College Sports As A Business: How Name, Image, & Likeness Deals Have Altered The Way Colleges Operate, Jake Alexander Macinnis
Honors Theses and Capstones
The introduction of NIL (Name, Image, and Likeness) rights for student-athletes by the NCAA has significantly altered college athletics, enabling athletes to profit from their personal brands. In this thesis, it examines the multifaceted impacts of thesis changes on student athletes, universities, and the broader collegiate sports ecosystem. Some of the key areas explored include the rise of NIL collectives, the influence of lucrative TV deals on conference realignment, and modifications to the transfer portal. The research highlights the lack of transparency in collective payments, raising concerns about regulation amongst colleges and universities on all levels. This complicates recruitment as …

Product Elimination Decision And Its Impact On Consumers: The Special Case Of A Local Speedway, Mark Mitchell, Jacob Voegel, Michael Smith
Atlantic Marketing Journal
After 60+ years of operation, Myrtle Beach Speedway was closed and the property sold. The new owners will redevelop the property for commercial and residential purposes. Businesses routinely eliminate products for a variety of reasons, including under-performance and/or a desire to redeploy those resources elsewhere. What is often overlooked is the impact on consumers. In addition to reducing fan access to racing, a closed race track removes a racing opportunity for aspiring race car drivers and crew members. It can also mean shuttering tracks that once had historical significance. The history of raceway closures in the Myrtle Beach, SC area …

When Ballots Are Blank: Write-In’S Serving Local Government And The Implications For A Healthy And Vibrant Democracy, Thomas J. Ruter
School of Business Student Theses and Dissertations
Our democracy depends on having a supply of candidates running for elected office, but in some instances, no one wants to run. This phenomenological study asks what the effects on a healthy and vibrant democracy are if ballots are blank and the seat is filled through write-in or appointment. Rooted in democratic theory, this study explores small, rural city elections where write-ins won election. Understudied, local governments are responsible for decisions affecting the lives of millions of people each day. Workforce scarcity, the alienation of young Americans from politics, government bashing, nasty campaigns, threats of physical harm, and other barriers …

Creating The New Normal: A Historical Approach To Understanding Marketing Agility And Its Implications Across Business, Healthcare, And Social Welfare In A Post Pandemic World, Elan Burton, Delancy Bennett, Linda Burton
Atlantic Marketing Journal
The purpose of this article is to expand our understanding of how marketing agility shapes business, healthcare, and social welfare policy and societal responses to global pandemics. We set the stage for this discussion by presenting an historical exemplar case of marketing agility during the 1918 Influenza pandemic in the US. Next, we outline a necessary conceptual revision and update to previous treatments of marketing agility relative to historical pandemics considering the recent COVID-19 pandemic. Our novel conceptualization focuses on a firm’s (business, healthcare, social welfare) prompt response to dynamic and turbulent circumstances beyond the control of the firm (Araújo …

What Corporate Factors Explain Variation In How Individuals Value Dei In The Beauty Industry?, Hannah Bolar
Honors College Theses
The beauty industry is known for its multi-billion dollar market, such as skincare, makeup, and haircare. As an employee in famous beauty stores, Ulta and Sephora, over the last five years, a bigger discussion has been brought to the table, being Diversity, Equity, and Inclusion (DEI) . The scope of my study is to shed light and address what factors beauty industry corporations factor in and how customers view and value DEI in the beauty industry; in which my methods of surveying and focus groups support my claim that internal and external factors do play a role. My results found …

Climate Risk, Insurance Retreat, And State Response, Mark P. Nevitt, Michael Pappas
Faculty Articles
Climate change is fundamentally destabilizing the private insurance industry, with many high-profile insurance companies exiting states in the face of catastrophic, climate-induced risk. This rapid "insurance retreat" represents a major market signal in response to climate-exacerbated risks. Private businesses are making actuarial decisions, assessing that some locations are just too vulnerable to insure. At the same time, this insurance retreat also poses a policy challenge for states as they react to the mounting insurance gaps left by exiting private insurers.
This Article analyzes insurance retreat, its attendant policy challenges, and the lessons that can be drawn from state responses. It …

Criminal Recordkeeping, Andrew K. Jennings
Faculty Articles
Business managers must create and keep records for decision-making. Yet doing so presents an obvious problem for those who manage illegal businesses: their records would make for powerful evidence in the hands of prosecutors. That problem raises a question—why would one knowingly create and keep such records when their mere existence risks detection and sanction? The answer, in short, is that the interaction of illicit activity’s complexity and continuity compels recordkeeping. A business, including a criminal one, cannot be managed without adequate information about its operations, obligations, and condition. Just how complex and long-lived its affairs are will drive the …

Human Capital Disclosure & Corporate Governance: The New Evidence, George S. Georgiev
Faculty Articles
This Article explores the evolution of human capital disclosure—firm-supplied information about various workforce-related matters—as a factor in contemporary corporate governance. Regulatory and nonregulatory developments from recent years have upended longstanding practices and generated extensive new evidence. Most notably, the Securities and Exchange Commission (SEC) adopted a human capital management (“HCM”) disclosure mandate in 2020, which, though long overdue, was criticized from the outset for its modest scope and lax design. In the meantime, courts have taken a renewed interest in board of directors’ oversight responsibilities in a number of areas, including HCM, while labor’s power has unexpectedly increased in some …

