This article investigates an anomalous legal ethics rule, and in the process exposes how current equal protection doctrine distorts civil rights regulation. When in 2016 the ABA Model Rules of Professional Conduct finally adopted its first ever rule forbidding discrimination in the practice of law, the rule carried a strange exemption: it does not apply to lawyers’ acceptance or rejection of clients. The exemption for client selection seems wrong. It contradicts the common understanding that in the U.S. today businesses may not refuse service on discriminatory grounds. It sends a message that lawyers enjoy a professional prerogative to discriminate against …

The unevenly distributed pain and suffering from the COVID-19 pandemic present a remarkable case study. Considering why the coronavirus has devastated some groups more than others offers a concrete example of abstract concepts like “structural discrimination” and “institutional racism,” an example measured in lives lost, families shattered, and unremitting anxiety. This essay highlights the experiences of Black people and disabled people, and how societal choices have caused them to experience the brunt of the pandemic. It focuses on prisons and nursing homes—institutions that emerged as COVID-19 hotspots –and on the Medicaid program.

Recruitment of Students of Color (African American and Latino) is a growing obligation of colleges and universities around the United States (Bauman et al., 2019). Personally, the culmination of my passion for diversity recruitment and my experiences with information technology has led me to study why Students of Color encounter barriers during their online college application process. A vicious cycle of seeing Students of Color students not being able to access key resources during their college application process has frequently left me heartbroken. There are an abundance of excuses and I want to be a part of the solution.

The United States is losing its position as an innovative global leader because of a shortage of skilled workers in STEM. This decline is due in part to the US producing a lower number of graduates from STEM related fields. One reason for the shortage is that US students are selecting or graduating with STEM majors at a lower rate than those of competing countries. As a result of these shortages, the US has undertaken several initiatives to increase public awareness of and training in STEM that will ultimately produce STEM degrees.

Strategies to recruit and hire faculty and staff of color to the Commonwealth of Kentucky’s population levels have continued for 57 years. From Title VI of the Civil Rights Act of 1964 to the Kentucky Plan in 1982 to the Strategic Plan for Kentucky Higher Education from 1982 to 1995, to the Kentucky Council on Postsecondary Education’s 2010-2015 Policy and Framework for Institution Diversity Plan to its current 2016-2021 Diversity, Equity, and Inclusion Policy. In today’s society, the teaching workforce should be more diverse. However, it still consists of majority white females. From a survey reported by Education Week in 2017-2018, the teaching workforce consisted of 79.2% white teachers. The same data reported that the teaching workforce consists of 7% African-Americans (Will, 2020). From that 7% of African-Americans, African-American males consists of 2% of the teaching workforce (Bell, 2017). Some school districts are seeking to attract more minority teachers to reflect their student demographics. A major legacy of the Obama presidency was the mark he left on the federal courts with respect to increasing judicial diversity. In particular, President Obama’s appointments of women to the federal judiciary exceeded all previous presidents in terms of both absolute numbers and as a share of all judges; he also appointed a record-setting number of women of color to the lower federal courts. This thesis investigates the unique interactions between pregnancy, substance involvement, and race as they relate to the War on Drugs and the hyper-incarceration of women. Using ordinary least square regression analyses and data from the Bureau of Justice Statistics’ 2016 Survey of Prison Inmates, I examine if (and how) pregnancy status, drug use, race, and their interactions influence two length of incarceration outcomes: sentence length and amount of time spent in jail between arrest and imprisonment. The results collectively indicate that pregnancy decreases length of incarceration outcomes for those offenders who are not substance-involved but not evenhandedly -- benefitting white …

Indigenous peoples living on Turtle Island, or what is now known as North America, are under constant threat of both erasure and domination. This study explores the intersecting concepts of Indigenous identity and sovereignty through the perspectives of Indigenous interviewees in the Northeast region of the continent as they navigate settler-colonial society and practice anticolonial resistance. It reveals the ways in which colonizing forces reappropriate and redefine the meanings of indigeneity and sovereignty in order to control Indigenous peoples and inhibit their ability to live self-sustainably. Many promising advances in precision health and other Big Data research rely on large data sets to analyze correlations among genetic variants, behavior, environment, and outcomes to improve population health. But these data sets are generally populated with demographically homogeneous cohorts. We conducted a retrospective cohort study of patients at a major academic medical center during 2012–19 to explore how recruitment and enrollment approaches affected the demographic diversity of participants in its research biospecimen and data bank. Invested in the workings of power - but with particular intersectional attentiveness to race - Critical Intellectual Property works to imagine new, often more socially just, forms of knowledge produce. Latinx members of the FFA Organization are disproportionately underrepresented in leadership positions. When they do get elected to leadership offices, they oftentimes have to accept behaviors that erase their cultural identity. This study aims to find what aspects of their identity they feel they have to give up in order to be seen as a potential state or national FFA candidate. Findings include the participation of the state-officer game, joining cliques that fit the white mold, and overall, assimilation on an individual and group scale. Womanism is a term curated by Alice Walker (2004) that centers Black women’s lived experiences, past and present, encouraging Black women to no longer look to others for their liberation (Floyd-Thomas, 2006). Soul 2 Soul Sister’s Facing Racism program is facilitated by Womanist instructors, who work with groups of mostly white people to address anti-Black racism. This qualitative study explored the experiences of white participants who took part in this program, Facing Racism, which holds Womanism as its central guiding principle. As algorithmic media amplify longstanding social oppression, they also seek to colonize every last bit of sociality where that oppression could be resisted. Swipe apps constitute prototypical examples of this dynamic. By employing protocols that foster absent-minded engagement, they allow unconscious racial preferences to be expressed without troubling users’ perceptions of themselves as non-racist. These preferences are then measured by recommender systems that treat “attractiveness” as a zero-sum game, allocate affective flows according to the winners and losers of those games, and ultimately amplify the salience of race as a factor of success for finding intimacy. Asian American transracial adoptees are an underserved and underrepresented population in America, specifically on college campuses. The purpose of this study was to gain an in-depth understanding of experiences lived by individuals in this group, focusing on their time in college. Through qualitative interviews, this research captured the feelings, opinions, and experiences of select individuals within this group. Two semi-structured interviews were conducted with six separate participants via video chat. Our national reckoning with race and inequality must include disability. Race and disability have a complicated but interconnected history. Yet discussions of our most salient socio-political issues such as police violence, prison abolition, healthcare, poverty, and education continue to treat race and disability as distinct, largely biologically based distinctions justifying differential treatment in law and policy. This approach has ignored the ways in which states have relied on disability as a tool of subordination, leading to the invisibility of disabled people of color in civil rights movements and an incomplete theoretical and remedial framework for contemporary justice initiatives.
