Military And Foreign Affairs Function Rule-Making Under The Apa, Arthur Earl Bonfield Dec 1972

Military And Foreign Affairs Function Rule-Making Under The Apa, Arthur Earl Bonfield

What is needed, therefore. is a system of rule-making that will strike a sensible balance between the need for adequate public participation in that process. and the need for efficient government. In striking that balance. society's interest in involving affected members of the public in administrative rule-making at an early stage is not so slight that it …

The Revised Washington Criminal Code's Vital Structure: The Burden Of Proof, Felony Murder, And Justification Provisions, Richard Cosway

Washington Law Review

I have chosen to discuss three areas of the Proposed Code: the proof requirement (with primary emphasis upon the affirmative defenses), justification, and felony murder. These sections are vital underpinnings of the Proposed Code. The Code makes substantial changes in each of these provisions, all of which deserve and demand critical review.

Logic And Coercion In Bentham's Theory Of Law, David B. Lyons Feb 1972

Logic And Coercion In Bentham's Theory Of Law, David B. Lyons

Faculty Scholarship

Unlike conventional moral standards and other social rules, laws can be deliberately laid down and changed by specified procedures. It therefore seems reasonable to think of laws as issuing from or adopted by lawmakers who are ordinary human beings. Since laws tell us what must or must not be done, and since there is some temptation to understand all laws on the same pattern, it is natural to think of them as either commands or prohibitions. This is indeed a traditional view.

Voice Identification Based On Spectrographic Analysis

University of Baltimore Law Review

This comment deals with spectrographic analysis and the conflict between courts' criteria for admissibility, using either the general-acceptance-of-the-scientific-community test or the accuracy-and-reliability test. The conclusion drawn is that the general-acceptance test should be coupled with judicial notice to avert the undesirable situation of having a lay jury making technical scientific judgments.
