A Primer On Trademark Law And Internet Addresses, 15 J. Marshall J. Computer & Info. L. 465 (1997), David J. Loundy
UIC John Marshall Journal of Information Technology & Privacy Law
The conflicts arising over Internet addresses generally fall within four categories: trademarks as second-level domains; second-level domains that are similar to trademarks; trademarks as third-level domain/machine names; and trademarks as userIDs. When confronted with the four categories, a court will generally analyze the problem by looking at the likelihood of confusion, applying the dilution statutes, and determining if the trademark has been blurred or tarnished. The likelihood of confusion analysis looks at: the degree of similarity between the marks in appearance and suggestion; the similarity of the product or services; the area and manner of concurrent use; the degree of …

UIC John Marshall Journal of Information Technology & Privacy Law
The Internet, which links millions of computer networks together worldwide for the purpose of automated communication, is the forefront of communications technology. An Internet domain name, which functions as a computer user's "address" on the Internet, not only identifies individuals and organizations, but is an important commercial source designator for businesses. The Internet Network Information Center ("InterNIC") is a central resource center for Internet users that operates the Internet Domain Name System ("DNS"). InterNIC, which comprises NSI and AT&T, performs various Internet services, including NSI's Internet domain name coordination and registration. Along with the positive effects that the Internet has …

Science And International Regulatory Convergence, Jeffery Atik
Science And International Regulatory Convergence, Jeffery Atik
Northwestern Journal of International Law & Business
National regulation is frequently premised on scientific assump- tions; much of regulatory design is based on scientific findings. Con- sumer product, food and drug and workplace safety standards all depend on a scientific assessment of the risks faced by the public and of the efficacy of an adopted measure in addressing these risks. Build- ing codes, waste disposal protocols and mandated immunization of school children all proceed from the technical recommendations of the scientific community. In current Western society, a regulatory measure lacking a scien- tific basis will be subject to criticism and perhaps ridicule; it may be struck down …
Shrinking Water Resources: The National Security Issue Of This Century, Niveen Tadros
Shrinking Water Resources: The National Security Issue Of This Century, Niveen Tadros
Northwestern Journal of International Law & Business
There are several places in the world where war could erupt over a dwindling supply of clean water from shared water resources. As one nation after another finds itself reaching its water resource limits, the potential for conflict among them intensifies. Add to already scarce reserves pollution of the water source, and the global picture appears more menacing. In fact, public health officials attribute al- most 80% of illnesses in developing countries to contaminated water;' the United Nations Children's Emergency Fund (UNICEF) reports that more than 35,000 children all over the world die every day from hunger or disease caused …

Signals, Threats, And Deterrence: Alive And Well In The Taiwan Strait, Glenn R. Butterton
Signals, Threats, And Deterrence: Alive And Well In The Taiwan Strait, Glenn R. Butterton
Articles
Taiwan held its first democratic presidential elections in March 1996, which motivated mainland China to stage large scale contemporaneous war games in the Taiwan Strait and aim unusually belligerent rhetoric at Taipei. The United States responded by deploying substantial naval forces in the area. After examining this confrontation between China, Taiwan, and the United States in terms of the 1979 Taiwan Relations Act, international law, and non-nuclear deterrence theory, the author presents a novel analysis of indirect deterrence communication between the United States and China

Part III discusses issues arising from commercial activity on the Internet, including the validity of on-line contracts, the use of digital signatures for authentication, and the applicability of Taiwan's Broadcasting and Television Law, Cable Television Law, and Fair Trade Law to regulating commercial advertising on the Internet. Part IV discusses the …

Abolish The Juvenile Court: Youthfulness, Criminal Responsibility, And Sentencing Policy, Barry C. Feld
Articles
The juvenile court system should be abolished and all juvenile offenders should be integrated into the traditional criminal court system. The offenders' age should be taken into account during sentencing. The juvenile court system is a failure because a criminal punishment system cannot also be a social welfare system.

"Toward The Reformulation Of International Refugee Law" Research Report 1992-1997, James C. Hathaway

Discussions of the crisis in international refugee protection are frequently characterized by rhetorical excess, in which some ascribe all problems to malevolent states, while others are equally insistent that fraudulent asylum-seekers are solely to blame. This study was based, in contrast, on a recognition of the real systemic difficulties that jeopardize the viability of refugee protection. Its purpose was to devise a principled yet pragmatic way to reconcile state interests to the continued importance of access to asylum for those who need it.
The essence of our thesis is that the withdrawal of states from their legal responsibility to protect …
