What's In A Name?: Geographical Indicators, Legal Protection, And The Vulnerability Of Zinfandel, Stephen M. Jurca

Indiana Journal of Global Legal Studies

This note explores the issues countries face when one party allegedly takes unfair economic advantage of foreign competitors in an increasingly global market by broadly interpreting international product labeling laws in its favor. The United States' widespread use of the term "champagne" in its domestic sparkling wine industry is just one example of how "genericide"-the process by which a popular brand name becomes so commonly used that the term is no longer protected by intellectual property law-negatively affects trade relations and hampers economic growth. This note focuses on the dangers of genericide in the marketplace, most specifically, the international wine …

International Deployment Of Microbial Pest Control Agents: Falling Between The Cracks Of The Convention On Biological Diversity And The Cartagena Biosafety Protocol?, Guy R. Knudsen

Pace Environmental Law Review

This paper considers one tangled web of conflicting developments. It involves the popular desire to replace chemical pesticides with more “natural” biological control strategies, plus a slowly emerging awareness of a less benign side to microbial pest control agents, based on their potential invasiveness and sometimes striking similarities to agents of bioterrorism and biological warfare. This desire, however, is overshadowed by concerns about the environmental release of genetically engineered organisms. I argue that as some of the concerns about ecological diversity, as captured by the Convention on Biodiversity, were channeled into the subsequent Cartagena Protocol on Biosafety to the Convention …

Animal Farm Reality: The First Amendment Struggle To Reveal The Frightening Truth Behind Industrial Farm Animal Production, Melanie M. Ghaw

Buffalo Environmental Law Journal

It began with the recall of cantaloupes and led to three additional recalls of produce in the following weeks.2Although the produce originatedfr om a single farm in Colorado, the harmful effects of the outbreak spanned 18 states, reaching as far as Alaska. Currently 29 people have died and 72 others were infected.3

Produce contaminated with animal waste caused this deadly traged.' Listeria outbreaks are becoming more common, coinciding 1with the increase of Industrial Farm Animal Production (IFAP), and many believe IFAP facilities are to blame …
