A Study Of Ohio's Correctional Institution Inspection Committee's (Ciic) Inmate Surveys, Melissa W. Burek, John Liederbach, Joelle K. Bridges

Correctional facilities have a discernible "social climate," or collection of contextual properties that derive from perceptions of both staff and prisoners. These properties include the physical, organizational, social, and emotional characteristics of correctional institutions. Ohio's Correctional Institution Inspection Committee (CIIC) requested research assistance to assess the validity of their adult and youth surveys, which are administered during the CIIC's regular inspections of facilities. The purpose of this study was to assess the validity of these instruments and the process by which they are administered. The study builds on the existing line of research on prison social climate surveys.

The Nonexceptionalism Thesis: How Post-9/11 Criminal Justice Measures Fit In Broader Criminal Justice, Francesca Laguardia

Contrary to the assumption that ‘‘9/11 changed everything,’’ post-2001 criminal justice practices in the area of terrorism show a surprising consistency with pre-2001 criminal justice practices. This article relies on an analysis of over 300 terrorism prosecutions between 2001 and 2010, as well as twenty full trial transcripts, content-coding, and traditional legal analysis, to show the continuity of criminal justice over this time in regard to some of the most controversial supposed developments. This continuity belies the common assumption that current extreme policies and limitations on the due process are a panicked response to the terror attacks of 2001. On …

The Civil Rights Act of 1871 (codified at 42 U.S.C. §1983 and commonly referred to as Section 1983) provides a civil remedy for aggrieved persons to sue state actors who under the color of law violate federally protected rights. Since the 1960s there has been an explosion of Section 1983 litigation in the federal courts against police officers and their employing municipal and county agencies. Due to a lack of official statistics and poor methodologies, research has yet to determine how common Section 1983 actions are against the police nationwide. This study explores a series of events that occurred in the spring of 1876. The relationship between the Indianapolis city government, the Marion County Courts, the Indianapolis Police Department, and the African American community came together to usher in changes never before envisioned. The Indianapolis Police Department (IPD) was formed in 1855, then disbanded 12 months later in a political dispute. From 1857-to-1876, the IPD was all white. These changes took place as the Reconstruction era was coming to a close. The first Ku Klux Klan was at its apex, terrorizing black communities, and Jim Crow was coming into its …

This is a chapter from the new book The Vigilante Echo. Previous chapters have made clear that some vigilantism can be morally justified where the government has failed in its promise under the social contract to protect and to do justice. But this chapter explains how even moral vigilante action can be problematic for the larger society. Vigilantes may try to do the right thing but are likely to lack the training and professional neutrality of police. They may be successful, but only on pushing the crime problem to an adjacent neighborhood. Because their open lawbreaking may seem admirable …

Over the last several decades, nearly all of the states have formed task forces to look at the perception of a gender bias within the family court systems as they pertain to child custody. This self-scrutiny has included the attitudes of judges and attorneys within the system and the need of reform of our family courts. This research focused on replicating a study conducted by Dotterweich and McKinney that was completed in 2000 that compiled statistics from four different state task forces in Maryland, Missouri, Texas, and Washington. This research explores different representations of youth crime in Canada from a feminist criminological and social constructionist perspective. Using a mixed-methods approach that draws upon historical scholarly works, official governmental crime and court statistics, and national Canadian newspapers, I investigate statistical and media representations of youth crime in Canada.
Official crime and court statistics were analyzed to identify trends in youth crime and how they vary by gender and legislative changes. I provide an historical overview of changing definitions of youth, crime and delinquency, and consider how these combined with changing norms regarding morality to shape youth crime legislation in …

There are no comprehensive statistics available on problems with police integrity, and no government entity collects data on all criminal arrests of law enforcement officers in the United States. Police crimes are those crimes committed by sworn law enforcement officers with the general powers of arrest. These crimes can occur while the officer is either on- or off-duty and include offenses committed by officers employed by state and local law enforcement agencies. This study provides a wealth of data on a phenomena that relates directly to police integrity— data that previously did not exist in any usable format. The first …

Legislators have been responding to the growing push to treat youth in the sex industry as victims of a crime instead of perpetrators. Recent legislative changes have occurred in every state and nationally as part of anti-trafficking legislation, not prostitution law directly. While the content of these laws has been studied, its outcomes for youth have not. This study uses a cross-sectional time-series model to test the impact that changes to state trafficking law has had on juvenile prostitution arrest rates. Findings support the hypothesis that legislation passed with a juvenile protection component decreases the juvenile prostitution arrest rate. It …

Using a mixed methods approach, this study examines whether: (1) courtroom actors (i.e., presence of legal counsel, translator, victim advocate, or informal support person; and presiding judge), (2) case aspects (i.e., abuse mentioned, type of abuse mentioned; weapon mentioned; children mentioned; and session time), and (3) individual characteristics (i.e., presence of applicant and/or adverse party; and race and gender of applicant and adverse party) influence an applicant’s likelihood of being granted a civil protective order and the length of time it is granted for. Problem analysis conducted by a university-based research partner can provide communities with data-driven options to address the local drivers of serious youth and gang violence. Situated in Worcester, Massachusetts, this article describes how after early childhood trauma was identified as a potential driver of adolescent and young adult violence, problem analysis using local data confirmed that being the victim or witness of a traumatic incident before the age of 12 was significantly correlated with involvement in violence in adolescence or young adulthood. Although parental incarceration is both a maternal and paternal issue, it is particularly detrimental to the family when the mother is incarcerated. The number of children with a mother in prison has more than doubled since 1991 (Glaze & Maruschak, 2008). Although there are more children of incarcerated fathers than mothers, it is particularly important to note that sixty-four percent of mothers were the primary caregivers to their children at their time of arrest (Glaze & Maruschak, 2008; Mumola, 2000). As the number of wrongful convictions and exonerations of individuals imprisoned for crimes they did not commit has increased dramatically, the study of wrongful conviction has become increasingly important. The majority of past research has focused on the various causes of wrongful convictions. However, very little attention is given in detail to the specific nature of each of these causes. This thesis examined the most current, inclusive database of exonerations in the United States that exists, the National Registry of Exonerations. Despite gains in the percentage of female police officers over past decades, female police officers are vastly underrepresented in modern policing. Female police officers face barriers to integration into policing and the surrounding culture that male police officers do not face, including unbalanced physical testing, double standards for success, and others. One explanation for the different experiences of female police officers compared to male police officers is the token status of women in policing.
