Criminalizing Pregnancy: An Analysis Of The War On Drugs And The Fetal Rights Movement, Sheryl R. Fett

The focus of study was the war on drugs and the fetal rights movement as they relate to the criminalization of pregnancy. There was a movement in the 1980s and early 1990s to prosecute pregnant women for prenatal drug use under child abuse statutes and/or drug delivery statutes.

A social constructionist framework was used to analyze this movement. This thesis utilized a qualitative case study relying on documentary analysis. Literature on the war of drugs and the fetal rights movement was analyzed as it related to the prosecutions of pregnant drug users and the subsequent criminalization of pregnancy.

On October 1, 1988, the Michigan Juvenile Waiver Package took effect in Michigan. One of the results of this was the implementation of prosecutorial waiver method in Michigan. Whereas previously juveniles could only be waived and tried in the adult court via a judicial waiver, now it was possible for the prosecutor to waive juveniles aged 15 or 16 if charged with one or more of seven specified Class 1A felonies. Data were collected for all youth subject to prosecutorial waiver in Wayne County over a five year period, from October 1, 1988 through October 1, 1993. Data included: date …

Housing strategies designed to create a sense of community for our nation's at-risk and poverty-stricken citizens continue to be a source of debate. One major issue is the degree to which criminal behavior exists within these environments. In this article, the results from a seven year study of one single room occupancy (SRO) facility in Pittsburgh, Pennsylvania are described. Analysis of two models used for intervening with the vulnerable tenant population of the SRO suggest that a "strengthfocused" strategy rather than a "need- focused" approach may be more effective in reducing crime and may contribute to the establishment of a …

Subsequent to the passage of the Community Mental Health Act in 1963, the "Total Institutions" described by Goffman have for the most part disappeared. Nonetheless, many writers charge that social control is still the primary function of mental health programs, even those that are identified as community-based. The new methods of control have not received widespread attention. In community-based programs control is operationalized in the form of "symbolic violence." This paper examines the various factors that contribute to this style of violence.

Research has directed little attention toward understanding and dealing with the adolescent sexual offender. In an effort to understand what makes adolescent sexual offenders different from other delinquents. I will examine the victimization experiences (sexual abuse and physical abuse) and the family dynamics (family violence, family incarceration and family structure) of both adolescent sexual offenders and nonsexual offenders. In this research, I examined the similarities and differences between black and white female delinquents. A secondary analysis of the Survey of Youth in Custody, 1987 data was utilized to answer the following research questions: (1) What factors contribute to each group's delinquency the most? (2) Are the factors that contribute to black girls' delinquency significantly different from those factors that contribute to white girls' delinquency? This article describes the Sheriff's Department correctional education programs at the Suffolk County House of Correction and Jail. It points out the tremendous need for educational services given that more than 60 percent of those incarcerated in these institutions are high school drop-outs, and a much higher percentage are functionally illiterate. Because 95 percent of those incarcerated at this facility will return to their communities within three years, educating prisoners serves as a constructive and cost-effective means of preventing recidivism and an effective investment in public safety. This article considers the role of the district attorney as a catalyst for aggressive school-based educational programs to help young people avoid trouble with the legal system. Walsh argues that while it may be unfair to burden classroom teachers with additional responsibilities concerning drug and alcohol issues, school is the logical site at which to provide these services and that a district attorney is well suited to act as a catalyst and resource for providing these additional services.

This study delves into this neglected area of sociological inquiry by addressing definitional, legal, empirical, and theoretical dimensions of the phenomenon of governmental crime. The four research objectives are to:

1. Demonstrate that socially deleterious governmental actions can be studied criminologically through the epistemological framework of international law.

2. Document the existence of such governmental crimes in the area of nuclear weapons.

3. Describe and compare the patterns of the United States' violations of international laws during the Korean and Vietnam wars.

Investigating The Age Effects Of Family Structure On Adolescent Marijuana Use, John P. Hoffmann

This study examines differences among older and younger adolescents in the influence of family structure, family relations, and peer relations on marijuana use. Data from a longitudinal sample of adolescents from the United States were stratified by age and used to assess these potential differences. Precise measures of family structure were constructed to account for the various manifestations of family forms. Multivariate analyses indicate that a recent divorce attenuates attachment among younger adolescents and leads to less family involvement among older adolescents. Moreover, older adolescents from stepparent families are less attached to their families. Changes in these family relationship variables …

What is the role of the occurrence of harm or evil in criminal law? What should it be? Answers to these questions commonly use the distinction between what is called an objective and a subjective view of criminality. To oversimplify, the objective view maintains that the occurrence of the harm or evil defined by the offense is highly relevant. The subjectivist view maintains that such harm or evil is irrelevant; only the actor's culpable state of mind regarding the occurrence of the harm or evil is important. The criminal law has three primary functions. First, it must define and announce the conduct that is prohibited (or required) by the criminal law. Such rules of conduct, as they have been called, provide ex ante direction to members of the community as to the conduct that must be avoided (or that must be performed) upon pain of criminal sanction. This may be termed the rule articulation function of the doctrine. When a violation of the rules of conduct occurs, the criminal law takes on a different role. After planning the effort for twenty years, the American Law Institute spent ten years debating and drafting a model criminal code. Twenty-eight drafters and forty-two advisors produced thirteen reports that were debated at eight annual meetings. Twenty years later, seven reporters with twenty-five advisors completed six volumes of official commentaries. This monumental drafting effort served as only the starting point for nearly two-thirds of the states that have recodified their criminal codes since the Model Penal Code was promulgated in 1962.