Examining The Antecedents Of Return Policy Leniency In Ecommerce, E. Mitchell Church, Richelle Oakley Dasouza, Olajumoke A. Awe
Management and Decision Sciences
As eCommerce has become widespread, the challenge of successfully navigating the returns process has grown perilous. The product returns issue is even more difficult for microenterprises that sell unique or custom products with fewer resources. The authors examined the impact of the antecedents of return policy leniency, specifically economic and social success factors. Using a web crawler over a 24-week period, the authors collected and analyzed data for a sample of 781 shops from Etsy, an eCommerce platform. Results indicate that the well-studied factor of sales, in addition to a new social factor – community dialogue – impacts an Etsy …

Why Do Banks Fail Together? Evidence From Executive Compensation, Deniz Anginer, Jinjing Liu, Cindy A. Schipani, H. Nejat Seyhun
Fordham Journal of Corporate & Financial Law
Recent bank failures have elicited extensive interest about the causes, focusing on incompetence of bank executives, policymakers, bank regulators and supervisors and even uninsured depositors. Yet, before we can prescribe solutions to bank failures, we need to identify the correct causes of the underlying problems. We argue that the problem is not so much with incompetence of executives, depositors, or regulators per se, but rather with managerial incentives.
We provide both a conceptual basis as well as empirical evidence to show that bank executives have incentives to increase systemic risks in order to maximize the benefits of bank bailouts. Consequently, …

A consistent takeaway from research conducted on effective learning and working environments is that communication is key. In remote work and learning environments, communication comes from many different platforms, can be asynchronous and synchronous, and requires specific techniques, trust, and technology to be effective. Every salient point from the Remote work revolution: Succeeding from anywhere (Neeley, 2021), comes down to one central concept: communication. Technology and engineering educators will find the foundational concepts of this book pivotal to help guide remote education, especially in laboratory settings; potentially increasing the reach of their programs.

Midwest Midlevel Professionals' Perspective On Their Entry-Level Experience: Supervisor Leadership And Its Effect On Employee Retention, Joseph Thomas
Theses and Dissertations
For the past three decades, new professionals have been leaving the student affairs field at alarming rates, with around 50% departing within five years of completing their master’s degrees. While numerous studies have explored the reasons behind this exodus, few have examined why the other 50% remain. Moreover, limited research has investigated how servant leadership impacts the retention of these professionals. This basic interpretive qualitative study aimed to understand how leadership’s focus on employee needs influences retention, using the lived experiences of eight mid-level student affairs professionals from large public institutions in the Midwest, each 5-7 years post-master’s degree. Thematic …

Minutes Are Worth The Minutes: Good Documentation Practices Improve Board Deliberations And Reduce Regulatory And Litigation Risk, Given As The 21st Annual Destefano Lecture, Leo E. Strine Jr.
Fordham Journal of Corporate & Financial Law
This Essay, originally the basis for the 21st Annual Albert A. DeStefano Lecture on Corporate, Securities & Financial Law given on February 27, 2024, at Fordham University School of Law, addresses the importance of good corporate minuting and board documentation practices. Using lessons from Delaware cases where the quality of these practices has determined the outcome of motions and cases, this Essay identifies effective and efficient practices to better address this decidedly not sexy, but unquestionably essential, corporate governance task. The recent Delaware cases underscore the importance of quality and timely documentation of board decision-making, the material benefits of doing …

Corporate Esg Falls Short: Systemic Anti-Black Racism And Inequality Should Be Addressed Through A Cumulative Integrated Approach, Ferrell L. Littlejohn
Fordham Journal of Corporate & Financial Law
In the 1896 case Plessy v. Ferguson, the Supreme Court endorsed the “separate but equal” doctrine, essentially codifying racial segregation. This decision guaranteed that systemic racism would permeate every fabric of society despite the abolition of slavery. Recently, many corporate institutions have pledged to actively support the fight against systemic racism through their environmental, social, and governance (“ESG”) initiatives. Corporate stakeholders have actively advocated for these initiatives, particularly in response to recent scholarship revealing the significant involvement of capitalist institutions in historical slavery, and the continued perpetuation of anti-Black racism. Nevertheless, such initiatives, for example, internal diversity, equity, and …

My first chapter shows that disruptions in derivative markets can propagate to corporate bond markets via mutual funds that hold both fixed-income securities and derivatives. The transmission arises because when fund managers incur losses in their derivative investments, they are obligated to deliver cash payments to counterparties or provide additional cash collateral to meet margin calls. Using the Covid-19 crisis as an adverse shock on derivative investments bond funds made in 2019 Q4, I find that funds with substantial exposure to derivative market disruptions liquidate fixed-income assets to fulfill corresponding payment obligations. The forced liquidations cause sizable price depressions in …
