Dissertations

Background: Pain affects more than 75 million Americans and is the primary reason people seek medical attention. Pain is a common cause of disability and diminished quality of life. While anecdotal evidence exists regarding nurses’ use of distraction therapy activities in pain management, little empirical research data is available.

Purpose: To examine the effects of video game use (VGU) on pain perception, pain interference perception and perceived self-efficacy in pain management in adult inpatients.

Conceptual Model: The conceptual model is based on Self-efficacy Theory (Bandura, 1995). The antecedents of the concept of distraction therapy with use of VGs in patients’ …

Art Resale Royalty Options, Herbert I. Lazerow Jan 2016

Art Resale Royalty Options, Herbert I. Lazerow

Faculty Scholarship

A federal resale royalty law that would require payments from the reseller of art to an artist when her work is resold is under consideration. This article analyzes provisions that might be contained in such a law with comparisons to Australia, England, France and California. It begins by pointing out that these payments can be conceptualized as either a substitute for copyright royalties or for the profits of a joint venture between the artist and the collector. It analyzes the kinds of artwork on which a resale royalty should be payable, with specific attention to multiples, crafts, antiques and wine. …

Anxiously Awaiting The Future Of Restorative Justice In The United States, David R. Karp Phd, Olivia Frank B.A. Jan 2016

Anxiously Awaiting The Future Of Restorative Justice In The United States, David R. Karp Phd, Olivia Frank B.A.

School of Leadership and Education Sciences: Faculty Scholarship

The problems of mass incarceration and other criminal justice system failures in the United States—such as racial disparities, wrongful convictions, and high recidivism rates—have reached a tipping point. For the first time in decades, coalitions of politicians on the left and right are seeking criminal justice reform. What is the place of restorative justice in these efforts? What is the depth and breadth of restorative justice implementation? How familiar is the American public with restorative justice? How successful is the restorative justice movement? In this article, we seek answers to these questions as we try to assess the future of …

In-Hospital Factors Associated With Supplementation Among Healthy, Full-Term, Breastfed Infants, Jodi Kae O'Brien Jan 2016

In-Hospital Factors Associated With Supplementation Among Healthy, Full-Term, Breastfed Infants, Jodi Kae O'Brien

Dissertations

Background: Formula supplementation of healthy, term, breastfed infants born to mothers who plan to exclusively breastfeed persists at high rates, in spite of global reduction efforts. The identification of modifiable risk factors for supplementation and effective nursing care for successful breastfeeding is understudied.

Purpose: This study aimed to better understand the obstetrical, hospital, and nursing factors associated with supplementation during the hospital stay. The aims were: (1) examine the relationships between aspects of hospital care of infants who are supplemented compared to infants exclusively breastfed and (2) determine what in-hospital risk factors increase the odds of formula supplementation among a …

Latina Principals In Southern California: A Phenomenological Look Into Their Journey Towards Leadership, Fabiola Bagula Jan 2016

Latina Principals In Southern California: A Phenomenological Look Into Their Journey Towards Leadership, Fabiola Bagula

Dissertations

California is home to almost 15 million Latinos, however, according to the 2015 State of Higher Education Report for California, only 12% of the Latino population between the ages of 25 and 64 has a baccalaureate degree or higher, compared with 42% of the White population. Latina students have some of the lowest levels of educational attainment at every point in their K-12 journey and in general, very low occupational attainment. Given these troubling findings, this research sought to understand and tell the stories of Latinas in k-12 leadership positions in Southern California. In this study, Latinas describe how they …

Endemic Corruption In The People's Republic Of China, Emily Tran Jan 2016

Endemic Corruption In The People's Republic Of China, Emily Tran

San Diego International Law Journal

Since taking office in 2013, President Xi Jinping has emphasized the importance of enforcing his campaign against corruption. The number of bribery convictions issued in recent years and the possibility of receiving the death penalty for serious corruption-related crimes underscores the seriousness with which the CPC considers corruption. The penalties for bribery are harsh compared to most other countries and serve as a strong method of deterrence. Part II of this Article discusses the PRC's anti-corruption laws in the individual and commercial contexts and note the inherent problems in the CPC's enforcement efforts. Part III will discuss the impact of …

San Diego International Law Journal

This Comment will explore the right to be forgotten, how it is recognized in the European Union, and the trend toward the existence of such a right in the United States. Additionally, this comment will discuss how the right to be forgotten could lessen the impact data breaches have on individuals through the lens of the Ashley Madison hack. Lastly, this comment will discuss how, if the United States narrowed the scope of the European Union’s concept of the right to be forgotten to fit into the United States’ view of privacy and the First Amendment, the impact of data …

Rædende Iudithðe: The Heroic, Mythological And Christian Elements In The Old English Poem Judith, Judith Caywood Dec 2015

Rædende Iudithðe: The Heroic, Mythological And Christian Elements In The Old English Poem Judith, Judith Caywood

