They Often Are Half Obscure: The Rights Of The Individual And The Legacy Of Oliver W. Holmes, Sandra Day O'Connor
They Often Are Half Obscure: The Rights Of The Individual And The Legacy Of Oliver W. Holmes, Sandra Day O'Connor
San Diego Law Review
These remarks were delivered April 9, 1992 at the Nathaniel L. Nathanson Memorial Lecture series at the University of San Diego. In this lecture, Ms. O'Connor discusses Oliver Wendell Holmes' legacy as a Supreme Court Justice from 1902 to 1932. She explains how Holmes was an "originator of transforming thought," making reference to his jurisprudence of individual liberties and his contribution to constitutional law by applying the Bill of Rights to the states. She also makes note of his less popular and less well-known jurisprudence that has slipped into obscurity. In this way, Holmes' influence is only half perceived by …
The Exhaustion Doctrine: State Prisoners Caught Between Civil Rights Actions And Writs Of Habeas Corpus, Linda Marie Bell
The Exhaustion Doctrine: State Prisoners Caught Between Civil Rights Actions And Writs Of Habeas Corpus, Linda Marie Bell
San Diego Law Review
This Comment explores the conflict between two federal laws when prisoners challenging their confinement seek damages or declaratory relief. On one hand, the exhaustion doctrine requires state prisoners to exhaust their state remedies before filing a petition for a writ of habeas corpus in federal court when they contest their confinement. On the other hand, prisoners challenging their civil rights may file in federal court without exhausting all state remedies. This Comment addresses how federal courts should determine which rule to apply when a prisoner brings an action contesting confinement, but seeks only declaratory relief or damages. The author proposes …

Solutions Of The Heat Conduction Equation In Multilayers For Photothermal Deflection Experiments, William A. Mcgahan, Kevin D. Cole
Solutions Of The Heat Conduction Equation In Multilayers For Photothermal Deflection Experiments, William A. Mcgahan, Kevin D. Cole
Department of Mechanical and Materials Engineering: Faculty Publications
Exact expressions are presented for the deflection of a laser beam passing parallel to and above the surface of a sample heated by a periodically modulated axisymmetric laser beam. The sample may consist of any number of planar films on a thick substrate. These exact expressions are derived from a local Green’s function treatment of the heat conduction equation, and contain an exact analytical treatment of the absorption of energy in the multilayered system from the heating laser. The method is based on calculation of the normal component of the heat fluxes across the layer boundaries, from which either the …

Modeling Of A-Si : H Deposition In A Dc Glow Discharge Reactor, Dariusz Orlicki, Vladimir Hlavacek, Hendrik J. Viljoen
Papers in Reaction Kinetics
PECVD reactors are increasingly used for the manufacturing of electronic components. This paper presents a reactor model for the deposition of amorphous hydrogenated silicon in a dc glow discharge of Ar-SiH4 The parallel-plate configuration is used in this study. Electron and positive ion densities have been calculated in a self-consistent way. A macroscopic description that is based on the Boltzmann equation with forwardscattering is used to calculate the ionization rate. The dissociation rate constant of SiH4 requires knowledge about the electron energy distribution function. Maxwell and Druyvesteyn distributions are compared and the numerical results show that the deposition …
Alternative Behavior Programs To Be Effectively Implemented In Middle Schools, Suzanne G. Carlson
Alternative Behavior Programs To Be Effectively Implemented In Middle Schools, Suzanne G. Carlson
Masters Theses and Doctoral Dissertations
Discipline in public schools tends to be the primary concern of people today. Disciplinary problems are not necessarily the school's fault. Many of the responsibilities traditionally assigned to the home are now assumed by the schools. Transportation, feeding, child care, substance abuse education, and sex education are just a few responsibilities now initiated by the public school system. Funding for public education has also declined in the past ten years. Because of this, new facilities are not being built to handle overcrowding, more teachers can not be hired to lower student/teacher ratios, and alternative methods of discipline are not being …
Biomechanics Of Corneal Wound Healing, James Charles Ramier
Biomechanics Of Corneal Wound Healing, James Charles Ramier
Theses
The re-establishment of tissue continuity, function, and mechanical proper ties after a through-and-through incision is an important issue in corneal surgery and trauma. Variations in healing can affect vision and patient activity during the recovery period, which may last up to five years. Growth factors introduced into the open wound have the potential to speed up the wound-healing process. The current investigation is concerned with quantitatively characterizing the mechanical properties of corneal tissue and evaluating the effects of epidermal growth factor (EGF), insulin-like growth factor (IGF), and platelet-derived growth factor (PDGF) on accelerating the wound-healing process as compared to a …
