Presidential Pensions And Impeachment: A Proposal For Reform, Patrick E. Mears Jan 1975

Presidential Pensions And Impeachment: A Proposal For Reform, Patrick E. Mears

University of Michigan Journal of Law Reform

The Former Presidents Act grants annual monetary and clerical allowances and free office space to "former Presidents." Under the Act a President is ineligible to receive any retirement benefits if he or she is removed from office by impeachment and conviction in the Congress of the United States. However, a President facing imminent impeachment can retain the benefits by resigning before the impeachment process culminates in his removal from office. Constitutional considerations indicate that the benefits conferred by the Act could not be revoked or reduced by special congressional legislation upon resignation; such action could be challenged as a bill …

Equal Protection Or Equal Denial: Is It Time For Racial Minorities, The Poor, Women, And Other Opressed People To Regroup?, Inez Smith Reid Jan 1975

Equal Protection Or Equal Denial: Is It Time For Racial Minorities, The Poor, Women, And Other Opressed People To Regroup?, Inez Smith Reid

Hofstra Law Review

The suspect classification approach as it pertains to women, racial minorities, and the poor will be analyzed first in order to determine what gains, if any, have been achieved and lost via this route. Then the utility of an equal protection-fundamental rights approach which may accent more concerns common to women, minorities, the poor, and other oppressed peoples will be examined. Finally, the value of a "sliding-scale" route to equal protection issues as a route which might permit the oppressed to present a more reasoned equal protection package to the Court, and simultaneously make it more uncomfortable for the Supreme …

Thoughts On Rodriguez: Mr. Justice Powell And The Demise Of Equal Protection Analysis In The Supreme Court, Larry W. Yackle Jan 1975

Thoughts On Rodriguez: Mr. Justice Powell And The Demise Of Equal Protection Analysis In The Supreme Court, Larry W. Yackle

University of Richmond Law Review

Continuity with the Warren Court jurisprudence is not a duty but only a necessity. The necessity is not to follow precedent blindly, but to explain the reasons for departure from it and to justify, again by reason rather than personal predilection, the results reached in every case.

The Uniform Probate Code: Article Iii Analyzed In Relation To Changes In The First Nine Enactments, Richard V. Wellman, James W. Gordon

Faculty Scholarship

The eleven pioneer states that have adopted the Uniform Probate Code have amended its provisions in various ways. This Article reviews the changes made in article III, the central procedural section of the Code. The Authors analyze the import of these amendments, considering the interplay between the carefully drafted provisions of the Code and its policy of uniformly minimizing the iudicial intervention and expense involved in the administration of estates. The Authors' analysis of these first enactments should prove helpful in those states currently considering adoption of the Uniform Probate Code as well as to lawyers and the courts in …

Public Access To The Beaches Of Connecticut, Don W. Oswalt Dec 1974

Public Access To The Beaches Of Connecticut, Don W. Oswalt

Marine Affairs Theses and Major Papers

Elements of the public of Connecticut are engaged in direct conflict against private and municipal property rights over the issue of increased public access to beaches of the state. In Connecticut, as well as the nation, definite solutions to the problem are slow to materialize. The public's right to the whole beach is being clarified by only a few states, while public access under common law remains a clouded issue nationwide. The research study I am proposing would examine in detail the legal issues involved, the state and federal legislative actions, geographical considerations, etc. I feel that the resulting collation …

Zahn V. International Paper: Taking The Action Out Of Class Action, Or Can Zahn Be Avoided?, Richard P. Berg

San Diego Law Review

The Supreme Court's decision last term in Zahn v. International Paper Co. was greeted in the news media with prophecies of doom for class actions brought in federal court. Though the media's concern was earnest, upon closer inspection, Zahn does not nearly have such a virulent effect. There is little doubt, however, that Zahn will be a serious hurdle to many class action litigants in federal court.
