Third World Trade Partnership: Supranational Authority Vs. National Extraterritorial Antitrust--A Plea For "Harmonized" Regionalism, Wolfgang Fikentscher
Michigan Law Review
That "Third World countries" should receive the assistance of the "industrialized nations" in increasing the level of their economic development is a matter beyond dispute. Yet the years following the "economic decade" of the 1970's have made apparent a crisis in the concepts underlying this philosophy of Third World assistance. The nature of this crisis has not yet been fully ascertained, and the following text does not undertake that task. Rather, it starts from the general feeling among experts involved in one way or another with "development aid" that the paths so far followed and the methods so far applied …
Geography And Law, Bernhard Grossfeld
Geography And Law, Bernhard Grossfeld
Michigan Law Review
The central questions of comparative law are still unsolved: Which legal institutions in what legal cultures can be compared with each other in a meaningful way? What can we learn from comparative law for the solution of our own problems?
This Article will discuss the relations between geography and law. I have already discussed the subject of language and law elsewhere; with regard to religion and law, I refer the reader to the extensive writings of Harold Berman.

Eugenics And Family Planning: Exploring The Yin And The Yang, George P. Smith Ii
Eugenics And Family Planning: Exploring The Yin And The Yang, George P. Smith Ii
Scholarly Articles
n order to combat genetic disease, genetic engineering may (and frequently does in fact) rely upon eugenics, the science that deals with the improvement of heredity. Stated simply, a positive eugenics program seeks to develop superior qualities in man through the propagation of his superior genes; with the positive eugenists seeking to produce a 'new breed' with keener and more creative intelligence. Contrariwise, a negative eugenics program attempts only to eliminate genetic weaknesses. When seen in application, positive eugenics programs encourage the fit and 'proper' individuals to reproduce, while negative eugenics programs discourage the less fit and those with inheritable …

The Moral Responsibility Of Law Schools, Terrance Sandalow
The Moral Responsibility Of Law Schools, Terrance Sandalow
Articles
The subject I have been asked to address, the moral responsibility of-law schools, is perplexing, less because answers to the implicit question are uncertain than because the meaning of the question is unclear. Our ideas about moral responsibility have been formed in reference to individuals. They presuppose the existence of distinctively human characteristics such as understanding and will. What, then, can be meant by the moral responsibility of "law schools," institutions that, just because they are not human, necessarily lack these capacities?

Policy-Oriented World Power Process, Julius Stone
Policy-Oriented World Power Process, Julius Stone
UC Law SF International Law Review
This material is a reprint of Chapter 4 of Professor Stone's latest book, Visions of World Order. Between State Power and Human Justice. In this book, Professor Stone analyzes the "factual substratum" out of which international law arises or ought to arise and how this factual substratum is relevant to discussions of international justice and international law itself. In the chapter reprinted here, Professor Stone discusses the work of Professor Myres McDougal. MeDougal, according to Stone, focuses on the policy-oriented approach of national decision-makers participating in the "World Power Process." Because the policy ostensibly being pursued is the furthering of …
