The Future Of First Amendment Overbreadth, J. W. Torke Mar 1974

The Future Of First Amendment Overbreadth, J. W. Torke

Vanderbilt Law Review

In Broadrick, Justice White suggests that the willingness of the Court in the past to accord standing to litigants to raise the over-broad aspects of a statute without regard to their own conduct'depended on a "judicial prediction or assumption" regarding the threat to liberty that the statute posed.' The spirit with which the Court makes such predictions would appear to be determinative not only of the underlying standing issue but of the overbreadth claimas well." The key to discovering the paths by which the Court is "retreating" from its overbreadth holiday of the sixties lies in the recognition that the …

A Theory Of Respect, Richard Stith Jan 1974

A Theory Of Respect, Richard Stith

Law Faculty Publications

To understand and to describe the feeling we call "respect" is the purpose of this thesis. Relying primarily upon the method of phenomenology, the contours of this often. invoked moral feeling are developed and a pattern and structure are therein discerned.

General issues of methodology as well as specific problems of access to the phenomenon of respect are first considered. Respect for persons qua persons is eschewed as a focus~ in order that our analysis not become excessively entangled in the nature of personhood. Rather, we turn to those particular individuals for whom we each have at some time felt …

Emigration: A Policy Oriented Inquiry, Arthur Jay Silverstein Jan 1974

Emigration: A Policy Oriented Inquiry, Arthur Jay Silverstein

Syracuse Journal of International Law and Commerce

This inquiry will treat restrictions on the desire to emigrate in a conceptual manner so as to provide criteria and procedures for decision-making. First, a framework will be constructed to assist decision-makers--be they heads of state, diplomats, legislators, bureaucrats, or simply citizens--in evaluating the competing claims involved when an individual seeks to exercise the right to emigrate. Then, an analysis of the emigration policies of Austria, India, the Soviet Union, the United Kingdom, and the United States will be presented as illustrative of the world community's approach toward emigration showing its general expectations about appropriate controls on emigration. Finally, the …

Queries 'N Theories: An Instructional Game On The Dot, Dot, Dot... Approach To Scientific Method, Layman E. Allen Jan 1974

Queries 'N Theories: An Instructional Game On The Dot, Dot, Dot... Approach To Scientific Method, Layman E. Allen

Articles

QUERIES 'N THEORIES provides a parallel to the strong inference approach to scientific method - designing experiments, observing data, and theorizing. The reiter- ated use of the DOT approach (Design, Observe, Theorize) in the problem-solving required by the game mirrors the regular, systematic application of strong inference in some areas of science (e.g., high energy physics and molecular biology) that have moved ahead much more rapidly than others. Moreover, the game embodies and provides practice in two aspects of scientific theorizing and designing which John Platt has pointed out as central to scientific advance: (1) the usefulness of multiple hypotheses …

The Fourth Amendment As A Way Of Talking About People: A Study Of Robinson And Matlock, James Boyd White Jan 1974

The Fourth Amendment As A Way Of Talking About People: A Study Of Robinson And Matlock, James Boyd White

Articles

One way to regard what the Supreme Court has done in the cases it has decided under the Fourth Amendment is to say that it has created a specialized discourse of adjudication, a language in which it can talk about and dispose of the repeated conflicts that arise between an officer engaged in the process of crime control and a citizen upon whose freedom or security he intrudes. The events which bring these two figures together are bewildering in their variety and complexity, and the claims on each side are deeply felt and strenuously made. It has not been easy …

The General Assembly And Local Government: Legislating A Constitution 1969-1970, Jack Spain Jr. Jan 1974

The General Assembly And Local Government: Legislating A Constitution 1969-1970, Jack Spain Jr.

University of Richmond Law Review

Counties, cities, towns, sanitary districts and authorities-these are the building blocks of the Commonwealth of Virginia. The operations of these units directly affect the day-to-day activities of every Virginian. The Virginia Constitutional Revision Commission (the Commission), in proposing its recommended changes to the Virginia Constitution of 1902, therefore, considered the area of local government most carefully. Its recommendations contained in Article VII of the proposed Revised Constitution of 1971, set forth in the Commission's Report. When the proposed Constitution was considered by the General Assembly in the special session of 1969 before its final adoption by the General Assembly and …

Tignum Iunctum: The Xii Tables And A Lost Word, Alan Watson Jan 1974

Tignum Iunctum: The Xii Tables And A Lost Word, Alan Watson

Scholarly Works

A text of the scholar Festus, which is famous among Latinists and lawyers alike, reads:

Tignum non solum in aedificiis, quo utuntur, appellatur, sed etiam in vineis, ut est in XII: "Tignum iunctum aedibus vineave et concapit ne solvito".

For the quotation from the XII Tables, the manuscripts showsome variation for 'vineave': 'victum' in W, 'vineaque' in V and 'minerve' in X. But these we can happily leave aside and com to the crux of the text, 'concapit', which appears in all the manuscripts. "'Concapit', a corrupt word, and difficult of explanation" say Lewis and Short! And the emendations proposed …

Warrantless Search Of A College Dormitory, Ronald J. Bacigal Jan 1974

Warrantless Search Of A College Dormitory, Ronald J. Bacigal

Law Faculty Publications

Student Conduct is as much a part of the collegiate experience as intellectual pursuit, and regulation of student conduct has been a concern of university officials for as long as there have been students and universities. Until the 1960s the courts had few occasions to concern themselves with the regulation of student conduct; and, university officials were free to take any action short of action that was arbitrary and capricious. University officials were deemed to stand in loco parentis and thus could make and enforce any regulation for the physical training, moral enrichment, and betterment of their pupils that a …
