The New Environmental Law: Forest Certification, Errol E. Meidinger

This paper argues that the rapidly expanding practice of forest certification, together with similar developments in other sectors, is creating a new template for environmental law. Nongovernmental organizations and some industry actors are establishing binding regulatory standards, systems for monitoring compliance, sanctions for non-compliance, and, when things work well, methods for assessment and revision. It locates these developments as a part of “phase 3” of environmental law, which also involves a proliferation of other initiatives beyond traditional regulation. Finally, it offers a preliminary discussion of the efficacy, adaptability, coherence, and legitimacy of the emergent system.

The weight of much expert forest management opinion is that issues such as climate change can be effectively addressed only if forest policy-making moves from a purely sectoral focus and undergoes a shift to a more integrated multi-issue, multi-sector policy-making process. This is because credible adaptation policies in the sector require greatly enhanced multi-sectoral policy integration if they are to succeed. But this requirement may be beyond the capacity of many countries to deliver. A major problem in post-fire restoration of semi-arid shrublands dominated by annual bromes is the presence of carryover seed banks that cannot be controlled using conventional methods. These seeds can provide significant competition for seeded species in the years following treatment. We investigated the feasibility of using a naturally occurring seed pathogen, the ascomycete Pyrenophora semeniperda, as a biocontrol organism for eliminating this carryover seed bank. We carried out the necessary technology development to create and apply field inoculum to cheatgrass- or red brome-infested areas (both burned and unburned) at six sites located in three states across two years of …

While the use of timber harvests is generally accepted as an effective approach to controlling bark beetles during outbreaks, in reality there has been a dearth of monitoring to assess outcomes, and failures are often not reported. Additionally, few studies have focused on how these treatments affect forest structure and function over the long term, or our forests’ ability to adapt to climate change. The capacity to estimate value of a stand by modelling trees and simulating conversion along the whole value chain offers the potential to maximise efficiency, by enabling virtual trials of different production, processing and utilisation scenarios. Wildfire can result in significant loss of property and lives. Evidence shows that residents can decrease the risk of loss when they stay to defend their property. In order to safely defend a property, residents need to be adequately prepared for the wildfire conditions they face. Residents who wish to evacuate prior to the arrival of a wildfire also need to prepare their property and themselves for such an action. Clearcutting is a common harvesting practice in many eastern hardwood forests. Among the vegetation strata of these forests, the herbaceous layer is potentially the most sensitive in its response to harvest-mediated disturbances and has the highest species diversity. Thus, it is important to understand the response of herbaceous layer diversity to forest harvesting. Previous work on clearcut and mature stands at the Fernow Experimental Forest (FEF), West Virginia, has shown that, although, harvesting did not alter appreciably herbaceous layer cover, it influenced the relationship of cover to biotic and abiotic factors, such as tree density and soil nutrients, respectively. Nonpoint source (NPS) pollution is one of the leading causes of water quality problems in the United States. Bioretention has become one of the more frequently used stormwater management practices for addressing NPS pollution in urbanized watersheds in New England. Yet despite increased acceptance, bioretention is not widely practiced. This study explores and evaluates the efficacy of bioretention for protecting urban water quality. This studio was based on the Fairmount Greenway that was developed through a series of public meetings with the neighborhood community and with consultants from the firm Crosby, Schlessinger and Smallridge (CSS). The Fairmount Greenway, while drawing its identity from the traditional greenway model is in fact a reinterpretation of an urban greenway. The greenway path follows along both primary and secondary city streets because of the lack of space along the rail right-of-way. The Fairmount Greenway begins at what will be a new station stop at New Market South Bay near Upham’s Corner in northern Dorchester. The greenway follows …

The spatial distribution of banks in any geographic entity determines the level of accessibility to its services by the public. This study examined the pattern of banks distribution in Ilorin metropolis. Field survey was employed in determining the number of available commercial banks and their respective distances between each other. The spatial analysis technique such as the nearest neighbour analysis as used ascertain the degree of clustering, density and the average distance taken to access these services. An annual trade deficit in Australia for forest products of approximately $2 billion (Aus$), predominantly in paper, pulp products and sawn timber, makes sound argument for continued support of plantation forestry expansion. Existing government policy promoting afforestation through fiscal tax-based incentives for Managed Investment Scheme (MIS) retail forestry however, has raised many questions regarding the need for performance targets and accountability criteria in response to the collapse of several private plantation companies during the global financial crisis of 2009 and 2010 that had been responsible for managing a large sector of the national estate. Rapid land-use change arising from incentives for afforestation has created tensions in rural communities previously dominated by agricultural enterprises. This paper reports on an innovative experiment with social learning that incorporated participatory modelling to resolve community concerns in a case study of plantation forestry in the Upper Clarence catchment of north-eastern NSW Australia. The development of a diagnostic framework helped identify socioeconomic and environmental issues within the community for investigation by a self-selected participatory advisory committee (PAC) representing a diversity of views. In this article, we analyze whether the Softwood Lumber Agreement between the United States and Canada imposed significant economic costs on industries that use softwood lumber in the United States. To ascertain this impact, we use an event study. Our event study analyzes variations in the stock prices of lumber-using firms listed at the major stock markets in the United States. We find that the news of events leading to the Softwood Lumber Agreement had significant negative impacts on the stock prices of industries using softwood lumber.
