Judicial Caution And The Supreme Court's Labor Decisions, October Term 1971, Theodore J. St. Antoine
Articles
Labor law, like most other law in the making, is intensely political at its margins. On certain central themes, such as the right to join a union and freedom of contract, judges and administrators of widely varying outlooks may be able to reach a consensus. But along the frontiers of the law, no such accord can be expected. Conscientious decision-makers will inevitably differ with one another, depending on their diverse social values. They may even differ with their own prior positions, depending on shifts in the political climate. Moreover, if the decision-makers happen to be justices of the United States, …

Constitutional Law- Freedom of Speech- Dismissal of Public School Teacher for Symbolic Expression of Political Opinion in the Classroom Held Unconstitutional. This case note discusses the first amendment issue in James v. Board of Education, 461 F.2d 566 (2d Cir. 1972), and the extent to which schools may limit a teacher's freedom of expression in the classroom. The note reviews the various tests used to analyze freedom of expression in general and then analyzes case law in the school context to infer that a court may permit state or local governments to control classroom expression when a teacher uses his …

Notes And Comments: U.P.I.A. In Maryland: Retroactive Application, Richard A. Spirko
Notes And Comments: U.P.I.A. In Maryland: Retroactive Application, Richard A. Spirko
University of Baltimore Law Review
Adoption of the Uniform Principal and Income Act has greatly simplified the administrative duties of a trustee who must properly allocate corporate distributions between the income beneficiary and the remainderman. However, Maryland expressly prohibits retroactive application of the UPIA to trusts created prior to its adoption. The result is an inequitable application of obsolete rules of law which do not reflect the sophisticated accounting practices involved in modern corporate distributions.

Separation Of Powers: Congrssional Riders And The Veto Power, Richard A. Riggs
Separation Of Powers: Congrssional Riders And The Veto Power, Richard A. Riggs
University of Michigan Journal of Law Reform
It has been suggested that in order to avoid this potential crisis statutory authority to veto nongermane riders be granted to the President. One author has contended that no such statute is needed, that the President presently has such power under Article I, Section 7 of the Constitution. On the other hand, bills have been introduced in both houses of Congress which might have specifically denied that power to the President. This article examines whether there is any constitutional ground on which the President could take the unprecedented action of separately vetoing congressional riders.

Modern Legislation, Metropolitan Court, Miniscule Results: A Study Of Detroit's Landlord-Tenant Court, Marilyn Miller Mosier, Richard A. Soble
University of Michigan Journal of Law Reform
This article is a description of a study of cases filed and tried in the Detroit, Michigan, Common Pleas Court, Landlord-Tenant Division, during 1970 and 1971. The court is in a large urban center and handles a high volume of cases, in most of which one or both parties appear without an attorney. The impetus for the study was Michigan legislation passed in 1968, which gave tenants additional defenses to summary eviction procedures. The main goal of the study was to observe the effects of the legislation on tenants who were subject to summary proceedings in Detroit. The purpose of …

Contract Rights And The Successor Employer: The Impact Of Burns Security, Michigan Law Review
Michigan Law Review
This Note will only briefly discuss the implications of Burns for NLRB proceedings. Instead, the focus will be on the impact of Burns on actions to compel arbitration under section 301. Is the rationale of Burns inconsistent with the rule established in Wiley for section 301 actions? If it does not undermine Wiley, does Burns indicate when employers will be deemed successors in future actions under section 301 to compel arbitration? Before examining these questions, however, it is necessary to consider the decisions of Wiley and Burns.

Offshore Oil Interests Of The United States: An Overview, Scott H. Marstan
Marine Affairs Theses and Major Papers
The following discussion focuses on the current situation as regards U.S. oil interests worldwide offshore. It divides into three general areas: 1) a general view of the scope of the U.S. oil companies' investments offshore, foreign and domestic, 2) an analysis of the recent rise to power of the Organization of Petroleum Exporting Countries (OPEC) and the ensuing problems created for U.S. oil investments abroad, and 3) a brief history and a discussion of U.S. oil interests in the law of the sea as an expression of their concern for resolution to OPEC-like problems.
