Contribution Among Negligent Tortfeasors: The New Rule And Beyond: Royal Indemnity Co. V. Aetna Casualty & Surety Co., 193 Neb. 752, 229 N.W.2d 183 (1975), Sam R. Brower

Nebraska Law Review

In Royal Indemnity Co. v. Aetna Casualty & Surety Co., the Nebraska Supreme Court was presented with an opportunity to determine whether there exists in Nebraska a right of equitable contribution between negligent judgment debtors after one such tortfeasor has discharged either the entire judgment or an amount exceeding his share of such liability. While Royal Indemnity represented only the third instance in the last half century in which this issue was addressed by the Nebraska Supreme Court, this modicum of Nebraska decisional law had, until this decision, been interpreted as prohibiting contribution among joint tortfeasors. Unlike a majority …

Propositional And Nonpropositional Perceiving, Dan D. Crawford Dec 1974

Propositional And Nonpropositional Perceiving, Dan D. Crawford

Department of Philosophy: Faculty Publications

The general theory of perception proposed by Roderick Chisholm in his book Perceiving: A Philosophical Study1 has gained considerable acceptance among contemporary philosophers of perception. In this paper, I will review and evaluate one part of this theory and show where I believe an important modification is necessary.

Chisholm distinguishes what he thinks are two importantly different senses of “perceive,” a propositional and a nonpropositional sense, and then proposes a definition of each. The propositional sense of “perceive” is expressed in contexts in which what is perceived is referred to by a propositional clause, as in

1. George perceives …

Structural And Operational Characteristics Of Nebraska And Kansas Feeder-Cattle Growing Operations, J. L. Jorgensen, J. G. Kendrick, A. C. Wellman, J. H. Mccoy, J. W. Koudele, Q. C. Smith Aug 1974

Structural And Operational Characteristics Of Nebraska And Kansas Feeder-Cattle Growing Operations, J. L. Jorgensen, J. G. Kendrick, A. C. Wellman, J. H. Mccoy, J. W. Koudele, Q. C. Smith

Nebraska Agricultural Experiment Station: Historical Research Bulletins

The beef cattle industry is experiencing a significant increase in demand for feeder cattle. Current difficulties in obtaining sufficient numbers of feeder cattle on a continuing basis have put pressures on the feeder cattle marketing system that did not exist in the past. Feedlot operators, growers (backgrounders), and cow-herd operators are looking for ways and means of improving the system. Innovations are being tested. Those circumstances prompted personnel of the Agricultural Experiment Stations of Kansas and Nebraska to undertake a joint study of cattle marketing under a Regional Research Project.

The Society For The Propagation Of The Gospel In Foreign Parts And The Assimilation Of Foreign Protestants In British North America, Anne Polk Diffendal Aug 1974

The Society For The Propagation Of The Gospel In Foreign Parts And The Assimilation Of Foreign Protestants In British North America, Anne Polk Diffendal

Department of History: Dissertations, Theses, and Student Research

The Society for the Propagation of the Gospel in Foreign Parts from its foundation in 1701 to the beginning of the American Revolution attempted to minister to non-English white settlers in the North American colonies. The Society sent clergymen to Dutch, to Germans, to Swedes, and to French Huguenots in various provinces, gave financial help to foreign ministers, and distributed books to foreign churches. Anglican religious services were open to foreigners living near the Society's missions. These activities have been chronicled in 1952 in a dissertation by William A. Bultmann, who published two articles from that paper. One is a …

Nuneaton Wreath-Laying, F.H.M. Fitzory Newdegate

The George Eliot Review Online, ISSN: 2831-5375

I am delighted to be here this afternoon to lay the annual wreath at this ceremony, which was for so long and so happily associated with my mother. As a child I was not over-encouraged to reason the works of George Eliot, but I did, so to speak, grow up with her as part of the story of Arbury and the surrounding countryside, which she loved so much and which so greatly influenced her earlier works. It is not always easy to see someone who is part of one’s own background as a world figure, a universal spirit whose works …

Review Of New World Bible Translation Committee's The Kingdom Interlinear Translation Of The Greek Scriptures, Thomas Nelson Winter Apr 1974

Review Of New World Bible Translation Committee's The Kingdom Interlinear Translation Of The Greek Scriptures, Thomas Nelson Winter

Department of Classics and Religious Studies: Faculty Publications

The Kingdom Interlinear Translation of the Greek Scriptures. Translated by the New World Bible Translation Committee. Brooklyn, N. Y.: Watchtower Bible and Tract Society (International Bible Students Assn.), 1969 Pp. 1, 165. $2.00.

