Directing The Development Of A University Centre Of Criminology, John Li. J. Edwards
Dalhousie Law Journal
The original sod out of which the University of Toronto's Centre of Criminology grew was a proposal that I drew up while teaching a course in criminology as part of the LL.B. curriculum in the Faculty of Law at Dalhousie University in 1958-59.1 The proposal reviewed the extent of criminological teaching and research in Canada, and drew particular attention to the lack of implementation of the recommendations of the Fauteux Committee - a committee established in 1956 by the Canadian federal government to study the country's penal system and to make recommendations for change and improvement. 2 In its report, …

The Causation Issue In Workers'compensation Mental Disability Cases: An Analysis, Solutions, And A Perspective, Lawrence Joseph
The Causation Issue In Workers'compensation Mental Disability Cases: An Analysis, Solutions, And A Perspective, Lawrence Joseph
Vanderbilt Law Review
Cases under workers' compensation systems that concern mental disabilities present special problems in the determination of causation. In this Article Mr. Joseph argues that the complexities inherent in a decision whether a mental disability has arisen out of employment force administrative agencies and courts in these cases to engage in normative evaluative inquiries. These inquiries, according to Mr. Joseph, result in findings that potentially frustrate the underlying compromise policy of workers' compensation systems; these evaluative decisions create classes of claimants that may be under or over inclusive. Mr. Joseph describes several possible solutions to this problem and concludes by reviewing …

Free Speech And The Assumption Of Rationality, Frederick Schauer
Free Speech And The Assumption Of Rationality, Frederick Schauer
Vanderbilt Law Review
First amendment doctrine is now both broad and complex, and the task of writing about all of it seems at least forbidding and perhaps impossible. Unthwarted by the magnitude of the mission, however, Franklyn Haiman has attempted, in Speech and Law in a Free Society,7 to survey and to integrate almost every area in which the first amendment restricts or should restrict the powers of the states and the federal government. Haiman's book is in some ways reminiscent of Thomas Emer-son's The System of Freedom of Expression." Like Emerson,Haiman devotes only a relatively brief introductory portion of his book to …
Does Wildlife Have Legal Standing? - The Penguin Case In Patagonia, Pedro Tarak
Does Wildlife Have Legal Standing? - The Penguin Case In Patagonia, Pedro Tarak
Laws and Legislation Collection
The Magellan penguin populations in the Patagonian province of Argentina were recently threatened by a proposed joint Japanese-Argentine venture to exploit them on a massive scale. The firm, Hinode Penguin Argentina, wished to begin slaughtering what it termed "excess" penguins, and to process the dead birds into skins for the world market; the carcasses were to be converted to a protein extract for local consumption.
Upon learning about this venture, Argentine conservation groups mobilized their forces quickly- formulating and implementing media campaigns, soliciting scientific opinions from local and worldwide experts, and concocting legal strategies. The legal tactics alone, although initially …
Some Preliminary Thoughts On Permitting Animals To Sue In Contract And Tort, Henry Cohen
Some Preliminary Thoughts On Permitting Animals To Sue In Contract And Tort, Henry Cohen
Laws and Legislation Collection
Animal protection statutes are of course extremely valuable, and they might be made even more so if they were formulated to give private rights of action to their beneficiaries--the animals themselves. But what I would like to explore here is the idea of extending common law rights of action to animals. Admittedly, permitting animals to sue in contract and tort now seems fanciful, but my hope is that this article will provide an initial step toward bringing it about.
