International Protection Of Computer Programs, Dale L. Carlson

Syracuse Journal of International Law and Commerce

This Comment is designed to acquaint the international lawyer with various considerations which underlie the obtaining of copyright and patent protection for computer programs. Both patent and copyright protection are considered in view of the statutory provisions of several technologically developed countries-the United States, Canada, the United Kingdom and the Soviet Union. In addition, the statutory provisions of the various countries are related to the particular ideologies of the administrative agencies which implement the patent and copyright laws within each jurisdiction.

Prudence In Trust Investment, Thomas D. Johnston Jan 1975

Prudence In Trust Investment, Thomas D. Johnston

University of Michigan Journal of Law Reform

Part I of this article presents a brief history of the prudent man standard and explores the meaning of "prudence." Part II discusses the shift in legal theory to include equities as prudent investments. Part III articulates the weaknesses in the method currently used by courts to assess investment prudence in view of the exigencies confronting today's trustee-investor. Finally, part IV shows that the same factors which justified the creation of the Prudent Man Rule and its expansion to include equities will support its modification to encompass modern investment theories and techniques.

Toward A Uniform Approach To Multilevel Distributorships, Donald Daniels Jan 1975

Toward A Uniform Approach To Multilevel Distributorships, Donald Daniels

University of Michigan Journal of Law Reform

The phenomenal growth and eventual collapse of the enterprises of Glenn Wesley Turner and William Penn Patrick during the 1960's should have surprised no one. They were only a recent example of an old and recurrent merchandising scheme, a variant of the chain letter device. Such operations, commonly called pyramid sales schemes, can temporarily succeed where a credulous public, willing to believe that it can get rich quickly for a small monetary investment and little or no expenditure of effort, exists in a legal system lacking a coordinated program for the prevention of such machinations. Pyramid sales schemes have been …

Deceptive Practices In The Marketplace: Consumer Protection By New York Government Agencies, William F. Mulroney Jan 1975

Deceptive Practices In The Marketplace: Consumer Protection By New York Government Agencies, William F. Mulroney

Fordham Urban Law Journal

The past several years have witnessed considerable growth in the power and number of New York governmental consumer protection agencies. New and potent statutory powers have been granted to the Attorney General. At the local level, cities, counties, and towns have created consumer agencies and granted many of them enforcement and rulemaking powers. Legislation on all levels of state government regulates an increasing number of commercial activities for the protection of consumers. That legislation has likewise led to greater cooperation among state and local consumer agencies. This Comment will examine the structures and powers of the various New York State …

Thoughts On Rodriguez: Mr. Justice Powell And The Demise Of Equal Protection Analysis In The Supreme Court, Larry Yackle Jan 1975

Thoughts On Rodriguez: Mr. Justice Powell And The Demise Of Equal Protection Analysis In The Supreme Court, Larry Yackle

Faculty Scholarship

Since the fall of 1969 when Warren Earl Burger took his seat as Chief Justice, the academic community has placed the Supreme Court under a thorough and searching examination. Coming on the heels of enormous and far-reaching activity in the judicial branch, the Burger Court has been called to account for both its adherence to and its rejection of the Warren Court's innovations in constitutional adjudication. The purpose of this article is to continue that constructive criticism by taking stock, after five years, of the Court's performance in one significant class of cases-those interpreting the equal protection clause of the …

Federal And State Regulations Pertaining To Systematic Collections. I. A Case Of Inadvertent Violation Of Federal Regulations, Jerry R. Choate, Hugh H. Genoways

University of Nebraska State Museum: Mammalogy Papers

First paragraph:

On 25 April 1975, at the twenty-second annual meeting of SWAN (i.e. Southwestern Association of Naturalists), at the University of Oklahoma Biological Station, President Keith A. Arnold appointed one of us (Choate) to investigate current regulations pertaining to collection and transport of scientific specimens in the region of representation (including Mexico) or SWAN. This charge involves both Federal and State laws, several of which are undergoing change and many of which doubtlessly are not familiar to the membership of SWAN. In order that SWAN members might be made aware of these regulations and not unwittingly commit violations, it …

California Congressional Reapportionment, Thomas B. Hofeller Jan 1975

California Congressional Reapportionment, Thomas B. Hofeller

CGU Theses & Dissertations

We now find ourselves at the end of the first redistricting following the so called "Reapportionment Revolution." There is, however, considerable disagreement defining its scope and the wisdom of its continuation. This paper reviews the effects of this revolution on this state. It outlines the development of the Court's involvement in redistricting and discusses the virtues of the Court's resistance of further involvement in this difficult question.

California's congressional redistricting history is reviewed from statehood to the present. Special attention is given to 1965, 1971, and 1973. The role of the computer is reviewed, both as an academic and political …

Practical Pitfalls In Handling Scientific Evidence, John W. Reed Jan 1975

Practical Pitfalls In Handling Scientific Evidence, John W. Reed

Book Chapters

In this article we are concerned with the techniques of what is more often an art than a science. Before going into the specifics, it is useful to take a look at scientific evidence in general-where it stands in relationship to other kinds of evidence, on what theory or theories it is admitted, and how to maximize its effect when it is admitted.

Proposed State Euthanasia Statutes: A Philosophical And Legal Analysis, Erik Kapner Jan 1975

Proposed State Euthanasia Statutes: A Philosophical And Legal Analysis, Erik Kapner

Hofstra Law Review

In recent years medical science has improved its ability to prolong life through sophisticated life support systems while as yet it has been unable to reverse the progress of fatal disease or the ravages of total physical injury. We have seen an increasing number of patients incurably ill, yet not allowed to die. This has resulted in a renewed interest in euthanasia as a remedy. This comment will examine the philosophical and legal underpinnings of euthanasia legislation; and further, it will analyze three specific pieces of legislation to determine how they deal with the major concerns of both the opponents …
