Ave Defamation, Atque Vale Libel And Slander, Francis D. Murnaghan Jr Jan 1976

Ave Defamation, Atque Vale Libel And Slander, Francis D. Murnaghan Jr

University of Baltimore Law Review

Two recent decisions by the Maryland Court of Appeals have brought about substantial changes in the law of libel and slander. The author considers the consequences of these decisions, welcoming the abolition of certain distinctions between written and spoken defamation as well as the adoption of new rules pertaining to recoverable damages. The author, however, expresses reservations as to pronouncements in the decisions that purport to impose new burdens on the plaintiff to establish liability.

Notes And Comments: Fcc Implementation Of The Section 315(A) Exemptions: The Disappearance Of The Equal Time Doctrine, Gary R. Greenblatt

University of Baltimore Law Review

As required by the equal time doctrine, broadcast licensees that permit their facilities to be used by legally qualified candidates for public office must provide all other legally qualified candidates for that office equivalent broadcast time. In 1959, Congress amended Section 315(a) of the Communications Act of 1931,. and created four statutory exemptions to the doctrine. The author analyzes the FCC implementation of these exemptions to determine the parameters and application of each to specific circumstances.

The Commodity Futures Trading Commission Act: Preemption As Public Policy, Philip F. Johnson Jan 1976

The Commodity Futures Trading Commission Act: Preemption As Public Policy, Philip F. Johnson

Vanderbilt Law Review

On October 23, 1974, President Ford signed into law P.L. 93-463, bearing the breathless title "Commodity Futures Trading Com-mission Act of 1974"' [hereinafter the CFTC Act]. The CFTC Act followed a series of hearings, beginning in the summer of 1973, held first by a subcommittee of the House Committee on Small Business and followed rapidly by the more traditional oversight committees of the Congress-the House Agriculture Committee and the Senate Agriculture and Forestry Committee.' The result was a major over-haul of the Commodity Exchange Act, which had governed the commodity futures markets since 1922. More significantly, however, the Act has become …

Judicial Policy-Making And Information Flow To The Supreme Court, Charles M. Lamb Jan 1976

Judicial Policy-Making And Information Flow To The Supreme Court, Charles M. Lamb

Vanderbilt Law Review

This article is intended as an exploratory step toward filling the gap in the literature by synthesizing the fragmentary knowledge relating to judicial information flow. It attempts to advance the dialogue initiated by Professors Miller and Barron by providing a number of components necessary for an adequate model; it seeks also to suggest additional considerations necessary for a more useful model and thus for a continuing systematic inquiry into the information flow process. Results of the Miller-Barron article supply the background for the work reported here. Times, Roe, and Doe and the Miller-Barron findings are considered in the first two …

Freedom Of The Press And Public Access: Toward A Theory Of Partial Regulation Of The Mass Media, Lee C. Bollinger Jr. Jan 1976

Freedom Of The Press And Public Access: Toward A Theory Of Partial Regulation Of The Mass Media, Lee C. Bollinger Jr.

Michigan Law Review

The purpose of this article is to examine critically these decisions and to explore whether there is any rational basis for limiting to one sector of the media the legislature's power to impose access regulation. The article takes the position that the Court has pursued the right path for the wrong reasons. There is a powerful rationality underlying the current decision to restrict regulatory authority to broadcasting, but it is not, as is commonly supposed, that broadcasting is somehow different in principle from the print media and that it therefore is not deserving of equivalent first amendment treatment. As will …

The Family Educational Rights And Privacy Act Two Years Later, Katherine Cudlipp Jan 1976

The Family Educational Rights And Privacy Act Two Years Later, Katherine Cudlipp

University of Richmond Law Review

The Family Educational Rights and Privacy Act of 1974, the so called Buckley Amendment, grants parents the right to inspect all records that schools maintain on their children and to challenge any contents they believe are inaccurate or misleading. The Act also requires that parents consent before information from school records is released to those outside specified educational categories. Once a student reaches eighteen years of age or enters a postsecondary educational institution, he assumes these rights in his parents' stead. The penalty for failure of an educational system or institution to comply with the law is loss of all …

Constitutional Law- Civil Rights- Private Schools Prohibited From Excluding Qualified Children Solely Because They Are Black, Craig S. Cooley Jan 1976

Constitutional Law- Civil Rights- Private Schools Prohibited From Excluding Qualified Children Solely Because They Are Black, Craig S. Cooley

University of Richmond Law Review

All major school desegregation decisions through 1975 involved "public" schools, and were based on provisions of the fourteenth amendment. This constitutional remedy, however, requires the presence of "state action" before being triggered. Commencing with the Supreme Court's earliest public school desegregation decisions, and accelerating with the finding of affirmative duties of southern school districts to desegregate, private educational institutions following racially exclusionary admittance policies were founded. Such private discrimination generally has been considered to be beyond the scope of the fourteenth amendment. Moreover, parents that patronize such institutions have sought support in Supreme Court cases which confer constitutional protection upon …

Problems In Defining The Institutional Status Of The Press, Andrew A. Jaxa-Debicki Jan 1976

Problems In Defining The Institutional Status Of The Press, Andrew A. Jaxa-Debicki

University of Richmond Law Review

This comment will deal with the concept of freedom of the press within the context of recent Supreme Court rulings which have directly or indirectly involved definitions of the role of the organized press in the governmental framework established by the Constitution. Specifically, the focus will be in the areas of the law dealing with defamation, testimonial privilege and the fair trial-free press controversy. The purpose will be to discern whether the Supreme Court is developing a concept of freedom of the press which is distinguishable from the general guarantee of freedom of speech and which derives its rationale from …
