Public Access To Beaches In America, Michael Betty
Public Access To Beaches In America, Michael Betty
Marine Affairs Theses and Major Papers
In the United States today there exists a growing, mobile population who wish to make use of what is considered to be a diminishing natural resource, the shoreline beaches. The public is denied access to the sea and the enjoyment of shore by the littoral land owner who occupies the beach area to the exclusion of all others.
It appears that the rights of the public will have to be expanded to insure adequate space and facilities for recreation. This expansion will encroach on private rights as the population seeks access to beach areas that have assumed a public character. …
A Regime For Archipelagos, Ralph Fink Iii
A Regime For Archipelagos, Ralph Fink Iii
Marine Affairs Theses and Major Papers
An analysis of the development of international law in the case of island States. The rights of these States to establish special juridical arrangements for their adjacent waters, and the effects of these decisions on other nations form the central theme. Any attempt at combining all the issues at stake into a single principle by LOS III appears doomed to failure. Success will be achieved by agreement on the separate issues and as a result of other actions not directly related to the problem of archipelagic States.

Municipal Bonds And The Federal Securities Laws: The Results Of Forty Years Of Indirect Regulation, Bruce N. Hawthorne
Vanderbilt Law Review
Recent abuses occurring in the municipal bond markets have threatened investor confidence and caused Congress to reevaluate its original decision to exempt these securities from the Securities Act of 1933 and the Securities Exchange Act of 1934. This Note will analyze in some depth the securities regulation aspects of the municipal securities markets. First, because an understanding of the unique nature of municipal securities and their markets is essential, a description will be made of the characteristics of municipal bonds and municipal bond purchasers, the participants in the municipal securities industry, and the new issue and trading markets for municipal …

Beach Access: Public Right Or Public Privilege, John E. Jessup
Beach Access: Public Right Or Public Privilege, John E. Jessup
Marine Affairs Theses and Major Papers
All the coastal states of the U.S., particularly the more populous, have been and are struggling with the problem of obtaining public access to the nation's coastal beaches. There s a large volume of litigation and legislation devoted wholly or in part to mitigating the problem. It is the intent of this paper to examine some of the landmark court cases on the subject throughout the U.S. and also Federal legislation which has been proposed or enacted. Because the issue joined is so basic, i.e., public rights to use the beach vs. private property rights in that same beach, emotions …

Uncovering "Nondiscernible" Differences: Empirical Research And The Jury-Size Cases, Richard O. Lempert
Uncovering "Nondiscernible" Differences: Empirical Research And The Jury-Size Cases, Richard O. Lempert
Michigan Law Review
My point is not that verdict differences associated with jury size cannot be revealed through careful empirical investigation. Indeed, at several places in this article I will suggest research strategies likely to reveal such differences. Rather, it is that typical strategies of legal-impact research, such as those utilized in the Colgrove real-world studies, are unlikely to uncover differences associated with jury size however well they control for those plausible rival hypotheses that form the usual threats to the validity of impact research. The reason lies in the unamenability of the jury-size problem to the usual techniques of aggregate data analysis.

Cruel Or Unusual Punishments In California: New Problems In Fitting Punishment To Crimes, Robert L. Eisenberg
San Diego Law Review
Recently, two California courts of appeal have attempted to apply the cruelty standards laid down in Lynch to the punishment proscribed in a criminal assault statute. People v. Romo and People v. Wingo came to opposite conclusions as to whether the punishment was cruel or unusual. The conflict will be resolved by the Supreme Court of California when it reviews the two cases. This Comment will discuss the status of California's cruel or unusual punishment provision, and will analyze the important problems raised by Romo and Wingo.

The Inns Of Court, Edson R. Sunderland
The Inns Of Court, Edson R. Sunderland
Law Quadrangle (formerly Law Quad Notes)
Edson R. Sutherland was Professor of Law at the University of Michgian from 1901-1944 and Professor Emeritus until 1959. This manuscript, based on original research by Prof. Sunderland and presented orally in 1951 to a faculty group from all parts of the University, hasbeen found only recently among his papers. The idea of publishing the piece came from Thomas V. Koykka, Class of 1930, a student of Sunderlands who knew him quite well from service with him on the University board in control of student publications. At Mr. Koykka's suggestion that the piece ought to have "a wider audience than …

Following In Another's Footsteps: The Acquisition Of International Legal Standing By The Palestine Liberation Organization, Robert A. Fisher
Following In Another's Footsteps: The Acquisition Of International Legal Standing By The Palestine Liberation Organization, Robert A. Fisher
Syracuse Journal of International Law and Commerce
The Palestine Liberation Organization (PLO) is a public body which has been accorded certain international legal standing. The purpose of this Comment is to chronicle the acquisition of that standing by reference to identifiable stages in a similar process undertaken by the Zionist Organization/Jewish Agency for Palestine. This kind of analysis should illustrate not only how international law bears upon Middle Eastern developments, but also how international practice of the last half century has allowed peoples such as the Jews and Palestinians to attain legal standing, as a vehicle for acquiring territorial sovereignty.
The Meaning And Role Of Prescriptive And Descriptive Statements: Particularly In The Legal Universe Of Discourse, Ivanhoe Tebaldeschi
The Meaning And Role Of Prescriptive And Descriptive Statements: Particularly In The Legal Universe Of Discourse, Ivanhoe Tebaldeschi
Syracuse Journal of International Law and Commerce
In a sense, any positive legal system can be considered as a body of prescriptive statements. Prescriptive statements represent indications of models of conduct. They include most often the linguistic expression "ought" (or "ought not") which works as a link between the grammatical subject and the predicate of the relevant sentence. Accordingly, prescriptive statements have also been called "ought-statements." This name has been mainly adopted in order to contrast prescriptive statements with descriptive statements, which are accordingly called "is-statements."
Another label for prescriptive statements is "deontic statements" or "statements having a deontic quality." Deontic quality imports a conceptual reflexion or …

The Legal Imagination And Language: A Philosophical Criticism, Thomas D. Eisele
Faculty Articles and Other Publications
James B. White's The Lega/lmagination: Studies in the Nature of Legal Thought and Expression takes upon itself an immense task, namely, investigating and characterizing the position of lawyers and the legal mind in today's world. Not surprisingly, the characterization and criticism of such a book is no less difficult a task or responsibility than that undertaken by the book. In fact, the characterization and criticism of the book and the characterization and criticism in the book-both being acts of criticism-require the same attitude: constant fidelity to the data with which one has to work. In
describing and assessing the book, …
