Marine Cargo Claims, Alastair Bissett-Johnson
Marine Cargo Claims, Alastair Bissett-Johnson
Dalhousie Law Journal
In marine matters, Canada is not a maritime but a coastal power. She is also a nation dependent for a livelihood on foreign trade. Translated into terms of admiralty law, Canada's principal interests in ships is not in their ownership but in the cargoes they carry. Accordingly Marine Cargo Claims is a particularly apt title under which Professor Tetley has written a unique Canadian text. His work is also unusual in several useful ways. First, in being directed to the general practitioner, accustomed or not to admiralty affairs but always short of time, it is deliberately organised to facilitate the …

H.B. 835: Ohio's Response To The Domestic Violence Dilemma, Mark R. Chilson
H.B. 835: Ohio's Response To The Domestic Violence Dilemma, Mark R. Chilson
University of Dayton Law Review
Domestic violence is most often manifested by repeated, deliberate and severe beatings of family or household members. Victims frequently suffer broken bones, concussions, miscarriages or other physical injuries. The abused family or household members are also subjected to serious psychological and emotional injuries. Even though domestic violence impacts most clearly upon the victims, the assailants, too, are not without injury, often suffering from some type of mental illness, alcohol or drug abuse problem. The traditional view is that domestic violence does not exist, or if it exists, it must be dealt with privately. Today this view inappropriately deals with the …

Purpose and Instruction:
The educational program of the law school is designed to equip its graduates with legally trained minds, while instilling a sense of professional responsibility. The case method of instruction is used in many courses. The beginning student is trained in the analysis and solution of legal problems by the application of logical reasoning. Attention is given to the principles of the early common law, state and federal decisions and statutes, and to such rules of law as are peculiar to Virginia. Substantive courses, dealing with the content of the law, are generally taught by full-time professors. Many …

Liberty And Lawyers In Child Protection, Donald N. Duquette
Liberty And Lawyers In Child Protection, Donald N. Duquette
Book Chapters
The distinguishing feature of the juvenile or family court which sets it apart from, all other elements of the child protection system is that the court acts as arbiter of personal liberty. When society at large, through child protective services, attempts to intervene in the private life of a family on behalf of a child, the court must assure that the rights of the parents, the rights of the child, and the rights of. the society are protected and are abridged only after full and fair and objective court process. Only the court can abridge these personal rights in other …

International Year Of Disabled Persons: The Institution In England And Wales, Lawrence O. Gostin
Georgetown Law Faculty Publications and Other Works
A notable characteristic of American federalism is that domestic policy has been substantially determined by the courts. The judiciary has introduced its own social morality to ensure reasonable access to services for minority groups.
The concept of judicial policy making has found no greater expression than in the field of mental retardation where the service provided has been largely mandated by judges.
The Indian Child Welfare Act Of 1978: A Critical Analysis, Russel Lawrence Barsh
The Indian Child Welfare Act Of 1978: A Critical Analysis, Russel Lawrence Barsh
UC Law Journal
In response to an increasing frequency of often unwarranted removals of Indian children from their homes, resulting in a continuing breakup of Indian families, Congress enacted the Indian Child Welfare Act of 1978. The Act was intended to diminish the problem by, among other things, modifying child removal procedures and by providing for greater tribal involvement m the proceedings and placements. This Article analyzes the effectiveness of the Act in achieving the intended goals. After summarizing the significant provisions, the author concludes that because of ambiguous language and confusing provisions, the Act creates more problems than it solves, with the …

Impact Of A Youth Service Center, Deborah W. Denno
Faculty Scholarship
This study evaluates the impact of a Youth Service Center (YSC) in South Philadelphia, using methods which consider both the Center's goals and relevant developments within its target area. The YSC is a delinquency-prevention program housed in the South Philadelphia Community Center (SPCC), a general recreation facility which evolved from the Philadelphia Boys' Club in 1974. The YSC program was added in June 1975 to "prevent and limit youth from becoming involved in the Juvenile Justice System, police courts, and institutions". Program referrals comprise area youths between the ages of 10 and 18 who have been arrested and are in …

The Oral Component Of Appellate Work, T. W. Wakeling
The Oral Component Of Appellate Work, T. W. Wakeling
Dalhousie Law Journal
Anyone who haunts the courtrooms of North America will find advocates of uneven quality. 1 There are master craftsmen but alongside them labour colleagues blessed with skills which escape the observer's scrutiny. Unfortunately, the latter category has been the subject of considerable attention lately with the result there is the impression about that poor advocates have cornered a disproportionate share of the market. Even Canadian and American judges have felt it necessary to question the competence of some practioners. Chief Justice Burger directed his serious charges at the trial lawyers but the appellate bar, the subject of this study, has …
