Rights Of Privacy-An Analytical Model For The Negative Rights Of Attribution, R. David Grant Jan 1992

Rights Of Privacy-An Analytical Model For The Negative Rights Of Attribution, R. David Grant

Utah Law Review

The negative rights of attribution intended for artists by the provisions of the Berne Convention are: (1) the right of an artist to prevent continued attribution of a work of art that has been modified to the detriment of the artist's reputation; (2) the right of an artist to prevent attribution of a work of art not created by the artist; and (3) the right of the artist to remain anonymous or to use a pseudonym in connection with a work of art created by the artist. The right of an artist to prevent continued attribution of a work of …

Wilson V. Seiter. An Unsatisfying Attempt At Resolving The Imbroglio Of Eighth Amendment Prisoners' Rights Standards, Arthur B. Berger Jan 1992

Wilson V. Seiter. An Unsatisfying Attempt At Resolving The Imbroglio Of Eighth Amendment Prisoners' Rights Standards, Arthur B. Berger

Utah Law Review

The Cruel and Unusual Punishments Clause of the Eighth Amendment to the United States Constitution is of murky philosophical genesis, has been the subject of discordant interpretation, and has an uncertain fate. Like several other provisions of the Constitution, such as the due process guarantees of the Fifth and Fourteenth Amendments, the meaning of the Cruel and Unusual Punishments Clause, as well as the standards by which alleged violations are judged, has evolved over time. Yet, notwithstanding its enigmatic nature and praxis, the clause has been an historically important source of rights for those resident in our nation's prisons.

Bioethics And Fatherhood, Daniel Callahan Jan 1992

Bioethics And Fatherhood, Daniel Callahan

Utah Law Review

For most of the rest of our culture, the twin issues of the meaning of masculinity (or maleness, depending on your tastes), and the significance of fatherhood are well-developed topics of public discussion. Whether as a response to feminism, on the one hand, or to independent uncertainties about what it means to be a male, on the other, the question of masculinity attracts considerable attention. While fatherhood was not exactly a neglected topic in years past, there seems little doubt that the nasty phenomena of more and more single-parent families, mainly headed by females, and a growing number of absent …

Frail Parents, Robust Duties, Hilde Lindemann Nelson Jan 1992

Frail Parents, Robust Duties, Hilde Lindemann Nelson

Utah Law Review

The American College of Emergency Physicians recently reported that as many as 100,000 to 200,000 geriatric patients are abandoned each year in emergency rooms across the country. At San Francisco General Hospital alone, three to four such patients are abandoned each week, often suffering from dementia or other ailments that impose serious burdens on their families. As the human life span is extended in postindustrial societies, those who used to die now grow old and often infirm, yet the younger population, the prop and mainstay of old age, is shrinking proportionately. Care for the aged has begun to be a …

Bioethics And The Family. The Cautionary View From Family Law, Carl E. Schneider Jan 1992

Bioethics And The Family. The Cautionary View From Family Law, Carl E. Schneider

Utah Law Review

This attempt to glean lessons for bioethics from family law has yielded no determinate answers or easy principles. I have suggested that family law has recently struggled to avoid the standards problems. Yet I have argued that each method of doing so is itself importantly flawed and sharply limited. I must confess that, if anything, this survey has been too pessimistic, that it has looked more assiduously for the drawbacks than the benefits of each approach. I should also say that my survey has confined itself to examining broad approaches, rather than seeking the surely valuable lessons to be learned …

Reconciliation Of Civil Rights And Civil Liberties After Rav. V. City Of St. Paul: Free Speech, Antiharassment Policies, Multicultural Education, And Political Correctness At Arizona State University, Charles R. Calleros Jan 1992

Reconciliation Of Civil Rights And Civil Liberties After Rav. V. City Of St. Paul: Free Speech, Antiharassment Policies, Multicultural Education, And Political Correctness At Arizona State University, Charles R. Calleros

Utah Law Review

Much has been written in recent years about the rise in racial hostility on college campuses, about "hate speech" codes and educational measures adopted by many public universities in response to the hostilities, and about the issues of free speech and "political correctness" raised thereby. The debate is unlikely to be quieted by the United States Supreme Court's decision in R.AV. v. City of St. Paul, which raises new doubts about the constitutionality of a great many campus antiharassment policies. Some scholars have approached these issues painfully, reluctantly choosing between dearly held principles of equality and freedom of expression. In …

