Search And Seizure Of The Media: A Statutory, Fourth Amendment And First Amendment Analysis, James S. Liebman Jan 1976

Search And Seizure Of The Media: A Statutory, Fourth Amendment And First Amendment Analysis, James S. Liebman

Faculty Scholarship

On the evening of October 10, 1974, police appeared at radio station KPFK-FM in Los Angeles with a warrant authorizing them to search the premises for a New World Liberation Front (NWLF) "communique" that took credit for a recent bombing. The officers conducted an intensive 8-hour search-combing files, listening to tapes, and looking through reporters' notes – finally concluding that the NWLF letter was not at the station. The KPFK search warrant was one of six that California law enforcement officials have executed at press offices since 1972. The circumstances surrounding the incident illustrate the rationale behind the recent development …

Freedom Of The Press And Public Access: Toward A Theory Of Partial Regulation Of The Mass Media, Lee C. Bollinger Jan 1976

Freedom Of The Press And Public Access: Toward A Theory Of Partial Regulation Of The Mass Media, Lee C. Bollinger

Faculty Scholarship

During the past half century there have existed in this country two opposing constitutional traditions regarding the press. On the one hand, the Supreme Court has accorded the print media virtually complete constitutional protection from attempts by government to impose affirmative controls such as access regulation. On the other hand, the Court has held affirmative regulation of the broadcast media to be constitutionally permissible, and has even suggested that it may be constitutionally compelled. In interpreting the first amendment, the Court in one context has insisted on the historical right of the editor to be free from government scrutiny, but …

The Unpopularity Of Lawyers In America, Jon R. Waltz Jan 1976

The Unpopularity Of Lawyers In America, Jon R. Waltz

Cleveland State Law Review

What's wrong with us lawyers? Mainly, it is that the worst among us pose for our portrait, so that we are viewed as avaricious and egomaniacal, all flair and no substance, seeking and wielding power without having the strength of character to wield it well. Lost to the public is the portrait of most lawyers, the sorts of lawyers that I hope this University produces. They are quiet people who come to the law, and stay with it, because they know that the law's power lets them help people make the best of a trying world.

Fcc Broadcast Standards For Ascertaining Community Needs, Arthur P. Deluca Jan 1976

Fcc Broadcast Standards For Ascertaining Community Needs, Arthur P. Deluca

Fordham Urban Law Journal

This comment examines: (1) the history of the ascertainment procedures, including the function of the original Primer; (2) the effect of the Renewal Primer amendments on the ascertainment procedures; and (3) the significance of the Bamford cases in light of the treatment of badly-organized groups under prior ascertainment procedures, and in light of the issuance of the Renewal Primer. The comment argues that the Primer's purpose of increasing the responsiveness of a broadcast applicant to the needs of its proposed service area has improved the situation for the more organized significant groups, such as minority groups, but its effectiveness as …

On Understanding Chinese Law And Legal Institutions, Stanley B. Lubman Jan 1976

On Understanding Chinese Law And Legal Institutions, Stanley B. Lubman

Hong Yen Chang Center for Chinese Legal Studies

Our unfamiliarity with Chinese legal institutions and policies toward law causes misunderstanding of the role of law in the People's Republic of China. The present unimportance of the formal legal system has deep historical reasons. As China's economy becomes more complex, regularity should increase, although it will remain controversial. In commercial contracts with the West, custom performs the role of law.

Advertising And Solicitation By Lawyers: A Proposed Redraft Of Canon 2 Of The Code Of Professional Responsibility, Monroe H. Freedman Jan 1976

Advertising And Solicitation By Lawyers: A Proposed Redraft Of Canon 2 Of The Code Of Professional Responsibility, Monroe H. Freedman

Hofstra Law Review

Rules of legal ethics are, broadly speaking, of two kinds. Rules of the first kind relate to the integrity of the system of administering justice and are designed to insure that the system will function effectively and fairly. Those rules include such matters as full access to the legal system, the competence and independence of counsel, preservation of clients' confidences, and zealous representation within the bounds of the law. Rules of the second kind are those that are concerned less with the integrity of the system and more with the conduct of lawyers as members of a guild or trade …
