Nebraska Law Review
Judicial creation of a private cause of action under rule l0b-5, which was promulgated pursuant to section 10(b)3 of the Securities Exchange Act of 1934, gave rise to a number of perplexing issues. One of the most formidable was whether proof of scienter was a necessary element for recovery. Lacking congressional direction, courts were free to fashion the state of mind standard flexibly, by pursuing what is recognized as the broad policy of section 10(b)—the prevention of fraud on the public by persons connected with the purchase or sale of securities. Predictably, the standards adopted within the United States courts …

Nebraska Well-Interference Problems—A Proposal, Paul D. Hietbrink
Nebraska Law Review
Use of Nebraska's ground water resources is multiplying at an ever-increasing pace. One of the most immediate results of the increase in the number of wells and the amount of withdrawals has been interference between the wells of adjoining users. This article delineates the scope of the problem, explains why current Nebraska law is ineffectual to resolve it, attempts to make some judgments as to whether and under what circumstances a remedy should be available, and proposes a method by which to implement whatever remedies are deemed advisable. No matter what the resolution is of broad-scale ground water management, a …

Bird Problems And Food Storage And Processing Facilities, Robert M. Russell, Robert Yeager, Fred Baur, James R. Dupre
Bird Control Seminars Proceedings
For the bird control problems in the food industry I think we have a good pair to work with us. We have Bob Yeager, a pest control authority. Fred Baur is from Procter and Gamble, a great company with a long record of association with the pest control industry. Third, we have with us Jim Dupre, whose experience is with the Food and Drug Administration. And with all the government controls we've learned to expect from the government in the last few years, I think it's good for us to know that we have had a long and good record …

Bird Control Seminars Proceedings
Some of the things that you must know in bird control are your state and local regulations. The state law may read that a license is required for bird control. A state law may read that the techniques and manners of your control must conform with their law. A state law may require registration of the poison you're going to use. State law may also prohibit placement of baits at a certain time during the day or year. And most important, a state law may prohibit control of specific types of birds. In Nebraska and most of the other states, …
Wetting As A Means Of Bird Control, Sheldon Lustick
Wetting As A Means Of Bird Control, Sheldon Lustick
Bird Control Seminars Proceedings
That birds are homeotherms is demonstrated by their ability to maintain a relatively constant body temperature over a wide range of ambient temperatures. An important com- ponent of this ability to maintain a constant body temperature in a cold environment is the feather layer. Birds have been shown to acclimate to cold by increasing their plum- age 20-30 percent and, hence, increasing their insulation (Kendeigh, 1934; Scholander, et al., 1950; West, 1962). Hutchinson (1954) states that oil secreted by uropygial (preen) glands maintains the ability of the feathers to shed water and, therefore, aids in maintaining the insulating layer. Since …

Laws, Rules, And Regulations Pertaining To Groundwater In Nebraska, Gerald R. Svoboda
Conservation and Survey Division: Faculty and Staff Publications
This publication contains (1) Nebraska laws pertaining to groundwater, and (2) the duties assigned to or the rules and regulations developed by various Nebraska agencies charged with the regulation of groundwater use. Following public hearings, rules and regulations can be changed at any time by state agencies. Each state agency with responsibility for groundwater regulation is able to supply, upon request, its rules and regulations pertaining to groundwater use. Water legislation varies from state to state because of differences in climate, availability and utilization of water, and fundamental legal concepts inherited at the time of statehood. Some states have laws …

Review Of The Immigrant Church: New Work's Irish And German Catholics, 1815-1865 By Jay P. Dolan., Frederick C. Luebke
Department of History: Faculty Publications
American church history, as practiced by its traditionalists, has recounted the intricacies of theological thought and debate, the mighty deeds of church fathers, and their positions on important social and political questions of the day. Despite the considerable influence of H. Richard Niebuhr's Social Sources of Denominationalism (1929), which illuminated the relationship between ethnicity and the growth of American churches, only rarely have professional historians focused their analytical skills on the foundational unit of American denominations, that is, the local congregation, parish, or synagogue. Similarly, immigration historians have described the contributions of this or that ethnic group to the composite …

The Bryas Palace Of Theophilus, Carol Bier
The Bryas Palace Of Theophilus, Carol Bier
Textile Research Works
According to the Continuation of the chronicles of Theophanes the Bryas palace of Theophilus (829-842) was built in imitation of an Arab palace. The present inquiry into its Islamic source offers a new interpretation of the Bryas palace within the context of Middle Byzantine secular architecture and the development of court ceremonial. ::?revious studies have concentrated upon locating Bryas in efforts to determine the extent of Islamic impact on the architecture of Byzantium. The most recent attempt, put forth by Dr. Semavi Eyice, tentatively links the unexcavated ruins at KUyUkyal!, a suburb of Istanbul, with the literary description of Bryas …

