The Rhetoric Of The Organizational Saga: A Fantasy Theme Analysis Of The Organizational Communication Culture Of The Louisiana State Police., Brookie Ann Allphin Jan 1994

The Rhetoric Of The Organizational Saga: A Fantasy Theme Analysis Of The Organizational Communication Culture Of The Louisiana State Police., Brookie Ann Allphin

LSU Historical Dissertations and Theses

This dissertation is a fantasy theme analysis of the organizational communication culture of the Louisiana State Police. This study interprets the rhetorical function of the organizational sagas of State Police. State Police has a distinct history aligned with Louisiana Politics. In 1937, General Louis F. Guerre, the first superintendent, envisioned a new State Police, immune from political pressures, "soldiers of the law in the first line of defense for society." The symbolic persona of LSP has survived through fifty-six years of politics and policing as the state's ranking law enforcement agency. As participant observer, the researcher gathered communication data and …

Jurisprudence Of Successful Treason: Coup D'Etat & Common Law, Tayyab Mahmud Jan 1994

Jurisprudence Of Successful Treason: Coup D'Etat & Common Law, Tayyab Mahmud

Faculty Articles

The first part of this article is a survey of all known judicial responses to coups d'etat in post colonial common law settings. Although these different coups unfolded in diverse contexts the courts validated all incumbent usurper regimes with one exception. Kelsen's theory of revolutionary legality furnished the primary doctrinal vehicle to reach this result. While some courts adopted Kelsen's proposition that efficacy of a coup bestows validity in an unadulterated form, others modified this with or substituted it by doctrines of state necessity, implied mandate, and public policy. Following Kelsen, they fail to distinguish between legitimacy and validity of …

"Snitching" For The Common Good: In Search Of A Response To The Legal Problems Posed By Environmental Whistleblowing, Stefan Ruetzel

LLM Theses and Essays

Despite the increase in public awareness of diminishing natural resources, mounting waste, and pollution and more comprehensive environmental regulations since the 1970’s, non-compliance with environmental laws and non-enforcement by government authorities is still a major problem in the United States. Disclosure of violations of environmental regulations by an employee of a private polluter, or whistleblowing, is an effective tool in enforcing the law and thereby protecting the environment. After examining the current whistleblowing law that has evolved in various jurisdictions across the country, this thesis proposes that a uniform state statute should be enacted to encourage employees to report violations …

Reconsidering The Tribal-State Compact Process, David E. Wilkins Jan 1994

Reconsidering The Tribal-State Compact Process, David E. Wilkins

Jepson School of Leadership Studies articles, book chapters and other publications

This essay evaluates the tribal‐state compact process, as one of several alternative, nonadversarial processes, warranting attention. It argues that, because of its binding character and relatively low cost (in contrast to litigation), and because it is based in the idea of tribes and states exhibiting mutual respect, the compact process is an advanced version of negotiation and bargaining that tribes and states should consider where appropriate.

South Africa's Long March To Freedom: A Personal View, Aubrey Immelman Jan 1994

South Africa's Long March To Freedom: A Personal View, Aubrey Immelman

Psychology Faculty Publications

In this article I first offer a brief historical account of European white settlement, and ultimately political dominance, in southern Africa. Next, I outline how whites, and in particular Afrikaner-dominated National Party governments after 1948, achieved almost total subjugation of South Africa’s black majority through oppressive legislation and the calculated use of force. In that regard I enumerate some of the draconian laws enacted in the post-1948 apartheid state — laws that served as an impetus for black nationalism, anger, resistance, protest and, after 1960, armed struggle to achieve liberation from white oppression. Against this background, I examine salient factors …
