Master Metaphors And Double-Coding In The Encounters Of Religion And State, Perry Dane
Master Metaphors And Double-Coding In The Encounters Of Religion And State, Perry Dane
San Diego Law Review
That term “existential encounter” is meant to convey several important ideas. First, it suggests that what is at stake here is not merely a set of legal doctrines or policy prescriptions, but something deeper and more constitutive. The sovereign nation-state, in some sense, looks out at the world around it and sees other entities that do not easily fit into its own internal sovereign architecture. Some of these are other nation-states. Some might be other types of essentially secular, but non-state, human associations. And others are, or should be, communities—large and small, organized or not, united or splintered—whose normative commitment …
Why The Ministerial Exception Is Consistent With Smith—And Why It Makes Sense, William A. Galston
Why The Ministerial Exception Is Consistent With Smith—And Why It Makes Sense, William A. Galston
San Diego Law Review
This conference puts on the table two linked questions: Can Hosanna-Tabor be reconciled with Employment Division v. Smith and, if so, on what basis? Let me say straightway that I have at most an amateur’s understanding of constitutional law and jurisprudence. I bring to our questions some intuitions about the best framework for thinking about them, and whatever light my home discipline of political theory can shed on them. I have also benefitted enormously from Christopher Lund’s splendid law review article on the topic of this conference.

Economic Espionage As Reality Or Rhetoric: Equating Trade Secrecy With National Security, Rochelle Cooper Dreyfuss, Orly Lobel
Economic Espionage As Reality Or Rhetoric: Equating Trade Secrecy With National Security, Rochelle Cooper Dreyfuss, Orly Lobel
Faculty Scholarship
In the last few years, the Economic Espionage Act (EEA), a 1996 statute that criminalizes trade secrecy misappropriation, was amended twice, once to increase the penalties and once to expand the definition of trade secrets and the types of behaviors that are illegal. Recent developments also reveal a pattern of expansion in investigation, indictments, and convictions under the EEA as well as the devotion of large resources by the FBI and other agencies to warn private industry against the global threats of trade secret theft. At the international level, the United States government has been advocating enhanced levels of trade …

The Complexity Of Providing Feedback When Teachers And Students Speak Different Varieties Of English In Transnational Language Teaching Contexts, Sarina Chugani Molina
The Complexity Of Providing Feedback When Teachers And Students Speak Different Varieties Of English In Transnational Language Teaching Contexts, Sarina Chugani Molina
School of Leadership and Education Sciences: Faculty Scholarship
The paradigm of English as an international language has shifted the ways in which we think about the ownership and use of English, particularly because it is estimated that more than 80% of communication in English is between non-native speakers of English. When so many varieties of Englishes are acknowledged as legitimate varieties, the question of assessing what it means to be proficient in English becomes critical. Through qualitative analysis, this study documents the ways in which American English teachers approached teaching English online to students in Nairobi, Kenya, and revealed the complexities of teaching and providing feedback in such …
English Language Teaching In China: Teacher Agency In Response To Curricular Innovations, Sarina Chugani Molina
English Language Teaching In China: Teacher Agency In Response To Curricular Innovations, Sarina Chugani Molina
School of Leadership and Education Sciences: Faculty Scholarship
This chapter explores the unique history of English Language Teaching in China, and the role of teacher agency in response to curricular changes. This study employed survey methodology with 72 Chinese English language teachers to understand the ways in which they adapt their curriculum within their local contexts. Interviews with five teachers and one teacher educator selected through purposeful sampling revealed additional factors that contributed to the teachers’ sense of agency. The complexity of the translation of theory into practice is revealed in light of the current ecological systems in which teachers and students are situated.

