This article examines one of the most important trends in international legal governance since the end of the Cold War: the rise of “soft law,” or legally non-binding instruments that are given legal effect through domestic law or internationally binding agreements such as treaties. Scholars studying the design of international agreements have long puzzled over why states use soft law. The decision to make an agreement or obligation legally binding is within the control of the states negotiating the content of the legal obligations. Nigeria’s abundant wealth is sufficient to make it one of the effective states in the African continent. However, the excess resources, like the sugar in the blood stream of a diabetic patient, serve no positive purpose for the teeming population. Poverty and hunger are the principal characters of the Nigerian state with attenuated crises affecting the socio-economic well - being of the people. While Nigeria ranks among the highest producers of crude oil in the world market, it also leads in the classification of countries in distress. Constitution-making is a ubiquitous but poorly understood phenomenon. There is much speculation but relatively little evidence about the impact of different design processes on constitutional outcomes. Much of the debate reduces to the question of who is involved in the process and when. We consider two central issues in this regard. The first is the problem of institutional self-dealing, or whether governmental organs that have something to gain from the constitutional outcome should be involved in the process. The second has to do with the merits of public involvement in the process. Both of these concerns have clear normative implications …
