General Equilibrium Theory And International Trade, Jagdish N. Bhagwati
Faculty Scholarship
This volume of Takashi Negishi's excellent essays in the theory of international trade underlines two major phenomena in this field: i) the displacement of the MarshalJian partialequilibriμm tools of analysis (now to be found only in the old-fashioned textbooks) by the general-equilibrium analysis of Mill, Marshan and Edgeworth which culminated in the major work of Meade and others; and ii) the emergence of a creative and ingenious school of Japanese international trade theorists in the last decade (of which Negishi is one of the more eminent members) which has virtually shifted the center of gravity in trade-theoretic research from England …

Courts-Martial And The Commander, Kenneth J. Hodson
Courts-Martial And The Commander, Kenneth J. Hodson
San Diego Law Review
During court-martial, the commander decides on the charge, selects of the jury, and reviews the trial's results. This Article examines these aspects of the military justice system. Currently, the decision to charge is made after the commander's legal advisor reviews the Article 32 investigation. This Article suggests a system where the Article 32 investigation is replaced by a probable cause hearing before a judge. Jury selection, like the decision to charge, is at the commander's discretion, allowing the commander to include and exclude military members. The Article calls for a military judicial system divided into districts from which an independent …

Equal Protection, Economic Legislation,And Racial Discrimination, William Silverman
Equal Protection, Economic Legislation,And Racial Discrimination, William Silverman
Vanderbilt Law Review
The drive to end racial discrimination now extends beyond blatant racial distinctions to less obvious and less intentional forms of unequal treatment; nonetheless, there still exist laws and governmental programs that are racially neutral on their face but that may have a racially discriminatory impact in practice. Such discrimination can take place when economic and social welfare legislation, lacking a sound economic grounding, attacks symptoms rather than causes and thereby unintentionally compounds the problems facing black people. At the same time, laws that are at the root of unequal treatment seem to go unchallenged. From the point of view of …
Alternatives To Administrative Trial-Type Hearings For Resolving Complex Scientific, Economic, And Social Issues, Barry B. Boyer
Alternatives To Administrative Trial-Type Hearings For Resolving Complex Scientific, Economic, And Social Issues, Barry B. Boyer
Michigan Law Review
Within the current wave of criticism directed at the federal administrative agencies, a traditional theme of administrative law is frequently echoed: agencies have allowed their proceedings to become over-judicialized, and ought to engage in more rule-making to avoid the slow, cumbersome, and repetitious process of case-by- case adjudication. As if to confirm the urgency of these calls for greater use of the rule-making power, examples occasionally surface which suggest that trial-type proceedings may collapse under their own weight and force some agencies to resort to rule-making if they are to accomplish anything at all. Thus, the Interstate Commerce Commission has …
