The Legal Aspects Of Containerization, C. Douglas Skinner
The Legal Aspects Of Containerization, C. Douglas Skinner
Marine Affairs Theses and Major Papers
A not-so-quiet revolution has been sweeping the transportation industry with the advent of containerization, a practice wherein goods are loaded into a 20' by 40' x 8' box of metal, wood or fiberglass, sealed, and shipped as a unit or package via rail, truck, freighter, or even air. While the use of the container for point-to-point shipment is part of the larger aspect of intermodal transportation, or the process through which the container travels by way of the differing methods or modes of transportation, this paper will deal primarily in how the ocean shipping industry interacts legally with the other …

Defining And Attaining Equal Educational Opportunity In A Pluralistic Society, Ernest Q. Campbell
Defining And Attaining Equal Educational Opportunity In A Pluralistic Society, Ernest Q. Campbell
Vanderbilt Law Review
We in America have never made peace with the concept of pluralism. As a nation, we are fundamentally committed to the ideal of "equal opportunity"; yet, despite our presumably concomitant dedication to the principle that society should accommodate diverse values and goals,we have not conceptualized any means of determining whether equality of opportunity exists except by measuring people on the same scale. We have an appropriate rhetoric for describing equal opportunity--self-actualization, through which each person develops to the fullest extent in those directions that he or she wishes--but we have no institutionalized standards for determining whether realization of potential has …

Justice As Fairness: A Commentary On Rawls's New Theory Of Justice, Gilbert Merritt
Justice As Fairness: A Commentary On Rawls's New Theory Of Justice, Gilbert Merritt
Vanderbilt Law Review
A Theory of Justice,' John Rawls's new book on social and legal philosophy, appears likely to become a monument of systematic thought comparable to Locke's Second Treatise of Government and Mill's Utilitarianism. It provides answers systematically to the most difficult questions of our time and promises to shape the thought and action of men for many years. Daniel Bell, a noted social scientist, has said that in Rawls "we can observe the development of a political philosophy which will go far to shape the last part of the 20th Century, as the doctrines of Locke and Smith molded the 19th."' …

The Constitutionality Of State Residency Requirements For Admission To The Bar, Michigan Law Review
The Constitutionality Of State Residency Requirements For Admission To The Bar, Michigan Law Review
Michigan Law Review
There has been controversy in the lower federal courts concerning durational residency requirements and one recent state court challenge of a simple residency requirement. This Note will discuss the constitutional validity of these requirements in the face of equal protection attacks, concentrating on the extent to which such requirements are justified by the interests of state courts in maintaining the integrity of their legal systems.
Juvenile Justice: The Economics Of Ineptitude, William M. Mccarty
Juvenile Justice: The Economics Of Ineptitude, William M. Mccarty
San Diego Law Review
The Juvenile Justice System is complex and wrought with problems. This Article reviews the scope and cost of the juvenile justice system. The article looks at the national and human costs of the system, with an eye towards change where the federal government assumes more of a leadership position, but not full control of the system. To alter the current juvenile justice system, the Article proposes a formula with which to measure the benefits and gauge the attitude towards the system. The author concludes that the government should focus efforts on modifying the system’s objective, putting constructive materials in the …
The Authentication Of Documents Requirement: Barrier To Falsehood Or To Truth?, Lawrence A. Alexander, Elaine A. Alexander
The Authentication Of Documents Requirement: Barrier To Falsehood Or To Truth?, Lawrence A. Alexander, Elaine A. Alexander
San Diego Law Review
The authentication rule requires that evidence submitted to the trier of fact sufficient. This article demonstrates how the authentication rule serves as a barrier to determining the relevancy and authenticity of documents relating to the facts in issue. The authentication rule often restricts the admissibility of evidence. At times the rule is superfluous because the same evidence that authenticates the writing is also enough evidence to prove the ultimate fact at issue. At other times the rule distorts the force of a parties’ case because the same evidence that is enough to prove the ultimate fact at issue is not …
Summary Creditor Remedies: Going…Going…Gone?, Patricia D. Benke
Summary Creditor Remedies: Going…Going…Gone?, Patricia D. Benke
San Diego Law Review
In Sniadach v. Family Finance Corporation, the Court effectively held that a summary creditor proceeding amounted to a taking of property without due process of law. This Note examines the summary creditor remedy. After Sniadach, concerted judicial attacks, like those on California’s claim and delivery statutes, and prejudgment attachment proceedings, were made on summary creditor remedies resulting in a broad reading of Sniadach. However, legislatures began enacting exceptions to Sniadach’s rule, such as requiring that seizures benefit the public, be immediate in nature, and have no affect on another’s livelihood. The next case to reach the Supreme Court, Fuentes v. …