Addition Of Arenesulfenyl Chlorides To Quadricyclene, Robert J. Niger
Addition Of Arenesulfenyl Chlorides To Quadricyclene, Robert J. Niger
Theses
The addition of arenesulfenyl chlorides to quadricyclene has been investigated. These reactions are rapid, exothermic and yield primairly three isomers. Two of the isomers (type I and type II structures) have the norbornene and nortricyclene carbon skeletons respectively. The structure of the nortricyclene isomer has been thoroughly established with a wide variety of techniques including 2D NMR. It has been found that a bridged sulfonium ion is not an important product precurser in these electrophilic addition reactions. In a attempt to force the formation of a bridged ion, preliminary studies using arenesulfenyl chlorides in which the aromatic ring contains electron-donating …
Multiple Learner Systems Using Resampling Methods, Binyun Xie
Multiple Learner Systems Using Resampling Methods, Binyun Xie
Computer Science Theses & Dissertations
The N-Learners Problem deals with combining a number of learners such that the resultant system is "better", under some criterion, than the best of the individual learners. We consider a system of probably approximately correct concept learners. Depending on the available information, there are several methods to make the composite system better than the best of the individual learners. If a sample and an oracle that generates data points (but, not their classification) is available, then we show that we can achieve arbitrary levels of the normalized confidence of the composite system if (a) a robust learning algorithm is available, …
Isolation And Characterization Of The Triiodothyronine Regulatory Region Of The Fatty Acid Synthase Gene In Avian Species, Delfina Rivera Valencia
Isolation And Characterization Of The Triiodothyronine Regulatory Region Of The Fatty Acid Synthase Gene In Avian Species, Delfina Rivera Valencia
Masters Theses
Fatty acids are utilized for energy storage in the form of triglycerides or neutral fats. One way to regulate fatty acid biosynthesis is to regulate the activity of fatty acid synthase (FAS), the enzyme that catalyzes the reaction. Previous studies have shown that regulation of FAS activity and synthesis is regulated by the hormone triiodothyronine, T3, at the level of transcription. Thus, isolation and characterization of the promoter region o f the FAS gene will enable the identification of the thyroid hormone response elements (TREs). This study could shed light on the mechanisms on how this gene can …
Does Overeducation Imply Poor Schooling Quality For Mexican American Men?, Marie T. Mora
Does Overeducation Imply Poor Schooling Quality For Mexican American Men?, Marie T. Mora
SHRI Publications
This paper attempts to reconcile a contradiction in the economics of education research. On the one hand, research suggests that Americans, particularly Mexican Americans, are overeducated, and consequently earn lower returns to education than adequately' educated peers. On the other hand, Mexican Americans have been well documented to receive lower education levels than non-Hispanic whites. To explain this research inconsistency, the earnings function used by Verdugo and Verdugo (1988) is examined to discover if the purported overeducation earnings penalty results from an empirical model misspecification. In addition, the relationship between education quality and earnings is examined for Mexican Americans, blacks, …

The Effects Of Ddavp On Speed Of Accessing Long-Term Memory And Incidental Learning In Healthy Male And Female Volunteers, Robyn R. Swenson
Theses and Dissertations
The effects of desmopressin acetate (DDAVP), a vasopressin analog, were investigated using a computerized task designed to measure speed of accessing long-term memory at three levels of processing (physically identical decisions, same name decisions and same category decisions), and an unexpected free recall of the words presented. Forty-one healthy females and forty-three healthy males (age 18-34) intranasally received either 60 ug DDAVP in 0.6 ml of solution or 0.6 ml of saline 20 minutes prior to testing. DDAVP did not affect response time on the computerized task; however, when response time control trials were subtracted from the corresponding cells of …
Childhood Sexual Abuse As An Antecedent Of Problem Drinking And Sexual Dysfunction In Women, Sue Ann Russell
Childhood Sexual Abuse As An Antecedent Of Problem Drinking And Sexual Dysfunction In Women, Sue Ann Russell
Theses and Dissertations
A number of studies have linked childhood sexual abuse to problems with alcohol and sexual dysfunction in adult women. Moreover, some researchers suggest temporal sequences in which either (a) early sexual abuse increases women's risks of sexual dysfunction, which in turn leads to increased alcohol use, or (b) the reverse, in which sexual abuse contributes to excessive drinking, which in turn impairs sexual functioning.