An original Greek text for two dollars is something of a miracle, and it should not surprise us that it took a world-wide group of Bible students to pull it off. This is no ordinary interlinear: the integrity of the text is preserved, and the English which appears below it is simply the basic meaning of the Greek word. Thus the interlinear feature of this book …

Use Of Chlorophacinone In The Struggle Against The Common Vole (Microtus Arvalis Pallas) And Against The Muskrat Ondatra Zibethica L.), J. Giban

Vertebrate Pest Conference Proceedings: 6th (1974)

The use of the anticoagulant rodenticide, chlorophacinone, was largely developed in France during the last ten years. Its special properties, with respect to those of other anticoagulants currently known, have contributed largely to finding an effective and economically acceptable solution in the struggle against the two most damaging rodents in France: the common vole (Microtus arvalis P. ) and the muskrat (Ondatra zibethica L. ).

Recent Changes In Federal Bird Control, Gene H. Wilson Mar 1974

Recent Changes In Federal Bird Control, Gene H. Wilson

Vertebrate Pest Conference Proceedings: 6th (1974)

Probably the most significant changes in U. S. Fish and Wildlife Service legislation that might have an effect on those engaged in animal control work would have to do with the Migratory Bird Treaty Act, the Fish and Wildlife Act of 1956 recently amended, and one piece of proposed legislation which I'll mention at closing.

In March 1972, an amendment to our treaty with Mexico became effective. And more recent, the Fish and Wildlife Act of 1956 had a section added to it having to do with airborne hunting.

About two years ago, the amendment to the Mexican treaty added …

The Role Of F.A.O. In Vertebrate Pest Problems, H.R. Shuyler

Vertebrate Pest Conference Proceedings: 6th (1974)

Since 1947, when FAO began its involvement in vertebrate pest problems, its role has gradually expanded. Through short-term Consultants, Experts, Regional and Headquarters Officers, it advises Member Countries about vertebrate pest control needs and opportunities, fulfills requests for assistance suggesting needed modifications, and guides and reports on assistance rendered. Assistance may involve one or more international specialists for a few weeks up to national and regional projects of several years' duration. In cooperation with WHO it sponsors meetings of specialists, develops rodenticide specifications for international commerce, and has published rodent bibliographies covering 1950 to 1969.

Bonds Of Loyalty: German-Americans And World War I, Frederick Luebke Jan 1974

Bonds Of Loyalty: German-Americans And World War I, Frederick Luebke

Department of History: Faculty Publications

This book is an effort to explain why American society lashed out at its German element during World War I. Ever since colonial times, Americans had received German immigrants gladly and regarded them highly. Yet when the United States entered the war against Germany in 1917, people were swept into a strong wave of anti-German hysteria. Citizens of German origin were individually harassed and persecuted, German ethnic organizations were attacked, and serious efforts were made to eliminate German language and culture in the United States.

The crisis of war did not by itself create conflicts between the native-born and the …

Things Seen, Norman A. Geske Jan 1974

Things Seen, Norman A. Geske

Sheldon Museum of Art: Catalogs and Publications

The present exhibition has been organized to focus attention on one of the most flourishing aspects of contemporary American painting, the revival of representational art in the traditional formats of the landscape, the figure and the still life. For the past ten years it has become evident that more and more artists are having second thoughts about the abstract style which had come to dominate the artistic scene within the several previous decades. There are instances of renunciation, a sudden yet deliberate turning away from abstraction toward some form of traditional representation. There are also numerous instances of artists beginning …

Quilts From Nebraska Collections, Norman Geske Jan 1974

Quilts From Nebraska Collections, Norman Geske

Sheldon Museum of Art: Catalogs and Publications

PREFACE

In early America most quilts were made for utilitarian purposes. Later, when time and fabrics became more plentiful, quilt making developed into an art form which flourished during the 19th century and continues to do so today. Within the broad definition of "patchwork," three types are represented in this exhibition-pieced, applique and crazy.

