Justification For Residual Criminal Stigmatization: A Contribution To The Modern Philosophy Of Punishment, R. Paul Nadin-Davis May 1981

Justification For Residual Criminal Stigmatization: A Contribution To The Modern Philosophy Of Punishment, R. Paul Nadin-Davis

Dalhousie Law Journal

In the past twenty-five years advances in research have increased awareness of the deleterious effects of criminal sanction to an extent that they are now undeniable from any political or academic viewpoint. The most obvious and immediate unofficial sanction accompanying conviction in a criminal court, social and familial ostracism, has been relegated to the background by application of subcultural theory' and empirical demonstration that a single conviction rarely causes severe and lasting effects on family ties. 2 Meanwhile discrimination against ex-offenders in employment markets, both private3 and public, 4 has been clearly demonstrated in many countries. American writers have documented …

Health Care, Markets, And Democratic Values, Rand E. Rosenblatt May 1981

Health Care, Markets, And Democratic Values, Rand E. Rosenblatt

Vanderbilt Law Review

Proposals to restructure the health care industry by increasing market competition currently have much political and academic momentum. Whether such proposals will work necessarily depends in part upon the criteria for success that are applied. Viewed from the market perspective, the question is whether procompetitive reforms will achieve their stated goals of containing costs, increasing efficiency, and enhancing consumer sovereignty over health care decisions. From a broader perspective, other questions are also of concern: whether increased competition in health care will actually improve people's health, and whether the operations and effects of health care competition are consistent with important values …

The Right To Treatment For Juveniles In Texas: A Legislative Proposal., Mark H. Marshall Mar 1981

The Right To Treatment For Juveniles In Texas: A Legislative Proposal., Mark H. Marshall

St. Mary's Law Journal

Studies of adult prison populations show large percentages of such populations are juvenile offenders. The right to treatment concept emerged as a solution to this perplexing problem. The right to treatment guarantees juveniles post-adjudicative care and treatment aimed at rehabilitation. Courts have indicated a willingness to support the right to treatment concept. However, legislatures limit courts power to affect change. To fully implement the right to treatment, legislatures must establish an express right to treatment for institutionalized juveniles and set standards to ensure this right. The Texas Legislature has an excellent start toward this goal, but it should not be …

School of Social Work Faculty Publications and Presentations

In lieu of an abstract, here is a brief excerpt:
My name is Norman Wyers. I am an Associate Professor, with a specialty in income maintenance from Columbia University, at the School of Social Work, Portland State University. I would like to talk with you today about the formulation of well-articulated welfare policy, in this case policy which would more effectively link social services with income maintenance. I am using this particular piece of welfare policy for illustrative reasons but also because it is badly needed.

The Legal Aspects Of Child Abuse And Neglect, Donald N. Duquette Jan 1981

The Legal Aspects Of Child Abuse And Neglect, Donald N. Duquette

Book Chapters

The law is an essential partner with the medical, social work, and mental health professions in identifying and responding to children who may be abused and neglected and their families. The law governs reporting of suspected child abuse and neglect and outlines the duties of the child protection agency in responding to those reports. Statutes and court rules determine the circumstances under which a child suspected of being abused or neglected may be detained in a hospital or removed from his home on an emergency basis. Child abuse and neglect laws in all states aim to facilitate the benevolent intervention …

Legal Roles, Donald N. Duquette Jan 1981

Legal Roles, Donald N. Duquette

Book Chapters

Attorneys may be involved at various stages in the management of cases of child abuse and neglect. However, typically they become important only on those cases which go to court. There are in fact three separate attorney roles, with requirements which vary according to whom the attorney represents. These roles are the child's attorney, the agency attorney, and the parents' attorney.

The Taxation Of Family Religious Orders, Albert Feuer Jan 1981

The Taxation Of Family Religious Orders, Albert Feuer

University of Dayton Law Review

Some promoters have reportedly claimed that individuals may avoid income taxes without changing their life styles in any manner by using a kit available at a substantial price to form and utilize a “family religious order,” i.e., a religious order consisting of an individual and his immediate family; the individual directs the order as its minister. In accord with a “vow of poverty” the family members assign all their assets, income, and the use of their personal services to the family religious order. In return, the family religious order provides the family members with all their former living expenses, including …

The Juvenile Offender Act: Effectiveness And Impact On The New York Juvenile Justice System, Merril Sobie Jan 1981

The Juvenile Offender Act: Effectiveness And Impact On The New York Juvenile Justice System, Merril Sobie

Elisabeth Haub School of Law Faculty Publications

The Juvenile Offender Act of 1978 incorporates the most radical and perhaps the most controversial amendments to New York's juvenile delinquency statutes in several decades. For the first time since 1909, children accused of committing serious offenses are subject to prosecution in the criminal courts. The gradual decriminalization of delinquency, which began a century and a half ago, has been reversed. This report analyzes and evaluates the Act and its implementation. The first two sections summarize the historical development of juvenile delinquency legislation and compare present New York provisions to those in other states. Sections III and IV will evaluate …

The Right To Privacy In Nineteenth Century America, David J. Seipp Jan 1981

The Right To Privacy In Nineteenth Century America, David J. Seipp

Faculty Scholarship

On December 15, 189o, Samuel D. Warren and Louis D. Brandeis, two young Boston law partners, published an article in the Harvard Law Review entitled The Right to Privacy. In that article, they proposed a remedy for invasions of personal privacy by the press. More than ninety years later, protection of privacy has become a major concern of the law. Legal scholars have organized the extensive body of case law into a coherent common law of privacy; the Supreme Court has enshrined the right to privacy in the "penumbra" of the Bill of Rights; and Congress has enacted additional safeguards.