Fast Power Flow With Capability Of Corrective Control Using A Neural Network, Badrul H. Chowdhury, B. M. Wilamowski Jan 1992

Fast Power Flow With Capability Of Corrective Control Using A Neural Network, Badrul H. Chowdhury, B. M. Wilamowski

Electrical and Computer Engineering Faculty Research & Creative Works

The authors present a number of different configurations of a neural network and identify a particular case which is most suitable for power flow analysis in real-time applications. The advantage of fast computation of the artificial neural network (ANN) is used for obtaining power flow solutions in real time. The inputs to the ANN are the real and reactive power generating and demand in the system, and the output data are the complex bus voltages. A few configurations of the neural network were experimented with, and the best results were achieved with a single-layer feedforward neural network with nonlinear feedback. …

An Optical Adaptive Resonance Neural Network Utilizing Phase Conjugation, Donald C. Wunsch, D. J. Morris, T. P. Caudell, R. A. Falk Jan 1992

An Optical Adaptive Resonance Neural Network Utilizing Phase Conjugation, Donald C. Wunsch, D. J. Morris, T. P. Caudell, R. A. Falk

Electrical and Computer Engineering Faculty Research & Creative Works

An adaptive resonance (ART) device has been conceived that is fully optical in the input-output processing path. It is based on holographic information processing in a phase-conjugating crystal. This sets up an associative pattern retrieval in a resonating loop utilizing angle-multiplexed reference beams for pattern classification. A reset mechanism is used to reject any given beam, allowing an ART search strategy. The design is similar to an existing nonlearning optical associative memory, but it does allow learning and makes use of information the other device discards. This device is expected to offer higher information storage density than alternative ART implementations.

Moving Object Recognition And Guidance Of Robots Using Neural Networks, Abhijit Neogy, S. N. Balakrishnan, Cihan H. Dagli Jan 1992

Moving Object Recognition And Guidance Of Robots Using Neural Networks, Abhijit Neogy, S. N. Balakrishnan, Cihan H. Dagli

Mechanical and Aerospace Engineering Faculty Research & Creative Works

The design of a robust guidance system for a robot is discussed. The two major tasks for this guidance system are the online recognition of a moving object invariant to rotation and translation, and tracking the moving object using a neural-network-driven vision system. This system included computer software ported to the IBM PC and interfaced with an IBM 7535 robot. The operation of this guidance system involved recognition of a moving object and the ability to track it till the robot and effector was in close proximity of the object. It was found that the robot was able to track …

Coperite-Computer-Aided Tool For Power Engineering Research, Instruction, Training And Education, Badrul H. Chowdhury, D. E. Clark

Electrical and Computer Engineering Faculty Research & Creative Works

A graphics-oriented, primarily PC-based tool for education, research, and training in power engineering is introduced. The tool, called COPERITE, has all user interfaces resident on an IBM-386 microcomputer. Menus and windows are used for the interface, and attractive graphical representations and displays are included. Application programs that are interfaced are power flow, contingency analysis, economic dispatch, security-constrained dispatch, system stability, and fault analysis. These programs are executed on a VAX 8800 computer mainly for speed of execution. Information exchange between the PC and the VAX is made through an Ethernet connection which is transparent to the user. Results of execution …

Judicial Choice And Disparities Between Measures Of Economic Values, David S. Cohen Jan 1992

Judicial Choice And Disparities Between Measures Of Economic Values, David S. Cohen

Elisabeth Haub School of Law Faculty Publications

An important idea, which characterizes law in society, is a reluctance to move from the status quo. In general, one can argue that legal institutions and legal doctrine are not engaged in the redistribution of wealth from one party to another. This paper explores a possible explanation for that principle. The authors' research suggests that, across a wide range of entitlements and in a variety of contexts, individuals value losses more than foregone gains. The paper argues, as a matter of efficiency, that law and social policy might have developed in a manner consistent with this valuation disparity. Furthermore, this …

What Role Should The Federal Government Play In Consumer Protection?, David S. Cohen Jan 1992

What Role Should The Federal Government Play In Consumer Protection?, David S. Cohen

Elisabeth Haub School of Law Faculty Publications

The purpose of these remarks is to comment on and to reinforce many of the points made by Professor Neilson in his "Comment on the Recent Federal Proposals for the Rationalization of Trade Practices Regulation in Canada".' More broadly, I would like to take this opportunity to reflect on the motives and agenda of the current policies and constitutional reform proposals which address the role which the federal government should play in consumer protection generally.

