Can A Cost Sharing Arrangement Prevent A Tax Shelter Label?, Jeffrey M. Kadet
Can A Cost Sharing Arrangement Prevent A Tax Shelter Label?, Jeffrey M. Kadet

In connection with an ongoing effort of the government to examine certain Microsoft documents, the government on October 12, 2016, stated in a filed document that one of the transactions at issue is "unquestionably" a tax shelter for purposes of section 7525. The significance of that is in whether some written communications should be protected from IRS scrutiny by the section 7525 confidentiality privilege that may apply to tax advice between a taxpayer and tax practitioners. Under section 7525(b)(2), written communications will not qualify if they are "in connection with the promotion of the direct or indirect participation of the …
An Investigation Into Spent Coffee Waste As A Renewable Source Of Bioactive Compounds And Industrially Important Sugars, Damhan Scully, Amit Jaiswal, Nissreen Abu-Ghannam
An Investigation Into Spent Coffee Waste As A Renewable Source Of Bioactive Compounds And Industrially Important Sugars, Damhan Scully, Amit Jaiswal, Nissreen Abu-Ghannam
Articles
Conventional coffee brewing techniques generate vast quantities of spent espresso grounds (SEGs) rich in lignocellulose and valuable bioactives. These bioactive compounds can be exploited as a nutraceutical or used in a range of food products, while breakdown of lignocellulose generates metabolizable sugars that can be used for the production of various high-value products such as biofuels, amino acids and enzymes. Response surface methodology (RSM) was used to optimize the enzymatic saccharification of lignocellulose in SEGs following a hydrothermal pretreatment. A maximum reducing sugar yield was obtained at the following optimized hydrolysis conditions: 4.97 g of pretreated SEGs, 120 h reaction …
How And Why International Law Binds International Organizations, Kristina Daugirdas
How And Why International Law Binds International Organizations, Kristina Daugirdas
Articles
For decades, controversy has dogged claims about whether and to what extent international law binds international organizations (“IOs”) like the United Nations and the International Monetary Fund. The question has important consequences for humanitarian law, economic rights, and environmental protection. In this Article, I aim to resolve the controversy by supplying a theory about when and how international law binds IOs. I conclude that international law binds IOs to the same degree that it binds states. That is, IOs are not more extensively or more readily bound; nor are they less extensively or less readily bound. This means that IOs, …
Microbial Enzyme Production Using Lignocellulosic Food Industry Wastes As Feedstock: A Review, Amit Jaiswal, Rajeev Ravindran
Microbial Enzyme Production Using Lignocellulosic Food Industry Wastes As Feedstock: A Review, Amit Jaiswal, Rajeev Ravindran
Articles
Enzymes are of great importance in the industry due to their substrate and product specificity, moderate reaction conditions, minimal by-product formation and high yield. They are important ingredients in several products and production processes. Up to 30% of the total production cost of enzymes is attributed to the raw materials costs. The food industry expels copious amounts of processing waste annually, which is mostlylignocellulosicin nature. Upon proper treatment, lignocellulosecan replace conventional carbon sources in media preparations for industrial microbial processes, such as enzyme production. However, wild strains of microorganisms that produce industrially important enzymes show low yield and cannot thrive on …
Power-Weighted Divergences For Relative Attenuation And Delay Estimation, Ruairí De Fréin, Scott T. Rickard Prof
Power-Weighted Divergences For Relative Attenuation And Delay Estimation, Ruairí De Fréin, Scott T. Rickard Prof
Articles
Power-weighted estimators have recently been proposed for relative attenuation and delay estimation in blind source separation. Their provenance lies in the observation that speech is approximately windowed-disjoint orthogonal (WDO) in the time-frequency (TF) domain; it has been reported that using WDO, derived from TF representations of speech, improves mixing parameter estimation. We show that power-weighted relative attenuation and delay estimators can be derived from a particular case of a weighted Bregman divergence. We then propose a wider class of estimators, which we tune to give better parameter estimates for speech.

Evaluation Of Ultrasound Assisted Potassium Permanganate Pre-Treatment Of Spent Coffee Waste, Rajeev Ravindran, Swarna Jaiswal, Nissreen Abu-Ghannam, Amit Jaiswal
Articles
In the present study, novel pre-treatment for spent coffee waste (SCW) has been proposed which utilises the superior oxidising capacity of alkaline KMnO4 assisted by ultra-sonication. The pre-treatment was conducted for different exposure times (10, 20, 30 and 40 min) using different concentrations of KMnO4 (1,2, 3, 4, 5% w/v) at room temperature with solid/liquid ratio of 1:10. Pretreating SCW with 4% KMnO4 and exposing it to ultrasound for 20 min resulted in 98% cellulose recovery and a maximum lignin removal of 46%. 1.7fold increase in reducing sugar yield was obtained after enzymatic hydrolysis of KMnO4 …

