Comparative Criminal Law Within The Soviet Union: A Review, William E. Butler
Comparative Criminal Law Within The Soviet Union: A Review, William E. Butler
Dalhousie Law Journal
The application of the comparative method to the study of two or more legal systems has led a jaded existence in the Soviet Union, for a variety of reasons. As a technique of inquiry, it has been acceptable only insofar as its utilization conforms to the general methodology of dialectical and historical materialism: "It is wrong to think," a Soviet jurist has argued, "that research procedures make up a series of instruments that, from an ideological and political point of view, are neutral."' Marxist jurists consequently have no sympathy for the view that ''comparison" is some type of "objective" or …
Pornography As A Species Of Second-Order Sexual Behaviour. A Submission For Law Reform, R. A. Samek
Pornography As A Species Of Second-Order Sexual Behaviour. A Submission For Law Reform, R. A. Samek
Dalhousie Law Journal
The immediate subject-matter of law reform is law, and the immediate reason for reforming the law is dissatisfaction with the law as it is; but the ultimate subject-matter of law reform is the human behaviour contained in a social practice, and the ultimate reason for reforming the law is dissatisfaction with such behaviour. The immediate task of the law reformer is to bring about a change in the legal rules; but his ultimate task is to bring about a change in human behaviour. Hence, law reform ultimately presupposes a set of evaluative standards according to which human behaviour can be …

Three Reviews Of R. M. Burns (Ed.), One Country Or Two?, L. C. Green
Dalhousie Law Journal
One Country or Two is an excellent book on the most critical subject faced by Canadians. It discusses Canada's nationhood and the issues of its survival as a political marriage of two peoples and two cultures. Ten main essays are edited by R. M. Burns, introduced by Principal John Deutsch, and provided with a reflective postscript by one of the essayists, Richard Simeon, who reviews some features of Quebec society in the light of the October crisis of 1970. All contributors are English-speaking Canadians and all except three are on the faculty of Queen's University. The essays are not uniform …

Conflicts Between Treaties And Subsequently Enacted Statutes In Belgium: Etat Belge V. S.A. "Fromagerie Franco-Suisse Le Ski", Michigan Law Review
Michigan Law Review
In Etat Belge v. S.A. "Fromagerie Franco-Suisse Le Ski," the Supreme Court of Belgium was faced with a conflict between a provision of the European Economic Community (EEC) treaty and a domestic law enacted subsequent to Belgian ratification of the treaty. The traditional approach in Belgium--and, incidentally, the rule in the United States--had been to give effect to whichever was enacted later in time. Although not stated explicitly in any constitutional provision, this rule had been well settled in Belgium.

Mental Illness: A Legal Fiction, James H. Hardisty
Washington Law Review
Professor Hardisty examines the use of the term "mental illness" by the law, focusing upon competency and insanity defense tests. After determining that the term has no accepted medical definition, the author analyzes the necessity for legal usage of the term. Professor Hardisty concludes that the term "mental illness" should be deleted from the law.

Segregation Of Poor And Minority Children Into Classes For The Mentally Retarded By The Use Of Iq Tests*, Michigan Law Review
Michigan Law Review
This Comment deals with the inadequacies of IQ tests as devices for identifying those children who are to be relegated to classes for the mentally retarded and with the constitutional ramifications of these inadequacies. The present use of standardized tests may violate due process and equal protection guarantees. Additionally, certain procedural due process requirements, heretofore ignored in this context, may apply to the placement process.

All efforts to improve the criminal law of this commonwealth prior to 1972 were directed toward relatively narrow problems. Legislative changes in the law had been made from time to time, almost always without conscious regard for the manner in which related principles were affected. Defects of considerable importance resulted. The criminal law became substantially disjointed and difficult of administration. Unjust and inequitable treatment of offenders was more prominent than its opposite. In some instances sanctions were clearly inadequate for the type of behavior sought to be controlled. In others they were grossly disproportionate to the social harms used to …

Zahn V. International Paper Co. - The Aggregation Principle And Its Effect On Jurisdiction In Rule 23 (B)(3) Class Actions, Zygmont A. Pines
Cleveland State Law Review
The course of the present inquiry begins with a consideration of the current obstacles confronting a diversity (b) (3) class action and proceeds toward an analysis of such considerations and the re- sulting ramifications, Special emphasis is placed on the policy aspects of the aggregation doctrine, the jurisdictional amount statute (28 U.S.C. § 1332), and the modern class action device, with specific reference to the problematic condition of the current judicial system.'
