Confidential Communications In The Correctional Halfway House Setting, Richard Kenney Jan 1978

Confidential Communications In The Correctional Halfway House Setting, Richard Kenney

Cleveland State Law Review

The author proposes that a legal testimonial privilege regarding confidential communications between the staff and residents of community-based correctional programs is necessary to insure the integrity of the therapeutic process and, ultimately, the success of the program itself. This note will examine the role of community-based correctional programs and the law in regard to testimonial privileges and will demonstrate that the extension of the privilege in this setting is legally appropriate.

Criminal Law: A Reappraisal Of Treating The Criminal Offender, Alexander B. Smith, Louis Berlin Jan 1978

Criminal Law: A Reappraisal Of Treating The Criminal Offender, Alexander B. Smith, Louis Berlin

University of Dayton Law Review

A short time ago the newspapers carried an item accompanied by lurid photographs of how a newly established third world power dealt with its criminals. The technique used guaranteed the offenders would not recidivate. They were hanged, thereby saving the state the expense of maintaining them while incarcerated. In our humane and democratic society such a brutal, final solution to the problem would never be acceptable. We are concerned with treatment. By treatment we do not imply that all criminals are ill and therefore in need of medical attention. Conceding that some offenders are mentally, emotionally and physically ill and …

The Right To Treatment, Adrienne E. Volenik

This article seeks to. trace the development of the right to treatment in the juvenile justice system from its origins to the present. Luther And The Law, Karl H. Hertz Jan 1978

Luther And The Law, Karl H. Hertz

UC Law Journal

In this Article, the author considers the characteristics of feudal Germany during the period of Luther's lifetime and, drawing on these observations, discusses Luther's philosophy regarding law and legal institutions. The author details three basic themes that underlie this element of Luther's thought: first, Luther's rejection of the right of retaliation in favor of objective judicial processes; second, Luther's assertion of the institutional independence of secular government from religious oversight and control but not from religious criticism; and finally, Luther's vision of a natural law that focused primarily upon the mutual interdependence of all humans.

In conclusion, the author notes …

Altruism And Professionalism: Boston And The Rise Of Organized Legal Aid, 1900-1925, Part Ii, Michael Grossberg

Articles by Maurer Faculty

The Boston Legal Aid Society was founded in 1900. In the years after 1910, led by General Counsel Reginald Heber Smith, the Society assumed leadership of the fledgling movement to offer legal services to the urban poor. Under its influence the first organized attack on the legal problems of the impoverished was launched. The effort had its origins in the social and professional crises that beset turn of the century American cities and lawyers. As described in the first installment of this article, the major difficulty facing the movement during this generative era was how to balance the conflicting demands …

Distributive And Retributive Justice In Canada, Patrick Kerans Oct 1977

Distributive And Retributive Justice In Canada, Patrick Kerans

Dalhousie Law Journal

The publications of the Law Reform Commission raise many ethical issues. One question - how distributive justice affects the working of retributive justice - is raised in several of their studies but not yet explicitly faced. This paper' approaches the question by way of a reflection on Paul Weiler's lucid and balanced argument, presented in "The Reform of Punishment". 2 1 fully agree with the polemic thrust of Weiler's essay, namely, that the rehabilitative model of corrections, which views crime as a disease, is inadequate and leads to injustice. What I aim to do here is to analyse and subject …
