Art Resale Royalty Options, Herbert I. Lazerow Oct 2015

Art Resale Royalty Options, Herbert I. Lazerow

Faculty Scholarship

Proposed federal law requires payments from the reseller of art to an artist when her work is resold. They can be conceptualized as a substitute for copyright royalties or for the profits of a joint venture between the artist and the collector. Application is analyzed by art type, especially multiples, place of sale, and nationality or residence of the seller, buyer, intermediary or artist, and by what constitutes a sale in a world of leases, exchanges, gifts, bequests, charitable donations, loans and casualty losses. If the base is gross sales price, is that the amount the seller receives, the amount …

Is Law A Technical Language?, Frederick Schauer Sep 2015

Is Law A Technical Language?, Frederick Schauer

San Diego Law Review

Although I believe that the collapse of the interpretation—construction distinction follows from some of what I have argued here, that conclusion is, at least for me, decidedly secondary. Far more important is recognition of the importance of the question of technical language in law and of the relationship between that question and the purposes of and audiences for law. If we are to understand what law is and how it operates, we need to understand to whom it speaks. If it speaks to everyone, as Bentham urged, then technical language in law is something to be lamented and expunged. But …

High-Speed Trading On Stock And Commodity Markets—From Courier Pigeons To Computers, Jerry W. Markham Sep 2015

High-Speed Trading On Stock And Commodity Markets—From Courier Pigeons To Computers, Jerry W. Markham

San Diego Law Review

A growing concern in the stock and commodity markets over the last several years has been the rise of high-frequency traders (HFTs). Those traders employ high-speed computer technology for the algorithmic origination, transmission and execution of their orders through fiber optic cables and microwave towers. That technology allows HFT orders to be executed in times measured in fractions of a second. As a result of this technological advance, HFTs are now dominating trading volumes. This phenomenon has, on the one hand, led to claims by proponents of high-speed trading that HFTs are an important source of market liquidity and should …

A Reason To Resist: The Use Of Deadly Force In Aiding Victims Of Unlawful Police Aggression, Kindaka Sanders Sep 2015

A Reason To Resist: The Use Of Deadly Force In Aiding Victims Of Unlawful Police Aggression, Kindaka Sanders

San Diego Law Review

Some two and a half years before the fatal shooting of Michael Brown by a Ferguson, Missouri Police Officer, the Indiana State Legislature enacted Indiana Code § 35-41-3-2 authorizing the use of force, including deadly force against public servants acting unlawfully against the persons or property of Indiana citizens. The statute, passed in March of 2012, is the first of its kind. It was passed in reaction to the Indiana Supreme Court's decision in Barnes v. State, which abolished the common law right to resist an unlawful arrest. Gun rights groups, most notably the National Rifle Association (NRA), responded in …

From Rescue To Representation: A Human Rights Approach To The Contemporary Anti-Slavery Movement, Austin Choi-Fitzpatrick Jul 2015

From Rescue To Representation: A Human Rights Approach To The Contemporary Anti-Slavery Movement, Austin Choi-Fitzpatrick

School of Peace Studies: Faculty Scholarship

Current efforts to end contemporary slavery represent a fourth wave of an Anglo-American abolitionist movement. Despite this historic precedent, there is little agreement on the nature of the problem. A review of current academic discourse, movement frames, and policy approaches suggests that six perspectives predominate: a prostitution approach focused on sexual exploitation of “women and girls”; a migration approach focused on the cross-border flow of migrants; a criminal justice approach focused on law and enforcement; a forced-labor approach emphasizing unfree labor; a slavery approach focused on trafficking in comparative-historical context; and a human rights approach centered on individual rights. This …

Compassion & Social Justice: 14th Sakyadhita International Conference On Buddhist Women, Karma Lekshe Tsomo Phd

