One of the latest developments in products liability law is "public tort" litigation. Public tort or government-sponsored lawsuits are actions by federal, state, or local government entities to recover the cost of public services provided to persons who have been injured as the result of a defendant's alleged misconduct. The best known example is the tobacco litigation of the mid-1990s in which more than forty states brought suit against the leading tobacco companies to recoup the cost of providing health care services to indigent smokers. Isoxsuprine is used to treat navicular disease and other lower-limb problems in the horse. Isoxsuprine is regulated as a class 4 compound by the Association of Racing Commissioners, International (ARCI) and, thus, requires regulatory monitoring. A gas chromatography-mass spectrometry method utilizing electron impact ionization was developed and validated for the quantitation of isoxsuprine in equine plasma or equine urine. The method utilized robotic solid-phase extraction and tri-methyl silyl ether products of derivatization. Products were bis-trimethylsilyl (TMS) isoxsuprine and tris-TMS ritodrine, which released intense quantifier ions m/z 178 for isoxsuprine and m/z 236 for ritodrine that were products of C-C cleavage. …

The Mare Reproductive Loss Syndrome And The Eastern Tent Caterpillar Ii: A Toxicokinetic/Clinical Evaluation And A Proposed Pathogenesis: Septic Penetrating Setae, Thomas Tobin, J. Daniel Harkins, John Ford Roberts, Patricia W. Vanmeter, Tara A. Fuller

Reviewing the mare reproductive loss syndrome (MRLS), it is proposed that the fundamental mechanism of this syndrome, which includes early fetal loss, late fetal loss, uveitis, pericarditis, and encephalitis, is tissue penetration by septic barbed setal fragments (septic penetrating setae) from Eastern tent caterpillars (Malacosoma americanum). Once ingested, these barbed setal fragments migrate through moving tissues, followed by rapid hematogenous spread of bacteria, bacterial emboli, and/or septic fragments of setae (septic penetrating setal emboli), collectively referred to as septic materials. Pathogenic bacteria, therefore, enter the horse as hitchhikers on or in the caterpillar setal fragments, and MRLS is caused by …

Treatment of experimental animals with prototypical enzyme inducers represents a useful tool to characterize the role of different isozymes in drug metabolism and to improve our knowledge on factors regulating their synthesis at the transcriptional level. The effect of model enzyme inducers on phase II (conjugating) enzyme families, including UDP-glucuronosyltransferase’s and glutathione-S-transferase’s, has been well characterized in rodent liver. More recently, the effect of inducers on the expression of canalicular multidrug resistance-associated protein 2 (Mrp2) has been focused upon. Early Adolescent Through Young Adult Alcohol And Marijuana Use Trajectories: Early Predictors, Young Adult Outcomes, And Predictive Utility, Kate Flory, Donald Lynam, Richard Milich, Carl Leukefeld, Richard Clayton

The present study takes a developmental approach to subgrouping and examines the trajectories of substance use from early adolescence through young adulthood among a community sample of 481 individuals. The patterns of use were examined, subgroups were identified separately for men and women and for alcohol and marijuana, and psychosocial predictors and psychopathology outcomes that differentiated the groups were identified. The results revealed three substantially overlapping subgroups for both alcohol and marijuana: early onset, late onset, and nonuser. Although the general patterns of which dependent variables were related to group were similar for alcohol and marijuana, a closer examination revealed …

This article focuses on three key reasons that the corporate practice of medicine doctrine should be laid to rest. First, the motives for creating the corporate practice of medicine doctrine are long gone; it has been some time since physicians have been able to operate as a guild of autonomous providers of health care. The delivery and financing of health care places physicians in an integrated system that is only frustrated by the corporate practice of medicine doctrine. What is the relevance of race to tax law? The race issues are apparent when one studies a subject like constitutional law. The Constitution concerns itself explicitly with such matters as defining rights of citizenship, allocating powers of government, and determining rights with respect to property. Given the history of our country -- with slavery followed by periods of de jure and de facto racial discrimination -- these constitutional law matters obviously must have racial dimensions.