Undergraduate Honors Theses

This project, devoted to the Old English epic fragment Judith, argues that the title character arises from the complex multicultural forces that shaped Anglo-Saxon society, positing that she exists between the mythological, the heroic and the Christian. Simultaneously Christian saint, Germanic warrior and pagan demi-goddess or supernatural figure, Judith arbitrates amongst the seemingly incompatible forces that shaped the poet’s world, allowing the poem to serve as an important site for the making of a new Anglo-Saxon mythos, one which incorporates these disparate yet co-existing elements. Judith becomes a single figure who is able to reconcile these opposing forces within …

John Milton’S Orphic Dependency, Magenta S. Reynolds Dec 2015

John Milton’S Orphic Dependency, Magenta S. Reynolds

Undergraduate Honors Theses

The 17th-century poet John Milton invokes Ovid’s Orpheus as a source of strength and security in overcoming barriers of instability and insecurity, ultimately enabling Milton to claim his own authority as both a prophesizing poet and a bounds-breaking seeker of Classical knowledge. It is my argument that Milton’s dependency on Orpheus has been overlooked, and that it is only through an Orphic foundation that Milton is able to reach beyond artistic creativity, into higher registers of inspiration.

Milton repeatedly invokes the Orpheus in both his prose and poetry, including: Paradise Lost, Ad Patrem, Lycidas, and various sonnets and elegies. These …

Legitimacy And The International Trade Regime, Thomas Christiano Dec 2015

Legitimacy And The International Trade Regime, Thomas Christiano

San Diego Law Review

Issues of global justice and trade are usually dealt with in terms of what a just system of trade is like and what the distribution of income, opportunities, or welfare ought to be. But the question I address and explore is what a legitimate way of making decisions in the international realm is. This issue has arisen acutely in the case of the formation of the World Trade Organization (WTO) and other international institutions. In particular, many have complained that developed countries engaged in hard bargaining with developing countries in the conferences that led up to the formation of the …

Revising International Law: A Liberal Account Of Natural Resources, Fernando R. Tesón Dec 2015

Revising International Law: A Liberal Account Of Natural Resources, Fernando R. Tesón

San Diego Law Review

In this Article, I defend the view that natural resources originally belong to individuals who have legitimately established private property claims over them. Natural resources do not belong to a collective entity such as the people or the state. My argument is simple. Relying on the Lockean contractarian tradition, I argue that individuals must delegate any resource controlled by the state. This is because all powers of the state are, morally, delegated powers. A group’s claims over natural resources is entirely derivative of the original claims of its members. Only individuals can originally appropriate natural resources; only they have the …

Growing Charter School Segregation And The Need For Integration In Light Of Obama’S Race To The Top Program, Brooke Finley Nov 2015

Growing Charter School Segregation And The Need For Integration In Light Of Obama’S Race To The Top Program, Brooke Finley

San Diego Law Review

This Article contends that increasing the number of charter schools across the United States per the Obama administration’s RTT initiative is not the answer to closing the racial and economic achievement gap, at least not without significantly more accountability and oversight. Part II describes the RTT initiative and its promotion of more charter schools. This Article suggests that advocating for charter schools may be problematic without proper supervision put in place by the government. Charter schools are privately managed schools that receive public funding, yet they are exempt from some rules that all other taxpayer-funded schools must abide by that …

Juridical Subordination, Roy L. Brooks, Kelly C. Smith Nov 2015

Juridical Subordination, Roy L. Brooks, Kelly C. Smith

San Diego Law Review

The purpose of this Article is to play out the various conceptualizations of the black equality interest in post-civil rights America. How is the claim of juridical subordination manifested in current Supreme Court cases, and what might civil rights law look like if the Court were to avoid juridical subordination? Our ambition is not to analyze every landmark Supreme Court civil rights case—page limitations prevent us from doing that—but to provide a framework for analysis, setting the table for the juridical subordination inquiry. Furthermore, we do not here attempt to reconcile the disparate ways in which the black equality norm …

Brown, Fisher, And The Necessity Of Context To Achieve Racial Equity In Public Institutions, Kiyana Davis Kiel Nov 2015

Brown, Fisher, And The Necessity Of Context To Achieve Racial Equity In Public Institutions, Kiyana Davis Kiel

San Diego Law Review

The United States Constitution is a social, as well as legal, document and should be interpreted and applied as such. Context is crucial in constitutional interpretations. The law cannot and should not exist in a vacuum. When interpreting the Constitution, the lasting and pervasive impact of structural and institutional racism and the undercurrents of white privilege should not be ignored. In other words, when interpreting the Constitution, the civil rights of non-white society members must be acknowledged and addressed. Purely literal interpretations of law must give way to both legal—precedential—and societal contexts and, in particular, racial equity in the context …

Transnational English Language Teaching: Opportunities For Teacher Learning And Development, Sarina Chugani Molina Oct 2015

Transnational English Language Teaching: Opportunities For Teacher Learning And Development, Sarina Chugani Molina

School of Leadership and Education Sciences: Faculty Scholarship

As a teacher educator, I have long been interested in looking for ways in which to provide educational opportunities for students, particularly for those who are unable to receive education due to a variety of social and contextual factors. As a faculty member of a University dedicated to the values of equity and social justice, I looked for ways in which to embed these important principles into our TESOL teacher education program. In the fall of 2012, I had the opportunity to meet the founder of Kito International, a nonprofit organization in Nairobi, Kenya. At the time, our School of …
