It is a privilege to offer a lecture in this series named for Edward J. Bloustein. Not many lecture series honor sitting university presidents who deliver the first lecture in the series; but President Bloustein is the very rare president whose long tenure in office has been accompanied by continuing academic productivity. That achievement is remarkable.

When I tentatively chose this topic a year ago, I knew it involved the application of philosophical insights to serious practical questions, the kind of work that President Bloustein has done so well. I also knew that the search for those aspects of human …

Limiting Section 301 Preemption: Three Cheers For The Trilogy, Only One For Lingle And Lueck, Michael C. Harper

After Lueck the preemption of state law claims by employees covered by collective bargaining agreements seemed to spread.²⁶ Lingle partially stemmed the flow, ²⁷ but the lower courts continue to deny significant state law rights to unionized employees in the name of section 301 and the arbitration process that it has encouraged. ²⁸ Many of these lower court decisions paint a much too broad swath of section 301 preemption through the range of employment rights now being made available by state law.

The fault, I suggest, lies with the preemption test suggested in Lueck and expressly articulated in Lingle …

In the long-awaited and much-discussed Nancy Cruzan case, a 5-4 Supreme Court majority ruled that absent "clear and convincing evidence" that a once but no longer competent patient wishes to discontinue her life support (in this instance artificial nutrition and hydration) a state is not constitutionally compelled to terminate that support.

Nancy's situation is tragic. Since suffering severe injuries in 1983, she has been in a persistent vegetative state. Yet medical experts testified that if her feeding tube were not removed she could linger on in her present condition for many years.

Electron Energy Loss Study Of Iron Epitaxially Grown On Copper(100), Copper(111) And Copper(110)., Nipon Thangprasert

The growth of iron up to several monolayers in thickness on Cu(100), Cu(111) and Cu(110) are studied using the combined techniques of AES and EELS. The graphs of the Auger peak-to peak-height of iron and copper as a function of iron thickness do not clearly show the linear segment which is the indication of the layer growth. The results from EELS indicate that the fcc iron formed first and then some bcc iron is formed on the top of this fcc iron. The critical thicknesses for the indication of bcc iron are 13 ML for Cu(100), 3 ML for Cu(111) …

This study is about the relationship of content in teaching to the process in teaching for the purpose of helping students to become better readers of literature. This study investigates two selected teaching strategies supported by research to be effective, and applies them to the teaching of a canonical piece of literature, The Scarlet Letter by Nathaniel Hawthorne. This study employs literary theory in the development of the objectives and applies both cooperative learning and mastery learning methods to the teaching of this novel. Age And Experience Effects In Spatial Visualization, Timothy A. Salthouse, Renee L. Babcock, Eric Skovronek, Debora R. D. Mitchell, Roni Reiter-Palmon

Psychology Faculty Publications

Three studies were conducted to investigate effects related to age and experience on measures of spatial visualization ability. All research participants were college-educated men; those in the experienced group were practicing or recently retired architects. The major results of the studies were (a) that increased age was found to be associated with lower levels of performance on several tests of spatial visualization and (b) that this was true both for unselected adults and for adults with extensive spatial visualization experience. These findings seem to suggest that age-related effects in some aspects of cognitive functioning may be independent of experiential influences. …

The precise nature of W. S. Jevons's utilitarianism as a guiding rule for economic policy has yet to be investigated, and that will be the first issue treated in this paper. While J. A. Schumpeter, for instance, asserted that 'some of the most prominent exponents of marginal utility' (including Jevons), were 'convinced utilitarians', he did not investigate the further implications for Jevons's policy analysis.¹
