Income Tax Aspects Of The Vow Of Poverty, Nancy H. Wilberding May 1979

Income Tax Aspects Of The Vow Of Poverty, Nancy H. Wilberding

University of Dayton Law Review

Religious orders, which by their nature are typically under the jurisdiction and control of a church, were present in the United States long before the enactment of the sixteenth amendment which authorized the present federal income tax. The Internal Revenue Code generally defines gross income for individuals and organizations alike as income from whatever source derived. Nevertheless, certain organizations which are tax-exempt are not required to pay tax on their income, unless the income is from a business unrelated to the exempt purposes of that organization. It is typical for many religious orders to require a member to take a …

Beyond Bakke—The Use Of Noncognitive Factors In Professional School Admissions Decisionmaking, Catherine Wright Smith Mar 1979

Beyond Bakke—The Use Of Noncognitive Factors In Professional School Admissions Decisionmaking, Catherine Wright Smith

Washington Law Review

This comment suggests that professional schools constitutionally need not and, as a matter of policy, should not be deterred from considering at least some noncognitive criteria in admissions decisions. An exhaustive constitutional analysis of the standard of inquiry appropriate for each noncognitive criterion is not attempted. Instead, the comment shows in Part I that, regardless of the standard of scrutiny applied, any constitutional adjudication will involve some inquiry into the relationship between the school's articulated admissions goals and the admissions criteria used to implement them. The focus of the comment, then, is to analyze those goals that are typically advanced …

University Of Richmond Bulletin: Catalog Of The T.C. Williams School Of Law For 1979-1980, University Of Richmond

Law School Catalogues

History:

The Law School was established as a department of Richmond College in 1870. In 1890 the family of the late T. C . Williams, who had been a devoted and valued Trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to The T. C . Williams School of Law. At various times the School has received further generous gifts from members of the family of Mr. Williams. A substantial gift came through a bequest from Mr. T. C. Williams, Jr. who, like his …

Joint Custody, Carolyn S. Bratt Jan 1979

Joint Custody, Carolyn S. Bratt

Law Faculty Scholarly Articles

Shared custody has traditionally been looked upon with disfavor by the courts. Similarly, some professionals in the field of child development oppose the concept of shared custody. There are, however, several advantages to shared custody. The legal system benefits, as judges escape the unenviable task of playing Solomon. The child benefits because both parents continue to have a voice in the child’s upbringing, and the child continues to enjoy the love, advice, and companionship of both parents. In addition, because both parents share the responsibility of child raising, neither is faced with the loss of self-esteem which results from being …

The Adoption Trilemma: The Adult Adoptee's Emerging Search For His Ancestral Identity, Marshall A. Levin Jan 1979

The Adoption Trilemma: The Adult Adoptee's Emerging Search For His Ancestral Identity, Marshall A. Levin

University of Baltimore Law Review

In 1974, while presiding over Circuit Court Number 2 of Baltimore City, a court having jurisdiction over domestic relations cases, the author was struck by the searing emotionalism often arising when adoptees' quests to learn about their genealogical heritage were frustrated by Maryland's "sealed record" rule, which denies adoptees access to the records of their adoption proceedings except upon an order of court (which, in effect, means a showing of "good cause"). In this Article, the author critically examines such rules (and similar statutes) in light of the interests of the parties to the adoption process. He recommends that these …

Affirmative Action Programs In Social Service Agencies: Status Of The Female M.S.W., Geraldine Ann Berg

Dissertations and Theses

Job status and salary inequities between men and women have only recently been documented. The federal government, over the past few decades, through various acts and executive orders, has created legislation to prohibit discrimination based on race, sex, color, religion or national origin in all employment practices. The question is to what extent this legislation has permeated social service agencies and affected their employment patterns, particularly with respect to administrative positions.

In 1976, the Women's Issues Committee of the Oregon Chapter of the National Association of Social Workers (NASW), addressed this question by initiating a study of social work employment …