Most studies of these issues to date have had serious methodological problems (e.g., small samples, often from clinical populations lacking control groups). Additional limitations have been the limited range of variables measured and the lack of …
Transforming Growth Factor-Beta 1 Expression In Developing Ovine Teeth As Visualized By In Situ Hybridization, Søren Jepsen
Transforming Growth Factor-Beta 1 Expression In Developing Ovine Teeth As Visualized By In Situ Hybridization, Søren Jepsen
Loma Linda University Electronic Theses, Dissertations & Projects
Recently we demonstrated that human dentin contained relatively high amounts of transforming growth factor beta (TGF-ß) and proposed that dentin TGF-ß originated from odontoblasts. Because of the suggested role of TGF-ß in mediating cellular interactions in dental cell development by paracrine mechanisms, we studied the expression of TGF-ß message in developing teeth by in situ hybridization. 5 µm serial sections of neonatal sheep mandibular third molars that had been fixed in glutaraldehyde and paraffin-embedded were used for in situ analysis. An [35S]-labeled cRNA probe, complementary to TGF-ß1 mRNA, was constructed from human TGF-ß1 cDNA. Northern analysis of total …
When Lehi's Party Arrived In The Land, Did They Find Others There?, John L. Sorenson
When Lehi's Party Arrived In The Land, Did They Find Others There?, John L. Sorenson
Journal of Book of Mormon Studies
A number of statements in the Book of Mormon text indicate the presence in Lehi’s promised land of peoples other than those descended from Lehi’s party. Reasons the topic is not addressed more explicitly in the record include a focus on the Nephites (and not on other people), a generic treatment of Lamanites, an a desire not to waste space on something obvious or insignificant. Clear evidence for the presence of others in substantial populations is present in the Book of Mormon. The demographic or cultural history of Lehi’s literal descendants must take into account these other groups.
Legal Perspectives On The Slaying Of Laban, John W. Welch
Legal Perspectives On The Slaying Of Laban, John W. Welch
Journal of Book of Mormon Studies
This article marshals ancient legal evidence to show that Nephi’s slaying of Laban should be understood as a protected manslaughter rather than a criminal homicide. The biblical law of murder demanded a higher level of premeditation and hostility than Nephi exhibited or modern law requires. The terms of Exodus 21:13, it is argued, protected more than accidental slayings or unconscious acts, particularly where God was seen as having delivered the victim into the slayer’s hand. Various rationales for Nephi’s killing of Laban include ancient views on surrendering one person for the benefit of a whole community. Other factors within the …
Limhi In The Library, John Gee
Limhi In The Library, John Gee
Journal of Book of Mormon Studies
Analysis of comparative data and historical background indicates that the quotations in Mosiah 7–22 are historically accurate. Further examination of the quotations of Limhi shows that they depend heavily on other sources. This implies some things about the character of Limhi and provides as well attendant lessons for our own day.

A Correlation Of The Sidon River And The Lands Of Manti And Zarahemla With The Southern End Of The Rio Grijalva (San Miguel), Janet F. Hilton, John L. Hilton
Journal of Book of Mormon Studies
We construct a detailed geographical model of the Nephite homeland areas of Manti, Zarahemla, and the river Sidon using the Book of Mormon text of around 80 BC. This model assumes that these areas are located in Mesoamerica, that the names of their surrounding seas do not necessarily correspond to local compass directions, and that the directions stated in the text are to be understood in the nontechnical normal English sense. We then describe the southern end of the Grijalva river basin, located across the southern part of the Mexico–Guatemala border. We nominate this area as a possible candidate for …