How Serious Are Teacher Educators About Career Education?, Allen G. Blezek
Department of Agricultural Leadership, Education, and Communication: Faculty Publications
A study recently completed at the University of Nebraska-Lincoln was designed to measure the extent to which selected teacher educators are incorporating procedures for planning and conducting career education programs into teacher education curriculums. The objectives discussed here are the determination of the extent to which teacher education staffs are incorporating career education concepts into the curricula of all of the colleges and universities collectively as well as specifically with respect to the subject matter area and/or specialty.
Ichthyology Of The Lakes Of Nicaragua: Historical Perspective, Jaime Villa
Ichthyology Of The Lakes Of Nicaragua: Historical Perspective, Jaime Villa
Investigations of the Ichthyofauna of Nicaraguan Lakes
Scientific study of Nicaraguan freshwater fishes did not begin until Gunther described the first species from Lake Nicaragua in 1864, but actual accounts of several interesting fishes were written as early as the sixteenth century by the first historians of the New World. These accounts ranged from hearsay to rather detailed (for their time) descriptions and first-hand observations on the form and life of some species. In some cases these observations or conclusions have been doubted for many decades but confirmed and elaborated in recent years. Therefore I believe it may be of interest to examine the early chronicles.
The Status Of The Freshwater Shark Of Lake Nicaragua, Thomas B. Thorson, Donald E. Watson, C. Michael Cowan
The Status Of The Freshwater Shark Of Lake Nicaragua, Thomas B. Thorson, Donald E. Watson, C. Michael Cowan
Investigations of the Ichthyofauna of Nicaraguan Lakes
Nineteen sharks collected from freshwater at several points on Lake Nicaragua and the Rio San Juan were all of the same species and indistinguishable from marine Carcharhinus leucas of the Atlantic. Minor differences previously thought to separate C. leucas from the lake shark proved to be invalid. Females had slightly longer gill slits, somewhat greater breadth of pelvic fin, and a longer abdominal region than males. Clasper length indicated that the onset of sexual maturity in males occurs when they are between 1,600 and 1,700 mm in total length.
The classical theory or origin of the sharks from Pacific ancestry …

Homosexuals And The Death Penalty In Colonial America, Louis Crompton
Homosexuals And The Death Penalty In Colonial America, Louis Crompton
Department of English: Faculty Publications
This article traces the legislative history of statutes prescribing the death penalty for sodomy in 17th-century New England and in the other American colonies. New England and some middle colonies broke with English legal tradition by adopting explicitly biblical language. After the Revolution, Pennsylvania took the lead, in 1786, in dropping the death penalty.
As the nation prepares to celebrate the bicentennial of the Declaration of Independence, the question of the status of the homosexual in pre-Revolutionary America comes to mind. The Body of Liberties approved by the Colony of Massachusetts Bay in 1641 welcomed refugees seeking to escape "the …

The Effects Of Boating Upon Lead Concentrations In Fish, David Oates
Nebraska Game and Parks Commission: Staff Research Publications
The concentration of lead in fish muscle tissue from lakes where boating is heavy and where it is prohibited was measured. The lead levels ranged from less than 0.05 to 1.35 ppm but did not differ significantly between those in the controlled and non-controlled boating lakes. Lead levels apparently pose no public health hazard.

University of Nebraska State Museum: Mammalogy Papers
Biologists have long been aware of close similarities between the mammalian faunas of northern Eurasia and northern North America (Flerov 1967; Rausch 1953, 1963; Sushkin 1925; Tugarinov 1934). This similarity is particularly strong between species of tundra and taiga ecosystems (Hoffmann and Taber 1967; Hoffmann 1974). Among the species having Holarctic distributions, the boreal red-backed vole, Clethrionomys rutilus (Pallas), and the tundra vole, Microtus oeconomus (Pallas) (Rausch, op. cit.), of the subfamily Arvicolinae (= Microtinae) (Kretzoi 1962; Repenning 1968), have wide distributions in Eurasia where they inhabit, but are not restricted to, tundra (Ognev 1950; Corbet 1966). East of the …
A Dinosaur Revival, Harvey L. Gunderson
A Dinosaur Revival, Harvey L. Gunderson
University of Nebraska State Museum: Programs Information
Just about everyone loves dinosaurs! Just ask any museum guard, 4th grader, or grandparent looking for souvenirs at a museum's gift shop. The only natural history exhibits that persistently challenge their popularity, in a child's mind, are the fabled mummies of ancient Egypt. Why does just the mention of the name "dinosaur" activate the imagination of most people? Naturally their size and dominating appearance are significant; however, we would hope people are also ---I intrigued by the very fact that these majestic beasts really existed at all, and for some ill-explained reason ----I seemed to disappear at the height of …