The Multiple Meanings Of San Diego's Little Italy: A Study Of The Impact Of Real And Symbolic Space And Boundaries On The Ethnic Identities Of Eight Italian Americans, Thomas Joseph Cesarini
The Multiple Meanings Of San Diego's Little Italy: A Study Of The Impact Of Real And Symbolic Space And Boundaries On The Ethnic Identities Of Eight Italian Americans, Thomas Joseph Cesarini
Dissertations
The literature suggests that identifying with a particular place can promote a sense of ethnic identity. This study focused on eight Italian American community members’ perceptions of San Diego’s Little Italy as both a container and creator of ethnic identity. The study addressed a) how the participants define and convey their Italian American ethnic identity and b) how the participants perceive the role of San Diego’s Little Italy pre-redevelopment and post-redevelopment in creating and shaping their sense of being Italian American.
The study employed a case-study design. Ethnohistoric accounts of life experiences were gathered from participants selected through convenience and …
A Mixed Methods Exploration Of Minority Resource Eligibility For Half White Multiracial College Students, Nicholas Reyes Franco
A Mixed Methods Exploration Of Minority Resource Eligibility For Half White Multiracial College Students, Nicholas Reyes Franco
Dissertations
Over the last several decades, multiracial populations have received increased attention in academic literature, particularly regarding identity development and psychological health and wellness. Less attention has been given to individuals with one minority and one white parent (i.e., half white individuals) in the context of affirmative action and higher education. Existing quantitative studies on this topic suggest, on the one hand, that half white individuals are likely to be considered members of racial minorities, yet, on the other hand, less of a minority—and less deserving of affirmative action benefits—than monoracial individuals or multiracial individuals with multiple minority identities. College students’ …
Transitions To Assisted Living Within A Continuing Care Retirement Community, Judith H. Scott
Transitions To Assisted Living Within A Continuing Care Retirement Community, Judith H. Scott
Dissertations
Purpose/Aims: The purpose of this study was to explore the lived experience of older single women who moved from their independent homes to the assisted living setting, both situated within a Continuing Care Retirement Community (CCRC).
Rationale: Anecdotally, CCRC transitions have been viewed as either one dreaded possible step toward the end of life or a supportive place to open a new chapter in older adults’ lives. However, no studies have actually examined this experience among older single women, who comprise a large proportion of people making this transition.
Background: Older adults move to assisted living within a CCRC when …
Transformative Models In K-12 Education: The Impact Of A Blended Universal Design For Learning Intervention, Kai Monet Mathews
Transformative Models In K-12 Education: The Impact Of A Blended Universal Design For Learning Intervention, Kai Monet Mathews
Dissertations
Accountability measures, by way of standardized curriculum and assessments, have played a large part in the attempt to ensure that students from all backgrounds receive equal access to quality education. However, the inherent disadvantage of a standardized system is the implied assumption that all students come in with the same knowledge, learn at the same pace, and learn the same way. In the wake of an increasingly diverse K-12 population, educational researchers, learning theorists, and practitioners agree that the concept of the average student is, in fact, a myth. Students come to school with different needs, norms, interests, cultural behavior, …
When Worlds Collide: Bringing The Native/Indigenous Transnational Nonprofit Leader To The Conversation, Christina E. Mitchell
When Worlds Collide: Bringing The Native/Indigenous Transnational Nonprofit Leader To The Conversation, Christina E. Mitchell
Dissertations
Transnationals have long been a subject of academic discussion. Described differently according to discipline and study, the primary characteristic of transnationals is that they cross borders in support of a broad range of purposes, including advocacy and service provision, and profession and research. While not explicitly engaged within the nonprofit conversation up to this point, transnationals do have an implicit association with the nonprofit sector. This dissertation locates the transnationals in the nonprofit sector bringing a particular type of transnational into the nonprofit conversation: the native/indigenous transnational nonprofit leader. Based on findings of an exploratory case study, this leader is …
The Evolution Of China’S Legislation On Reproduction, Du Yifang
The Evolution Of China’S Legislation On Reproduction, Du Yifang
San Diego International Law Journal
This Article discusses how Chinas policy on reproduction developed from one that encouraged population growth to the very restrictive one-child policy. Part I discusses the factors underlying the establishment of the reproduction system after 1949. Part II analyzes the transition of national olicy and legislation over the period from 1980 to 2001 from encouraging to controlling childbirth. Part III discusses, in detail, the development and implementation of the one-child policy, and Part IV discusses the effects of this development. Finally, Part V explains the 2016 amendment to the Population and Family Planning Law in China, which abandoned the one-child policy.
An Exploration Of The Use Of Photovoice-Inspired Techniques To Facilitate Narrative Leadership In A Small Group Of Middle-Aged Women, Michelle M. Zive
An Exploration Of The Use Of Photovoice-Inspired Techniques To Facilitate Narrative Leadership In A Small Group Of Middle-Aged Women, Michelle M. Zive
Dissertations
Leadership often is defined as a persuasive relationship. Over the last two decades, narrative leadership has been viewed in the Leadership Studies literature as a source of persuasion. Narrative leaders use stories to impact others in both large-scale political and social movements, as well as in large-scale organizations. Even as this has been happening, the field also has begun to re-conceptualize leadership as a group rather than an individual process, a view of leadership sometimes characterized as shared leadership. There is limited understanding of whether narrative leadership operates in shared leadership situations and a dearth of literature about specific techniques …
