Department of Anthropology: Faculty Publications
The aim of this article is to describe an aspect of Ye'kwana (Makiritare) technology, basketry, in its overall cultural context. We will not only describe basketry as technology per se but the role it plays in Ye'kwana symbolism, ecology, economy and social organization. Also, we will discuss its role in inter-village and inter-ethnic trade and how this role has implications for understanding socio-cultural change in the immediate area of the Padamo River Basin, Territorio Federal Amazonas, Venezuela.
The Pragmatics Of Scientific Laws, Michael A. Day
The Pragmatics Of Scientific Laws, Michael A. Day
Transactions of the Nebraska Academy of Sciences and Affiliated Societies
What it is for a statement to be a scientific law has been widely discussed and debated in the philosophy of science. Not only is the question interesting in itself, but it is essential that this question be answered if a complete analysis of such things as scientific explanation and prediction are to be given. The purpose of this paper will be to put forward an analysis of the phrase "X is reasonably classified as a scientific law at time t" in such a way as to highlight certain pragmatical aspects of scientific laws while doing justice to the syntactical …
Hypothesis In British Methodological Thought: Newton To Whewell, Gary Blum
Hypothesis In British Methodological Thought: Newton To Whewell, Gary Blum
Transactions of the Nebraska Academy of Sciences and Affiliated Societies
In this paper I wish to trace the gradual breaking away from the powerful influence of Isaac Newton's views on the admissibility of hypotheses in "experimental philosophy," mainly as this break occurred in the writing of 19th century methodologists in Great Britain.
First, let us consider Newton's notion of hypothesis. The term is used in many different ways in Newton's various writings (I. B. Cohen, in Franklin & Newton, has distinguished at least 9 different senses of the word). But two major considerations are relatively clear: Newton called his science "experimental philosophy" in order to contrast it with …
Applying Due Process To Gag Rules And Orders, Laurie Smith Camp
Applying Due Process To Gag Rules And Orders, Laurie Smith Camp
Nebraska Law Review
At its 1976 annual meeting held in August, the American Bar Association (ABA) House of Delegates recommended a new court procedure for the application of due process to the issuance of gag orders. The proposal seeks to render standing gag rules unenforceable and would provide for special gag orders only after notice and an opportunity for a hearing are given to interested parties. The ABA proposal will help to reduce the current glut of judicial restraints by providing more specific procedural guidance than was offered by the Supreme Court in Nebraska Press Association v. Stuart. This article first explores …

Dramatic Structure And Philosophy In Brutus, Alzire And Mahomet, Thomas M. Carr Jr.
Dramatic Structure And Philosophy In Brutus, Alzire And Mahomet, Thomas M. Carr Jr.
French Language and Literature Papers
An impressive amount of recent critical work has dealt with the philosophic element in Voltaire's tragedies. His plays have been labelled a theatre of involvement and a theatre of ideas; they have been examined from the standpoint of propaganda and as tragedy. However, the focus of such studies has been primarily on Voltaire's message or on the meaning of the plays, rather than on the dramatic structure he created to convey his philosophic concerns.
Today, of course, Voltaire does not rank high either as an original thinker or as a dramatist. Nonetheless, his attempt to introduce his philosophic concerns into his …
How To Apply The Categorical Imperative, Nelson T. Potter Jr.
How To Apply The Categorical Imperative, Nelson T. Potter Jr.
Department of Philosophy: Faculty Publications
The aim of the present paper is to give a new positive interpretation of how the categorical imperative is to be applied. There have been critiques of Kant's applications and defenses of Kant against such criticism, but it is surprisingly seldom that a positive interpretation of how the categorical imperative is to be applied has been offered.

Physical And Chemical Properties Of Outdoor Beef Cattle Feedlot Runoff, C. B. Gilbertson, J. R. Ellis, J. A. Nienaber, T. M. Mccalla, T. J. Klopfenstein
Nebraska Agricultural Experiment Station: Historical Research Bulletins
Within the past decade, emphasis has been placed on the quality of our environment. Beef cattle feedlots have been singled out as a significant source of environmental pollution. Environmental protection provided by control facilities requires basic knowledge of the physical and chemical properties of feedlot runoff. This bulletin summarizes studies of physical and chemical properties of beef cattle feedlot runoff completed from August, 1968 through December, 1972.