Porting Chorus To The Pa-Risc: Booting, Jon Inouye, Ravi Konuru, Jonathan Walpole, Marion Hakanson

Computer Science Faculty Publications and Presentations

We started out with the low level Tut (HP-CX 2.0) boot code. One of our goals was to reuse as much of this code as possible, which would reduce the amount of low level code we would have to debug. This was very important, especially fiince the RP 9000/834 has a very complex I/O architecture and we lacked any sophisticated debugging tools. Writing the PA-Chorus boot code involved modifying the Tut code to match the Chorus startup sequence. In the remainder of this section, we present an overview of the PA-RISC boot mechanisms and the Chorus startup sequence. Sectlon 2 …

This document is part of a series of reports describing the design decisions made in porting the Chorus Operating System kernel to the Hewlett-Packard 9000 Series 800 workstation. This document summarizes the matches and mis-matches between Chorus and the PA-RISC and outlines the general lessons learned during the project.

This document is intended for people who are interested in (a) the separation of machinedependent micro-kernel code from machine-independent micro-kernel code, (b) the interaction between operating system design and the PA-RISC architecture, and (c) the portability ofthe Chorus operating system.

The first report in the series, Porting Chorus to the PA-RISe: …

Civil Practice, Jay C. Carlisle Jan 1992

Civil Practice, Jay C. Carlisle

Elisabeth Haub School of Law Faculty Publications

During the Survey year seventeen articles of the CPLR were amended and three new articles were added. Also, effective December 1, 1991, Congress has approved important amendments to the Federal Rules of Civil Procedure, Civil Justice Expenses and Delay Reduction Plans were adopted by the Board of Judges of the Southern and Eastern Districts of New York. Additionally, there have been significant developments in the decisional law of discovery, statute of limitations, sanctions, and res judicata. These and other areas should be of interest to the practitioner.

The New Prosecutors, Bennett L. Gershman Jan 1992

The New Prosecutors, Bennett L. Gershman

Elisabeth Haub School of Law Faculty Publications

The power and prestige of the American prosecutor have changed dramatically over the past twenty years. Three generalizations appropriately describe this change. First, prosecutors wield vastly more power than ever before. Second, prosecutors are more insulated from judicial control over their conduct. Third, prosecutors are increasingly immune to ethical restraints. Only the last point may provoke some controversy; the first two are easily documented, and generally accepted by the courts and commentators.

Part I of this article examines in greater detail this vast accretion of prosecutorial power, and explains how this transformation has resulted in a radical skewing of the …

Medicine And Law: Selected Recent Developments, M. Stuart Madden Jan 1992

Medicine And Law: Selected Recent Developments, M. Stuart Madden

Elisabeth Haub School of Law Faculty Publications

The dynamic interaction of medicine and law continues to raise difficult, cutting edge challenges for practitioners, scholars, and decision makers in both fields. The process of accommodating new medical problems, techniques, and solutions within the traditional doctrines and processes of the law involved many new or developing issues during the past year. This article will consider the state of the law, as reflected in recent decisions and legislation, in two particularly important medical-legal areas: AIDS and proof of causation.

Private Property Investment, Lucas And The Fairness Doctrine, John R. Nolon Jan 1992

Private Property Investment, Lucas And The Fairness Doctrine, John R. Nolon

Elisabeth Haub School of Law Faculty Publications

These remarks are not intended to advocate the interests of the new property rights movement. In fact, those advocates will be disappointed by what I say. Rather, I aspire to view the issue of real property regulation as broadly as possible, reaching beyond the jurisprudence of regulatory takings cases into the realms of real estate transactions law and comprehensive land use planning.
