The Global Land Rush: Markets, Rights, And The Politics Of Food, Smita Narula
The Global Land Rush: Markets, Rights, And The Politics Of Food, Smita Narula
Elisabeth Haub School of Law Faculty Publications
In the past five years, interest in purchasing and leasing agricultural land in developing countries has skyrocketed. This trend, which was facilitated by the 2008 food crisis, is led by state and private investors, both domestic and foreign. Investors are responding to a variety of global forces: Some are securing their own food supply, while others are capitalizing on land as an increasingly promising source of financial returns. Proponents argue that these investments can support economic development in host states while boosting global food production. But critics charge that these “land grabs” disregard land users' rights and further marginalize already …

Zootecnia
Rural Crowdfunding, Andrew A. Schwartz
Rural Crowdfunding, Andrew A. Schwartz

One reason that economic development in rural America lags behind its urban counterpart is the persistent lack of venture capital for rural entrepreneurs. Geography deserves much of the blame, as angel investors and venture capitalists tend to live and work in metropolitan areas on the coasts, in places like Silicon Valley and Boston. Many rural areas are literally thousands of miles away, with the result that venture capital has rarely found its way to rural regions.
Recent federal legislation, however, has the potential to change this dynamic. The JOBS Act authorizes the sale of securities over the Internet to large …
From “Food Miles” To “Moneyball”: How We Should Be Thinking About Food And Climate, Bret C. Birdsong
From “Food Miles” To “Moneyball”: How We Should Be Thinking About Food And Climate, Bret C. Birdsong
Scholarly Works
Since Michael Pollan popularized the push to eat local food in his bestseller, The Omnivore’s Dilemma, the concept of “food miles” has been something of a rallying cry and an organizing principle in the marketing of the local food movement. Among locavores and their sympathizers, the term seems to encapsulate all that is wrong with the food system. Fresh grapes from Chile make their way to supermarkets from Maine to Minnesota, and even California. Major food conglomerates process commodity ingredients like corn, soy, and wheat into packaged food that travels across the country and across oceans before landing on …
Empowering Market Regulation Of Agricultural Animal Welfare Through Product Labeling, Sean P. Sullivan
Empowering Market Regulation Of Agricultural Animal Welfare Through Product Labeling, Sean P. Sullivan
Animal Law Review
In many Western nations, rising public concern about the welfare of agricultural animals is reflected in the adoption of direct regulatory standards governing the treatment of these animals. The United States has taken a different path, tending to rely on a “market-regulation” approach whereby consumers express their desire for specific welfare practices through their purchasing decisions. This Article explores the failure of market regulation and the welfare-preference paradox posed by consumers who express a strong preference for improved animal welfare in theory, but who simultaneously fail to demand heightened welfare standards in practice. It argues that market regulation is failing …

Environment, Ethics, And The Factory Farm, David N. Cassuto
Elisabeth Haub School of Law Faculty Publications
Transcript of Symposium: Ethical Implications of the Commercial Use of Animals.
What are the ethics behind factory farming? What are the ethical implications? Specifically, I'd like to focus on the environmental implications. But I define environmental implications a little differently than a lot of folks because I teach animal law.

Does Regulation Chill Democratic Deliberation? The Case Of Gmos, Alison Peck
Does Regulation Chill Democratic Deliberation? The Case Of Gmos, Alison Peck
Law Faculty Scholarship
Breakthroughs in science and technology pose a challenge to the U.S. legal system: either regulate under pre-existing laws using a business-as-usual approach, or pass new laws to deal with new relationships and conflicts created by these breakthroughs. How does the legal process determine when to regulate and when to legislate? Does that process adequately ensure deliberative democratic debate and implementation of democratic consensus? Does it adequately protect urgent interests in the meantime? Currently, this determination is ongoing with regard to new scientific developments such as climate change science, and new technological developments such as hydraulic fracturing of unconventional natural gas …

European Decisions About The 'Whack-A-Mole' Game, Drew L. Kershen
European Decisions About The 'Whack-A-Mole' Game, Drew L. Kershen
Drew L. Kershen
This article reports on several court decisions in Europe that illustrate the seemingly unending delays and barriers, within the EU structure, for genetically-engineered crops. Like the fun-park children’s game—wherein each time the player whacks a mole, another mole instantly pops to the surface so that the player must whack again—each time a producer of a GE crop appears to have approval for planting, another delay and barrier arises.

The European Commission Proposal to Simplify, Rationalise and Standardise Food Controls: Towards a New Concept of “Food Law” in the EU? There is no doubt that ensuring a high level of health for humans is a leading objective of the European Union (EU): This was set by the Treaty, has been declared unequivocally by the Community legislator and has been repeatedly confirmed by the Court of Justice of the EU (CJEU).