Bionomics Of Insects Associated With Corn In The Nebraska Sandhills, J. L. Wedberg, J. B. Campbell, T. J. Helms
Nebraska Agricultural Experiment Station: Historical Research Bulletins
Investigations were conducted in the Nebraska Sandhills to determine the impact of transition from grassland to irrigated corn on selected insect species, to identify indigenous species that may be economically important to corn production, and to provide a point of reference for future development of pest management programs for irrigated corn.

"Producing A World Crop In A World Market", Clayton K. Yeutter
"Producing A World Crop In A World Market", Clayton K. Yeutter
Clayton K. Yeutter, United States Secretary of Agriculture: Papers
From the very beginning, rice in the United States has been an export crop. History shows that the development of the U.S. rice industry started in about 1964, and by 1698 sufficient rice was being produced to warrant an effort to export it.
That same year a petition was drawn up in South Caroline where the rice was being produced to get the English to drop their import tariffs on colony-produced rice. Two years later about 300 tons were shipped to England.
A New Prescription For A Lens To Homer: Review Of Robert Fitzgerald's Translation Of The Iliad, Thomas Nelson Winter
A New Prescription For A Lens To Homer: Review Of Robert Fitzgerald's Translation Of The Iliad, Thomas Nelson Winter
Department of Classics and Religious Studies: Faculty Publications
HOMER, The Iliad, translated by ROBERT FITZGERALD, Doubleday.
One of the best things about this version was Fitzgerald’s decision to use the purist transliterations: the effect of this is to invite the reader to read as if he had never read an Iliad before. A single newly thought‐out rendering can nudge the reader into new thinking about Homer, thinking which he otherwise would not have done. The ultimate way to experience Homer will ever remain to become at home in Greek. Then the experience is your own. But for the price of fifteen dollars you can experience Fitzgerald’s experience of …

Implying A Civil Remedy From 15 U.S.C. § 1674(A): Stewart V. Travelers Corp., 503 F.2d 108 (9th Cir. 1974), Carl J. Circo
Nebraska Law Review
In Stewart v. Travelers Corp., the United States Court of Appeals for the Ninth Circuit held that a private remedy rather than only criminal sanctions should be implied for a violation of section 1674(a) of Title 15 of the United States Code. As a response to the dilemma of no specifically mentioned private remedy, federal courts have developed a policy of implying a civil remedy for violations of statutory prohibitions like section 1674(a). The court's opinion was based on the Texas & Pacific Railway v. Rigsby principle and the line of federal cases that have developed from it.

Statutory Forfeitures: The Taking Of Pearson's Yacht: Calero-Toledo V. Pearson Yacht Leasing Co., 416 U.S. 663 (1974), Steven E. Achelpohl
Statutory Forfeitures: The Taking Of Pearson's Yacht: Calero-Toledo V. Pearson Yacht Leasing Co., 416 U.S. 663 (1974), Steven E. Achelpohl
Nebraska Law Review
In Calero-Toledo v. Pearson Yacht Leasing Co., the United States Supreme Court recently reaffirmed its longstanding position that forfeiture statutes may be constitutionally applied to innocent property owners such as lessors, bailors, and secured creditors. The Court also held that seizure for purposes of forfeiture constitutes an "extraordinary situation" which justifies postponing notice and an adversary hearing. The decision overturned a lower court ruling which held the seizure and forfeiture to be unconstitutional on two distinct grounds: as a taking of property for government use without just compensation and as a taking of property without adequate notice and hearing. This …

A Setback For Environmental And Other Public Interest Plaintiffs: Alyeska Pipeline Service Co. V. The Wilderness Society, 421 U.S. 240 (1975), Robert L. Matthews
Nebraska Law Review
In Alyeska Pipeline Service Co. v. The Wilderness Society, the United States Supreme Court struck a severe blow to public interest litigation, particularly in the area of environmental law, by eliminating the "private attorney general" exception to the American rule. Although the American rule required parties in judicial proceedings to pay their own attorneys' fees, this exception had arisen which permitted public interest claimants to be awarded attorneys' fees. This article discusses the holding in Alyeska and examines the legal precedents and policy considerations of the private attorney general concept in order to demonstrate that the Supreme Court should …

Nebraska Game and Parks Commission: Publications
Nebraska's appearance today is greatly changed from its territorial, prestate days; so much so that it is difficult to imagine our vast, grass-covered plains without today's cities, roads, fences, farm and ranch buildings and other contributions of progress. This "sea of grass" of yesteryear was liberally sprinkled with sunflowers, wild legumes, wild rose, buckbrush and other low-growing shrubs. Streams in central and eastern Nebraska - the Loups, Cedar, Dismal, Calamus, Blue, Nemaha, Elkhorn, Niobrara and many of their tributaries - added variety by supporting a scruby growth of wild plum and chokecherry along their banks. Timbered areas were restricted to …