Theology and Religious Studies: Faculty Scholarship

The 14 Sakyadhita International Conference on Buddhist Women in Yogyakarta, Indonesia, is an extraordinary crosscultural opportunity. Focusing on the theme “Compassion and Social Justice,” the conference introduces activists of the social justice movements in Indonesia and other Asian countries to Buddhist feminist wisdom, social analysis, lives, and experiences. At the same time, it introduces Buddhist communities to Indonesian activists and local social justice movements. The conference provides a space for attendees, volunteers, interpreters, and seminar and workshop presenters of different backgrounds to interact and break down perceived barriers. It creates a foundation for future collaborations among Buddhist feminists and social …

Delaware’S Familiarity, Brian J. Broughman, Darian M. Ibrahim Jun 2015

Delaware’S Familiarity, Brian J. Broughman, Darian M. Ibrahim

San Diego Law Review

This Article builds on our prior empirical research showing that, everything else equal, start-up firms financed by out-of-state investors are more likely to incorporate in Delaware. We argue that this finding is due to out-of-state investors’ familiarity with Delaware corporate law, and relative lack of familiarity with the corporate law of the start-up’s home state. In the current project, we extend our prior research by (i) developing an informal model distinguishing investor familiarity from related economic theories of network effects and learning effects, (ii) showing that our data are more consistent with familiarity than with these alternative explanations, and (iii) …

Legendary Pride: How Legends Derived From Times Of Oppression Influence Cultural Pride In Subsequent Eras Through The Analysis Of The Lowry War In Robeson County, North Carolina 1864-1872, Katrina Thoreson

Theses

This thesis will prove how legends derived from times of oppression in history are used to assert the identity of the oppressed. To emphasize the importance of a legend for one specific group, the victims of oppression, this thesis will present the Lowry War through both perspectives of the parties involved, the Lumbee and the oppressors, the white community of Robeson County. These perspectives appear on an interactive website accompanying this thesis, which can be found at www.henrylowry.com.

Making The Vision A Reality: Staging The Unreal In Realist Theatre, Sarah Zentner May 2015

Making The Vision A Reality: Staging The Unreal In Realist Theatre, Sarah Zentner

Undergraduate Honors Theses

This paper seeks to understand why visionary elements are sometimes implemented in otherwise realist works of theatre. Beginning with the father of realism, Henrik Ibsen, and discussing some of the social and domestic conventions present in his work, the paper then moves through an analysis of visionary elements, as they have been implemented in the following works: August Wilson's The Piano Lesson (1987) and Two Trains Running (1990), Tennessee Williams's A Streetcar Named Desire (1947), Arthur Miller's Death of a Salesman (1949), and Elizabeth Egloff's The Swan (1993). In doing so, the paper investigates how visionary elements can be effective …

Telephone Calls To Reduce 30-Day Readmissions For Older Adults With Heart Failure, Juanette G. Clark

Doctor of Nursing Practice Final Manuscripts

Abstract

Purpose: The purpose of this evidenced based practice project was to evaluate the effectiveness of discharge follow-up calls for heart failure (HF) patients recently discharged from a private hospital.

Background: HF is the number one discharge diagnosis among patients 65 years and older. It affects 5.8 million people in the United States. HF admissions total (1) million annually, however, 24% of these patients are readmitted within 30 days of discharge. Re-hospitalizations are associated with high mortality rates and expenditures approximated at $13,000 per patient contributing to the overall annual expenditure of $33.7 billion. In 2012, the Centers for Medicare …

Heart Failure Patient Self-Care: An Evidence-Based Outpatient Management Program, Christine Marie Ensign, Shelley Hawkins, Barry Greenberg

Doctor of Nursing Practice Final Manuscripts

Background: According to the American Heart Association, there are over 5 million people in the United States with heart failure (HF) and projections suggest the prevalence of HF will increase by 46% through 2030. HF is the most common cause of hospital admissions in the United States for patients age 65 years or older and despite improvement outcomes, national readmission rates remain high at 23%. Current guidelines recommend health professionals provide comprehensive HF education and counseling that is not only focused on knowledge, but also on skills of management and self-care behaviors. In order to achieve quality patient-centered care, …

