The Invisible Discourse Of The Law: Reflections On Legal Literacy And General Education, James Boyd White Jan 1983

The Invisible Discourse Of The Law: Reflections On Legal Literacy And General Education, James Boyd White

Book Chapters

The subject of this essay is legal literacy, but to put it that way requires immediate clarification for that phrase has a wide range of possible meanings. At one end of its spectrum of significance, for example, legal literacy means fuU competence in legal discourse, both as reader and as writer. This kind of literacy is the object of a professional education, and it requires not only a period of formal schooling but years of practice as well. Indeed, as with other real languages, the ideal of perfect competence in legal language can never be attained: practitioners are always learning …

Western Scholarship On Chinese Law: Past Accomplishments And Present Challenges, Stanley B. Lubman Jan 1983

Western Scholarship On Chinese Law: Past Accomplishments And Present Challenges, Stanley B. Lubman

Hong Yen Chang Center for Chinese Legal Studies

Chinese law-making in recent years has been nothing less than remarkable and presents a new challenge for research today. The recent adoption of new codes, the revival of formal legal institutions, including courts and the bar, and the reinvigoration of legal education and research all signal the reappearance of an entire field of study.

Although a foundation for study was laid by some scholars in the 1960's, the field later declined, reflecting the low condition to which the Chinese legal system fell, both before and during the disastrous Cultural Revolution. Once again, however, study of the operation of the Chinese …

Cases, Conflict, And Accommodation: Patterns Of Legal Interaction In An American Community, David M. Engel Jan 1983

Cases, Conflict, And Accommodation: Patterns Of Legal Interaction In An American Community, David M. Engel

Journal Articles

This article provides an overview of an empirical study of a civil trial court and the environment of indigenous law and conflict resolution in which the court operates. The article combines an analysis of civil cases and litigants with an investigation of alternative nonjudicial approaches used by residents of the community. The first section of the article examines the emergence of legal conflicts from the fabric of social relationships in the community and compares cases and parties in the court with those that gravitate toward nonjudicial settings. The second section compares processes and outcomes available in the court with those …

My subject today is "legal literacy," but to put it that way requires immediate clarification, for that phrase has a wide range of possible meanings with many of which we shall have nothing to do. Several years ago, a story appeared in The New York Times which provided a graphic illustration of how the Soviet government manipulates the news about itself. Each year on May Day, the Times reported, the Soviet leadership poses for a photograph while standing atop the Lenin tomb in Red Square. In the year of the Times story, however, the photograph had undergone a number of noticeable alterations as it appeared in the various government-run media outlets. One official had been removed altogether, another had been positioned a bit closer to Brezhnev, some who had not in fact been present were …

The Origins Of The Occupational Safety And Health Act Of 1970, Patrick G. Donnelly Oct 1982

The Origins Of The Occupational Safety And Health Act Of 1970, Patrick G. Donnelly

Sociology, Anthropology, and Social Work Faculty Publications

This paper analyzes the emergence of the Occupational Safety and Health Act of 1970 and finds previous explanations of its origin inadequate. I trace the roots of this law to the protests of rank-and-file workers across the United States at a time when the support of these workers was particularly important to the two main political parties. The protest was directed not only at those employers who operated unsafe and unhealthy workplaces, but also at union officials who paid little or no attention to safety and health issues in negotiating new contracts.