The Crux Of Merging Deltas: A Note On Alan Sillitoe, Robert S. Haller
Department of English: Faculty Publications
First paragraph:
The English Writer Alan Sillitoe is, to most Americans, a man of two books (or movies): Saturday Night and Sunday Morning (with Albert Finney); and The Loneliness of the Long-Distance Runner (with Tom Courtenay). Indeed, most Americans do not know that he has produced a book a year since 1959 (when The Long Distance-Runner came out), including eight other novels, three books of poems, two collections of short stories, one book of travel, one play, and one children's book. They know little about his life or the progress of his career, about his international connections or his present …

Societal Complexity And Moral Development: A Kenyan Study., Carolyn P. Edwards
Department of Psychology: Faculty Publications
This study examines the moral judgment levels (as measured by Kohlberg’s 6-stage moral judgment interview) for two Kenyan samples. The first sample includes a culturally and racially group of 35 young men and 17 women studying at the University of Nairobi, while the second sample consists of 44 males and 14 females living in seven communities in the Central and Western Provinces of Kenya who were interviewed by a cadre of trained University students on their school vacation. The moral judgment interview included four hypothetical moral dilemmas and a standard set of probing questions. Three of the dilemmas were standard …
Prevalence And Potential Vectors Of Haemoproteus In Nebraska Mourning Doves, Ellis C. Greiner
Prevalence And Potential Vectors Of Haemoproteus In Nebraska Mourning Doves, Ellis C. Greiner
Harold W. Manter Laboratory of Parasitology: Faculty Publications
Three hundred and nine mourning doves (Zenaida macroura) from Lancaster County, Nebraska, were examined for species of Haemoproteus. Older doves possessed higher Haemoproteus prevalences than younger doves. Mean total prevalence for each dove age group was as follows: adults, 61% H. sacharovi and 83% H. maccallumi; immatures, 35% H. sacharovi and 42% H. maccallumi; and nestlings, 31 % H. sachairovi and 16% H. maccallumi. Yearly prevalences were less variable in mature doves than in immature and nestling doves. No correlation between nestling and parent Haemoproteus infections were observed, but nestmates in 10 or 18 …

Digenetic Trematodes In Cephalopods, Robin M. Overstreet, F. G. Hochsberg
Harold W. Manter Laboratory of Parasitology: Faculty Publications
In addition to listing digenetic trematodes found in cephalopods, we provide descriptions of adults of Derogenes varicus and larvae of Lecithochirium microstomum, Lecithochirium sp., Elytrophallus sp., Monilicaecum sp., and Stephanochasmus sp. Only the first had been described previously from cephalopods, and the last represents the first record of a nonpiscine second intermediate host for a species of Stephanochasmus. We found 15 species infected, which brings to nearly 30 the total number of squids, octopods, and cuttlefish reported to be infected with Digenea. Many early records of trematodes in cephalopods are actually reports of Monogenea, Cestoda, or reproductive organs …

Tetrahymena corlissi, a free-living protozoan, apparently caused the death of large numbers of guppies (Poecilia reticulatus) and occasionally other fishes, in aquaria and hatcheries at several locations. Apparently the disease occurs when the fish and protozoan populations are both at a high level of density. The signs include white spots and epidermal damage. Histologically, T. corlissi could be seen in skin, muscle, and viscera; in some there was marked inflammation, in others there was little tissue reaction. A key is presented for the identification of invasive fish ciliates: Chilodonella, Hemiophrys, Ichthyophthirius, Ophryoglena, and Tetrahymena.

The Farm Corporation As An Estate Planning Device, Donald H. Kelley
The Farm Corporation As An Estate Planning Device, Donald H. Kelley
Nebraska Law Review
The farmer and rancher in the United States have departed from the era when the fruits of agricultural enterprise were primarily the product of one's hands, and have entered an era of declining labor input and continually expanding employment of capital. In the present economic and tax atmosphere, incorporation of the family agricultural unit is an increasingly popular method of accommodating both death taxes and family inheritance. The purpose of this article is limited to an examination of the ways in which incorporation may help achieve the basic objectives of the estate-planning process, which may be summarized as follows: (1.) …
