The Legal Status Of The Unborn After Webster, Jeffrey A. Parness

The recent U.S. Supreme Court decision in Webster v. Reproductive Health Services, as well as recent advances in our understanding of human reproduction, has prompted new dialogue on the legal status of the unborn and on the level of legal protection appropriate for potential human life. In joining the dialogue, this commentary is prompted by several concerns. First, the landmark decision in Roe v. Wade has frequently been misunderstood, creating much confusion over the permissible boundaries of protecting potential human life. Ideology, Racism And Morality: Investigating The Structural Origins Of Drug Prohibition, John P. Hoffmann

This paper explores the origins of drug prohibition in the United States from a structural perspective. The primary locus ,son how certain economic conditions in U.S. history influenced attitudes toward racial and ethnic minorities during the 1800s and early 1900s. and indirectly affected the passage or prohibitory drug laws. The economic structure continues to Influence the current illegal drug market. Moreover, some consequences of legal and illegal drug use identify the impact of the economic structure on drug prohibition.

Observations On Recent Efforts To Deter Frivolous Papers In The Illinois Circuit Courts, Jeffrey A. Parness

Recently, significant legislative initiatives have been made to deter the filing of frivolous papers in the Illinois Circuit Courts. These initiatives authorize the imposition of sanctions on those who file litigation papers determined to be without adequate support. The 1986 amendments to section 2-611 of the Illinois Code of Civil Procedure and the 1989 Illinois Supreme Court's adoption of Rule 137 represent the most significant of these legislative initiatives. These changes in Illinois law were comparable to the procedural law changes effected recently for many other state trial courts and for the federal district courts. While significant national attention has recently been paid to varying questions about the legal duties of prospective mothers to their unborn children, little comparable focus has been placed on the duties of prospective fathers. Why the difference? Though men and women obviously participate differently in nurturing the development of potential human life, there is much that both prospective parents can do to promote the well-being of their future offspring. This inattention to male responsibilities not only undercuts prevailing governmental interests in protecting potential life, but also may, at times, constitute prohibited sex discrimination. X-ray windows are used in sources and detectors to separate the neighborhood of the x-ray generation or detection from the use environment. While each use has its own requirements, there are some principles that should be used in designing an optimal x-ray window. Because x-rays are absorbed to some extent by all materials, minimizing absorption is one criterion in preparing windows. Also, for most uses there is a pressure difference across the window so that ensuring pinhole-free structure and sufficient mechanical strength to support the differential is another criterion for window design. It is a privilege to offer a lecture in this series named for Edward J. Bloustein. Not many lecture series honor sitting university presidents who deliver the first lecture in the series; but President Bloustein is the very rare president whose long tenure in office has been accompanied by continuing academic productivity. That achievement is remarkable.

Limiting Section 301 Preemption: Three Cheers For The Trilogy, Only One For Lingle And Lueck, Michael C. Harper

After Lueck the preemption of state law claims by employees covered by collective bargaining agreements seemed to spread.²⁶ Lingle partially stemmed the flow, ²⁷ but the lower courts continue to deny significant state law rights to unionized employees in the name of section 301 and the arbitration process that it has encouraged. ²⁸ Many of these lower court decisions paint a much too broad swath of section 301 preemption through the range of employment rights now being made available by state law.

In the long-awaited and much-discussed Nancy Cruzan case, a 5-4 Supreme Court majority ruled that absent "clear and convincing evidence" that a once but no longer competent patient wishes to discontinue her life support (in this instance artificial nutrition and hydration) a state is not constitutionally compelled to terminate that support.

Nancy's situation is tragic. Since suffering severe injuries in 1983, she has been in a persistent vegetative state. Yet medical experts testified that if her feeding tube were not removed she could linger on in her present condition for many years.

The growth of iron up to several monolayers in thickness on Cu(100), Cu(111) and Cu(110) are studied using the combined techniques of AES and EELS. The graphs of the Auger peak-to peak-height of iron and copper as a function of iron thickness do not clearly show the linear segment which is the indication of the layer growth. The results from EELS indicate that the fcc iron formed first and then some bcc iron is formed on the top of this fcc iron. The critical thicknesses for the indication of bcc iron are 13 ML for Cu(100), 3 ML for Cu(111) …