Pieced quilts are made from materials cut in geometric shapes and put together in pattern blocks. These blocks are repeated to form the quilt top. The designs were often of political, historical or religious events, but many also were associated with abstract visual ideas and images. …

Graduate Education And New Jobs In Education, Paul A. Olson Jan 1974

Graduate Education And New Jobs In Education, Paul A. Olson

Department of English: Faculty Publications

Teacher education has too largely concerned itself with a study of schooling rather than a study of education. In the next generation, given the concerns that I’ve talked about, we’re going to have to look much more intensively, on the one hand, at how much human beings learn as biological creatures and, on the other hand, at all the cultural and legal constraints on learning that exist. We will look at education in industry, in the community, in community action programs, in the tribal council, education through ritual, and through play, as well as through public schooling. The job of …

Recollections, George W. Beadle Jan 1974

Recollections, George W. Beadle

Department of Biochemistry: Faculty Publications

In these exciting times when elementary and high schools teach modern biology, including many of the intricacies of biochemical genetics, the long slow process by which our present knowledge in this area was gained is not often fully appreciated. A third of a century elapsed before Mendel’s work was "rediscovered" and properly appreciated. Archibald E. Garrod’s (1) prophetic appreciation of the relation genetics and biochemistry, beginning soon after the so-called rediscovery of Mendel, lay fallow for more than forty years despite the fact that he published widely and relatively voluminously. As late as a quarter of a century after the …

Review Of Parasites Of Freshwater Fishes Jan 1974

Review Of Parasites Of Freshwater Fishes

United States Fish and Wildlife Service: Publications

This is a well organized, clearly written review of fish parasite control and treatment methods. The authors, who are renowned specialists in the field, have drawn together more than 390 up-to-date references and over 440 treatments. The treatments are discussed for each major parasite group in a handy chart form that greatly facilitates the book's usefulness. Interspersed between the charts are full-page or half-page color plates illustrating the parasites and the appearance of their infections in fish. There are 108 illustrations (all but 2 in color) on 57 pages, constituting more than 25% of the book's length and resulting in …

Review Of Fish Pathology: A Guide To The Recognition And Treatment Of Diseases And Injuries Of Fishes, With Emphasis On Environmental And Pollution Problems And Parasites Of Freshwater Fishes: A Review Of Their Control & Treatment, Ross F. Nigrelli

United States Fish and Wildlife Service: Publications

Fish Pathology states in its subtitle that it is "A guide to the recognition and treatment of diseases and injuries of fIshes with emphasis on environmental and pollution problems." These topics were included in the author's earlier volume "Krankheiten und Schadigungen der Fische" (Gustav Fischer Verlag, Stuttgart, 1966) and are only slightly revised in . this English translation by Christa Ahrens. Fish Pathology deals briefly but inadequately with semiology and histopathologY but it is a good introduction to information on infectious, parasitic, and nonparasitic diseases of fishes, and to such subjects as the harmful effects of pollutants and abnormal environmental …

Fitting Principles Within A Positivistic Model Of Law, Bruce Dennis Sales Jan 1974

Fitting Principles Within A Positivistic Model Of Law, Bruce Dennis Sales

Nebraska Law Review

Throughout this article, it is contended that a theory of law must include both principles and rules if the theory is to describe accurately the legal process in its day-to-day workings. This position is admittedly antithetical to most legal philosophers who see rules and principles as mutually exclusive and unincorporable. Violation of the usual position is necessitated since a model of law should transcend philosophy and become a useful tool for all lawyers, judges, and legislators in guiding their day-to-day legal decisions.

Crop Depredations By Waterfowl In Wisconsin, Richard A. Hunt, James G. Bell Oct 1973

Crop Depredations By Waterfowl In Wisconsin, Richard A. Hunt, James G. Bell

Bird Control Seminars Proceedings

On December 5, 1965 the Governor of Wisconsin signed into law a statute permitting claims against the State for damages to crops by wild geese and ducks. This law had been rushed through the legislature in the wake of a rash of crop depredation complaints caused by Canada Geese in their off-refuge feeding flights from the Horicon National Wildlife Refuge. This paper reviews our experiences with waterfowl depredations in the development of a cooperative program by State and Federal wildlife agencies that has held a potentially serious wildlife problem to a minimum of financial losses and public relations concern.
