Developing A National Coastal Zone Management Program For Venezuela, Marisol Salazar
Developing A National Coastal Zone Management Program For Venezuela, Marisol Salazar
LLM Theses and Essays
The primary focus of this study is to develop a National Coastal Zone Management Program for Venezuela, a moderate, comprehensive, and an effective long-term program which allows the development and protection of the Venezuelan Coastal Zone now and in the future. This program must comply with the actual Venezuelan environmental laws and its administrative mechanisms. Also, it must help to control ecological, economic, commercial, social, and human pressures on the Venezuelan coastal area. The design of this project will be based on an analysis of the extensive experience of the U.S.A. coastal states under the Coastal Zone Management Act (CZMA); …

Virtual Borders - Some Legal-Geo-Philosophical Musings On Three Globally Significant Fragil Ecosystems Under United Nations' Agenda 21 , Robert F. Blomquist
Cleveland State Law Review
The purpose of this article is to use the 1992 United Nations Conference on Environment and Development’s Agenda 21 discussion of globally significant fragile ecosystems as an imaginative launching point for some tentative explorations of what a recent Stanford Law Review Symposium terms "law and borders" studies. More specifically, I am interested in sketching and briefly analyzing what I call the "legal-geo-philosophical" characteristics of three examples of globally significant fragile ecosystems addressed in Agenda 21: (1) drylands, (2) mountains, and (3) coastal areas. The article's legal-geo-philosophical analysis, then, is an initial attempt to ponder some of the connections between law, …

To Hire Or Not To Hire: What Silicon Valley Companies Should Know About Hiring Competitors' Employees, Hanna Bui-Eve
To Hire Or Not To Hire: What Silicon Valley Companies Should Know About Hiring Competitors' Employees, Hanna Bui-Eve
UC Law Journal
The Silicon Valley is one of the most important moneygenerating regions of America. Its phenomenal success is the result of a unique regional network-based industrial system which operates as a kind of meta-organization. Engineers move frequently between firms and projects, taking the knowledge, skills, and experience acquired at previous jobs and using them as building blocks in their new jobs. California courts have contributed to Silicon Valley's success by allowing workers easy mobility among jobs and by restricting employers' attempts to restrain employees from relocating. As a result, most employers have come to accept a high turnover rate as a …

Making International Refugee Law Relevant Again: A Proposal For Collectivized And Solution-Oriented Protection, James C. Hathaway, R. Alexander Neve
Making International Refugee Law Relevant Again: A Proposal For Collectivized And Solution-Oriented Protection, James C. Hathaway, R. Alexander Neve
Articles
International refugee law is in crisis. Even as armed conflict and human rights abuse continue to force individuals and groups to flee their home countries, many governments are withdrawing from the legal duty to provide refugees with the protection they require. While governments proclaim a willingness to assist refugees as a matter of political discretion or humanitarian goodwill, they appear committed to a pattern of defensive strategies designed to avoid international legal responsibility toward involuntary migrants. Some see this shift away from a legal paradigm of refugee protection as a source for enhanced operational flexibility in the face of changed …

Jane Aiken and Kimberly O'Leary undertake the difficult work of developing specific approaches and techniques for taking account of characteristics such as race/ethnicity, gender, dis/ability, and sexual identity in clinical pedagogy. Carolyn Grose uses outsider narratives and popular culture to challenge the "pre-understanding" of students, and to assist them to accept client stories as true and valid. Focusing on the professional value of striving to promote justice, fairness, and morality identified in the MacCrate Report, Professor Aiken exhorts us to promote justice by unmasking privilege, the invisible package of unearned assets--about which I (we? or you?) was "meant" to remain …

My original answer to the question “Alternative to what?” was “the adversary system.” ADR held out the promise of a better way than the adversary system for handling at least some of the inevitable friction in society. I could not define “better” precisely, but it contained notions of faster, cheaper, less contentious, less aggravating, or more likely to leave the parties talking to each other when the process was over. My current answer to the question “Alternative to what?” is that ADR is not an alternative. Alternative Dispute Resolution courses have become Dispute Resolution. In this society, dispute resolution is …

Radical Plural Democracy And The Internet, Margaret Chon
Faculty Articles
By examining the consequences that particular social practices on the Internet have in physical space, this essay attempts to re-pivot the democratic discourse of the Internet so as to include Chantal Mouffe's vision of a radical and plural democracy: one that accounts for missing material markers, one that encourages the proliferation of different democratic struggles, one that acknowledges that "[a]ll inequities existing in our society are now at issue."

The Jurisidctional Shadowland Between The Nlrb And The National Mediation Board: Who's In Charge?, Shaunta M. Knibb
Washington Law Review
The National Labor Relations Act exempts all persons subject to the Railway Labor Act (RLA) from its jurisdiction. As a result, for over fifty years the National Labor Relations Board (NLRB) has referred challenges to its jurisdiction based on the RLA to the National Mediation Board, the RLA's administering agency. In 1995, however, the NLRB's decisions in Federal Express Corp. and United Parcel Service, Inc. cast doubt on this policy. Even though the Court of Appeals for the District of Columbia then affirmed the NLRB's decision in United Parcel Service, the question of whether the NLRB has the authority …
