Computerized Criminal Records: The Duty Of The Fbi To Maintain And Disseminate Accurate Files, Barbara Pugliese Gorman Jan 1976

Computerized Criminal Records: The Duty Of The Fbi To Maintain And Disseminate Accurate Files, Barbara Pugliese Gorman

University of Dayton Law Review

Tarlton v. Saxbe, 507 F.2d 1116 (D.C. Cir. 1974).

The use and dissemination of criminal records for routine suspect checks, sentencing and parole hearing has been the subject of much recent discussion. Much of the controversy revolves around the increased access to criminal history files through the FBI's National Crime Information Center (NCIC) which serves as a clearing house for law enforcement agencies throughout the nation. Due to conflicting court decisions and varying state statutes, the rights, requirements and limitations for expunging these records are presently in a state of confusion.

Oil Operations In Latin America: The Future Of Private Enterprise, Ewell E. Murphy, Jr. Jan 1976

Oil Operations In Latin America: The Future Of Private Enterprise, Ewell E. Murphy, Jr.

Vanderbilt Journal of Transnational Law

We live in tumultuous times. Whether measured on a scale of millennia, of centuries, or of generations, our lifetime's segment of the graph of world history is marking giddy ascents, harrowing declines, and abrupt, unbridgeable discontinuities.

On a millennial scale we are entering the twilight of those five astounding centuries of Western leadership that began with the Renaissance. The flags of empire, long banished from the Americas, have now been struck in Asia and Africa as well, and flutter quaintly over only a dwindling handful of enclaves and outposts. Islam has awakened from her sleep of seven hundred years and …

First Amendment Protection For Commercial Advertising: The New Constitutional Doctrine, Thomas W. Merrill Jan 1976

First Amendment Protection For Commercial Advertising: The New Constitutional Doctrine, Thomas W. Merrill

Faculty Scholarship

Governmental regulation of commercial advertising has become a major focus of challenges to established first amendment doctrine. An increasing number of suits have raised constitutional objections to regulations of false or deceptive advertising, regulations of offensive advertising, prohibitions of commercial advertising in certain forums, prohibitions of price advertising for particular products or services, and prohibitions of all advertising for particular products or services.' Until recently, the majority of courts upheld such regulations under the Supreme Court's ruling in Valentine v. Chrestensen that "purely commercial advertising" is unprotected by the first amendment.

In the last two years the Court has subjected …

The Turkish Aid Ban: Review And Assessment, A. A. Fatouros

Articles by Maurer Faculty

In this article, A.A. Fatouros places the U.S. aid-embargo to Turkey in the context of jurisdiction (executive vs. legislative powers) rather than in the context of ideological differences between the two camps. If, as the writer claims, the final concessions to the executive branch by Congress had been predictable, could we conclude that the executive branch is on the road to recovery? And if that is the case, is the Congressional ratification of the recent agreement between Kissinger and Turkey a foregone conclusion? There is of course such a possibility. To avert it, the opponents of the aid and the …

Book Review Of Disaster By Decree, Charles F. Abernathy Jan 1976

Book Review Of Disaster By Decree, Charles F. Abernathy

Georgetown Law Faculty Publications and Other Works

In Disaster by Decree, and beginning with Brown v. Board of Education, Professor Graglia traces national efforts at school desegregation, constantly pricking the Court's egalitarian balloon with his needle of logic. How can the 1954 Brown decision, he asks, which forbade consideration of race in school assignments, justify current relief decrees that require courts and school boards to consider race? This attack indeed may catch affirmative action proponents at their Achilles' heel, for preferential admissions programs, if not actually spawned by admiration of the courts' desegregation efforts, draw constitutional strength from the courts' own repeated assumption of the …

Prescription Drugs And Open Housing: More On Commercial Speech, Howard Hunter

Research Collection Yong Pung How School Of Law

It has long been an assumption of American democracy that the liberties guaranteed by the First Amendment to the Constitution are fundamental to the development and success of a democratic society. The freedom to speak one's mind, to publish one's thoughts, to petition the government for a redress of grievances, and to worship or to refrain from worshipping according to one's conscience are those freedoms which set a democratic society apart from other forms of political organization. They provide the individual with the opportunity for self-fulfillment and the society with the benefit of the thoughts, ideas, and aspirations of an …

Constitutional Law—The Public Forum In Nontraditional Areas—Lehman V. City Of Shaker Heights, 418 U.S. 298 (1974), David D. Swartling

Washington Law Review

In 1970, Harry Lehman, a candidate for election to the Ohio state legislature, attempted to purchase advertising space on local buses belonging to the city of Shaker Heights' rapid transit system. Although space was available, the advertising agent for the transit company rejected Lehman's request because its contract with the city proscribed political advertising on buses. Lehman sought a declaratory judgment and an injunction, alleging violation of the first and fourteenth amendments. The trial court denied relief, and the state supreme court affirmed. In a 5-4 decision, the United States Supreme Court affirmed. In the plurality opinion, Justice Blackmun concluded …