Fermentation-Assisted Extraction Of Isothiocyanates From Brassica Vegetable Using Box-Behnken Experimental Design, Amit Jaiswal, Nissreen Abu-Ghannam
Articles
Recent studies showed that Brassica vegetables are rich in numerous health-promoting compounds such as carotenoids, polyphenols, flavonoids, and glucosinolates (GLS), as well as isothiocyanates (ITCs) and are involved in health promotion upon consumption. ITCs are breakdown products of GLS, and typically used in the food industry as a food preservative and colouring agent. They are also used in the pharmaceutical industry due to their several pharmacological properties such as antibacterial, antifungal, antiprotozoal, anti-inflammatory, and chemoprotective effects, etc. Due to their widespread application in food and pharmaceuticals, the present study was designed to extract ITCs from York cabbage. In order to …

What Lurks Below Beckles, Leah Litman, Shakeer Rahman

This Essay argues that if the Supreme Court grants habeas relief in Beckles v. United States, then it should spell out certain details about where a Beckles claim comes from and who such a claim benefits. Those details are not essential to the main question raised in the case, but the federal habeas statute takes away the Supreme Court’s jurisdiction to hear just about any case that would raise those questions. For that reason, this Essay concludes that failing to address those questions now could arbitrarily condemn hundreds of prisoners to illegal sentences and lead to a situation where the …

Gear Tooth Mesh Stiffness: A Comparison Of Calculation Approaches, Christopher G. Cooley, Chunguang Liu, Xiang Dai, Robert G. Parker
Gear Tooth Mesh Stiffness: A Comparison Of Calculation Approaches, Christopher G. Cooley, Chunguang Liu, Xiang Dai, Robert G. Parker
Articles
This work compares spur gear tooth mesh stiffness calculations using two approaches. The first is a common approach from the literature that calculates the mesh stiffness by dividing the mesh force by the mesh deflection, which we call the average slope method. The second approach calculates the local slope of the force-deflection curve about a nominal deflection. The two approaches result in meaningfully different mesh stiffness predictions that persist for wide ranges of applied torque and for gear teeth with tooth surface modifications. It is shown that each calculation approach has its own distinct use, broadly divided as average slope …

It is estimated that 5.9% of all human deaths are attributable to alcohol consumption and that the harmful use of ethanol ranks among the top five risk factors for causing disease, disability, and death worldwide. Ethanol is known to disrupt phospholipid packing and promote membrane hemifusion at lipid bilayers. With the exception of mitochondria involved in hormone synthesis, the sterol content of mitochondrial membranes is low. As membranes that are low in cholesterol have increased membrane fluidity and are the most easily disordered by ethanol, we hypothesize that mitochondria are sensitive targets for ethanol damage. HeLa cells were exposed to …

Infrared spectroscopy is a reliable, rapid and cost effective characterisation technique, delivering a molecular finger print of the sample. It is expected that its sensitivity would enable detection of small chemical variations in biological samples associated with disease. ATR-IR is particularly suitable for liquid sample analysis and, although air drying is commonly performed before data collection, just a drop of human serum is enough for screening and early diagnosis. However, the dynamic range of constituent biochemical concentrations in the serum composition remains a limiting factor to the reliability of the technique. Using glucose as a model spike in human serum, …

Using Advanced Conflict Waivers To Teach Drafting, Ethics, And Professionalism, Edward R. Becker
Articles
On a substantive and ethical level, I tell my students to take on faith that if you were to do all of this and take all this into account, if you were to apply the conflict of interest and the disqualifications rules, it could make it extremely difficult or many of the firms involved in these matters to avoid being conflicted out; especially, if the parties and the kind of firms involved were not dealing with these conflicts and issues until a problem arose. The question I ask my students again at this point is what could be done. What …
Should We Presume State Protection?, James C. Hathaway, Audrey Macklin
Should We Presume State Protection?, James C. Hathaway, Audrey Macklin
Articles
Professors Hathaway and Macklin debate the legality of the “presumption of state protection” that the Supreme Court of Canada established as a matter of Canadian refugee law in the Ward decision. Professor Hathaway argues that this presumption should be rejected because it lacks a sound empirical basis and because it conflicts with the relatively low evidentiary threshold set by the Refugee Convention’s “well-founded fear” standard. Professor Macklin contends that the Ward presumption does not in and of itself impose an unduly onerous burden on claimants, and that much of the damage wrought by the presumption comes instead from misinterpretation and …