Tax law, however, does not generally concern itself explicitly with matters of race. Tax law is often thought of as completely race neutral in …

Conflicts scholars and jurists for centuries have sought an answer to the question of "what law controls?" by balancing a number of considerations. Chief among those considerations are the legitimate political and policy concerns of conflicting sovereigns. This article analyzes the Supreme Court's recent preemption decisions with an understanding of these theories and their underlying considerations. That analysis reveals that the Court's recent preemption decisions incorporate two modem conflict of laws theories: Governmental Interest Analysis and its corollary, Comparative Impairment. Part I provides a brief overview of federal preemption law, considering the constitutional sources of preemption and the traditional preemption categories. Part II analyzes Cipollone v. The concept of economic development has broadened to include environmental quality and population health. Interactions between income and pollution, income and health, and pollution and health have been studied separately by researchers from various disciplines. This study attempts to unify several different research strands and analyze simultaneous interactions between population health, measured by the infant mortality rate, pollution, and income in one endogenous system. Socioeconomic, racial, and rural urban disparities in infant mortality, pollution, and income are analyzed. Detection and inspection of metal surface corrosion in the ballast tanks of U.S. Navy ships has been a long time problem. The adverse climatic conditions to which the ballast tanks are exposed and the uneven geometry of ballast tanks makes the visual inspection process of surface coatings a difficult job. Thousands of tanks are inspected yearly, with the average cost of an individual tank inspection at approximately $8-15 thousand/each. The Problem

In early 2003, the Kentucky Cabinet for Health Services, faced with a $450 million Medicaid shortfall, implemented several cost-cutting measures to the Medicaid program. The most visible measure included new stricter medical eligibility requirements for long-term care programs. As a result of these new requirements, approximately 2,813 elderly and disabled Kentuckians were denied services in Kentucky’s Aged/Disabled Home and Community-Based Waiver Program, a Medicaid program that provides long-term care services in people’s homes and in community-settings. The Cabinet for Health Services claimed that those who lost home and community-based Medicaid services could receive care through alternative state programs. …

The food processing industry is dominated by large corporations. These firms play a critical role in forming the derived demand faced by agricultural producers, but little is understood about how these companies make strategic choices. Organizational economics provides a framework for exploring the firm's decision process. However, several theories exist in this discipline, operating in fundamentally different ways. Local twitch responses (LTRs) can be elicited by snapping palpation of myofascial trigger points (TrP) or TrP injections. Objective: To characterize the LTR elicited by TrP injection and snapping palpation on surface electromyography (sEMG) in subjects with myofascial pain in 14 female subjects. Methods: Surface EMG electrodes were placed around the TrP and a control site on the trapezius muscle. Then the following protocol was carried out: tension and contraction of the ipsilateral trapezius muscle, baseline resting activity (five minutes), snapping palpation of the TrP and the control sites, TrP injection, and final resting activity (five minutes). Atherosclerosis is thought to be initiated by endothelial cell dysfunction. Research described in this dissertation is focused on interactions of nutrients, cytokines and pharmaceutical compounds in the intracellular signaling pathways leading to endothelial cell activation. The flavonoid quercetin could significantly downregulate the inflammatory pathways induced by linoleic acid as determined by DNA binding assays of the proinflammatory transcription factors nuclear factor-kappaB and activator protein-1 as well as by gene expression studies of interleukin-6 and vascular adhesion molecule-1. Interestingly, quercetin and vitamin E also prevented the linoleic acid-induced activation of PPAR DNA binding - suggesting a role of oxidation in the …

The present study has tested the hypothesis that leptin receptors are localized in caveolae and that caveolae are involved in the leptin-induced stimulation of lipolysis in 3T3-L1 adipocytes. Leptin, a peptide hormone, is secreted primarily by adipocytes and has been postulated to regulate food intake and energy expenditure via hypothalamic-mediated effects. Exposure to leptin increases the lipolytic activity in 3T3-L1 adipocytes. We isolated caveolae from 3T3-L1 adipocytes using a detergent free sucrose gradient centrifugation method. Leptin receptors were localized in the same gradient fraction as caveolin-1. Confocal microscopic studies demonstrated the colocalization of leptin receptors with caveolin-1 in the plasma …

To identify the signaling mechanisms and components that are involved in regulation of a promoter for a gene involved in a secondary pathway I studied the nicotinic alkaloid biosynthetic pathway using various N. tabacum tissues. Nicotine and tropane alkaloids are widely known to be synthesized predominantly in the roots of species that produce pyrrolinium ring containing alkaloids. Putrescine Nmethyltransferase (PMT) catalyzes the first committed step in the biosynthesis of these alkaloid secondary products and earlier studies have indicated that PMT gene expression is restricted to root tissue in Solanaceae plants. Cancer is a group of diseases that are the second leading cause of human mortality in the United States. Discovering new therapies is vital to conquer cancer. Thymoquinone (TQ) is found in the plant Nigella sativa. TQ was found to be cytotoxic to the human ovarian cancer cell lines PA-1, CAOV-3 and SKOV-3, which have varying p53 status. PA-1 cells were the most sensitive, indicating that TQ was effective against cells having wild-type (WT) p53. Western blots indicated an increase in p53 in cell lines having WT p53. TQ when given concurrently with cisplatin resulted in antagonism for PA-1, A172 …