Promoting Completion Of Advance Directives In A Hispanic Religious Congregation: An Evidence-Based Practice Project, Luis Daniel San Miguel, Mary Jo Clark May 2015

Promoting Completion Of Advance Directives In A Hispanic Religious Congregation: An Evidence-Based Practice Project, Luis Daniel San Miguel, Mary Jo Clark

Doctor of Nursing Practice Final Manuscripts

Background: Hispanics utilize more aggressive medical treatment at the end of life and are less likely to receive end-of-life care consistent with their wishes than nonHispanic Whites. Hispanics are less likely than nonHispanic Whites to have an advance directive (AD). Increasing AD completion among Hispanics can promote end-of-life care consistent with their wishes, diminish healthcare disparities, and eliminate unnecessary healthcare spending. Objectives: To promote completion of advance directives by increasing knowledge, positive attitudes, and comfort with advance care planning (ACP) among Hispanics through culturally sensitive interventions. Intervention: The project was conducted in Spanish and implemented among a …

Moral imagination can be defined as an act or process that involves the consideration of a moral-ethical tension and the generation of a novel and appropriate course of action that accommodates the situation. The purpose of this study was to understand how, if at all, might Balinese leaders demonstrate moral imagination using their sociocultural values. The following supporting research questions frame this study: (a) What sociocultural values inform the process by which Balinese leaders approach moral-ethical tension? (b) What specific interventions are part of Balinese leaders’ process in achieving their stated vision? (c) How, if at all, might the …

Hispanic Mothers’ Narratives: Experiences Of Parenting A Child With Cystic Fibrosis, Health Beliefs, And Health Care Experiences Related To Cystic Fibrosis, Linda Tirabassi-Mathis

Dissertations

The Hispanic population is the fastest growing minority in the United States and is also a minority in the cystic fibrosis (CF) community. Therefore, an increase in CF in the U.S. might be anticipated. This study explored stories of Hispanic mothers’ perspectives of parenting their child with CF, health beliefs, and health care experiences. The study interviewed 10 mothers of which half were English speaking. Narrative structural and thematic analyses were applied through a critical feminist lens. The major themes that emerged were mothering, growing and growth, mother talk, and connected; all informed by Ruddick’s (1995) framework on maternal thinking. …

Personality And Happiness, Brianna L. Kirkpatrick May 2015

Personality And Happiness, Brianna L. Kirkpatrick

Undergraduate Honors Theses

The connection between personality, emotions, and experience have been of interest to researchers for many years. The present study was designed to assess the specific connection between personality, happiness, and happiness inducing behaviors (HIB) within individuals. This study also extends previous research by assessing whether any or all of these variables were connected to the recommendations an individual would make to improve the mood of a hypothetical other. The data from 424 university students were analyzed to determine the relationship between self-reported extraversion and neuroticism and self-reported affect, engagement in HIB, and the recommendations provided. The results revealed the expected …

A Phenomenological Study Of Health Professionals’ Perceptions Of Good And Bad Pediatric Hospital Deaths, Self-Care Needs And Lingering Distress, Carmen Nichole Spalding May 2015

A Phenomenological Study Of Health Professionals’ Perceptions Of Good And Bad Pediatric Hospital Deaths, Self-Care Needs And Lingering Distress, Carmen Nichole Spalding

Dissertations

The death of a child is devastating. Although death is a part of every life, a child dying seems out of order in current times and in the context of Western Healthcare. Health professionals (HP) caring for dying children frequently report suffering. In the past four decades, HP have been concerned with providing a “good death” for patients at the end-of-life (EOL). While studies have shown what a good death includes in elderly patients in various settings, few studies have examined what constitutes a good death for pediatric patients within the hospital setting. No studies were found examining healthcare workers …