Synthesis Of Orthogonally Protected Thioamide Dipeptides For Use In Solid-Phase Peptide Synthesis, Fintan Kelleher, Kim Manzor
Synthesis Of Orthogonally Protected Thioamide Dipeptides For Use In Solid-Phase Peptide Synthesis, Fintan Kelleher, Kim Manzor
Articles
Orthogonally protected thioamide-containing dipeptides were efficiently and cleanly prepared from the precursor dipeptides using Curphey’s method (P4S10, hexamethyldisiloxane (HMDO), reflux, DCM) in 67-96% isolated yield. This was in contrast to the use of Lawesson’s or Berzelius’ reagents where significant issues with reaction non-completion, decomposition and purification were observed. Subsequent clean removal of the dipeptides’ t-butyl ester protecting groups gave thioamide dipeptide acids which were suitable for use in solid-phase peptide synthesis (SPPS).
Evaluating The Afdb “High 5’S”: Bifocal Lenses Assessment Via Citizen Participation, Oluwasegun O. Seriki
Evaluating The Afdb “High 5’S”: Bifocal Lenses Assessment Via Citizen Participation, Oluwasegun O. Seriki
Articles
The thought of evaluating the AfDB high 5’s is tempting. It is, in fact, a herculean task and cannot just be achieved using a blanket approach or be dismissed with the common approach “…difficult is done at once; the impossible takes a little longer”. In reality, evaluating these high priority areas will involve much rigour and will involve finding that one area that is lacking but can improve on with a single change of lenses, consequently improving circumstances drastically. The high 5’s garner much attention in headlines, much is said about it, talks, seminars, and — who knows — maybe …
Supervision Of Students In Social Care Education: Practice Teachers' Views Of Their Role, Fiona Mcsweeney
Supervision Of Students In Social Care Education: Practice Teachers' Views Of Their Role, Fiona Mcsweeney
Articles
This paper presents findings from research about how practice
teachers in social care education in Ireland view their role, in
particular what elements they prioritise and what they see as relatively
unimportant. The aim of the research was exploratory, seeking to
discover commonalities and differences in how practice teachers saw
their role in the supervision of social care students. Q methodology
was used to compare the participants’ viewpoints. Twenty practice
teachers, from varying practice backgrounds and levels of experience,
sorted statements outlining aspects of the practice teacher’s role,
during individual interviews. Analysis indicates participants had two
ways of conceptualising the …

How The Sentencing Commission Does And Does Not Matter In Beckles V. United States, Leah Litman, Luke C. Beasley

Two years ago, in Johnson v. United States, the Supreme Court held that the so-called “residual clause” of the Armed Career Criminal Act (ACCA) is unconstitutionally vague. Last spring, the Court made this rule retroactive in Welch v. United States. Then in June, the Court granted certiorari in Beckles v. United States to resolve two questions that have split lower courts in the wake of Johnson and Welch: (1) whether an identically worded “residual clause” in a U.S. Sentencing Guideline—known as the career offender Guideline—is unconstitutionally void for vagueness; and (2) if so, whether the rule invalidating the Guideline’s residual …

Behaviour Of A Spd Switchable Glazing In An Outdoor Test Cell With Heat Removal Under Varying Weather Conditions, Aritra Ghosh, Brian Norton, Aidan Duffy
Articles
Suspended particle device (SPD) switchable glazing has potential to control transmission of solar radiation in the visible range by changing its transparency from 55% to 5%. Outdoor test cell characterisation of a SPD switchable glazing offered the dynamic solar heat gain coefficient (SHGC) which varied between 0.05 (when opaque) and 0.38 (when transparent). Reduction of maximum temperature rise of 11% and 15% was possible using SPD “transparent” and “opaque” state compared to same area double-glazing. Insulated test cell with water flow heat exchanger was employed to measure the cooling load reduction potential of SPD glazing while its transmission changed from …
Optimisation Of Fucoxanthin Extraction From Irish Seaweeds By Response Surface Methodology, Emer Shannon, Nissreen Abu-Ghannam
Optimisation Of Fucoxanthin Extraction From Irish Seaweeds By Response Surface Methodology, Emer Shannon, Nissreen Abu-Ghannam
Articles
Fucoxanthin is a xanthophyll pigment which occurs in marine brown algae (Phaeophyceae). The anti-diabetic, anti-obesity, anti-cancer, and antioxidant properties of fucoxanthin have been widely reported. Macroalgae, particularly brown seaweeds, grow prolifically around Irish coasts, representing a valuable resource of nutraceuticals such as fucoxanthin for functional food applications. The aim of this study was to maximise the solvent extraction yield from three anatomically discrete regions of the seaweed thallus: blade, stipe, and holdfast. Response surface methodology was applied to determine optimum parameters for extraction of fucoxanthin from the seaweed, Fucus vesiculosus, as a model species. A central composite design was …

This year Ireland celebrates the centenary of the Easter rebellion of 1916, the event which is generally regarded as having led to Ireland’s independence six years later. Drawing on Irish government archives, this paper presents the beginnings of Irish state hospitality in the 1920s the emergence of diplomatic dining in the 1930s hosted by the Irish head of state and the first attempts to establish inventories of state owned furniture abroad. The paper then discusses how the Department of External Affairs set out to acquire a dinner service for official entertainment by the Minister of External Affairs as a showcase …
