Second Chances: Bill C-72 And The Charter, Isabel Grant

For decades, Canadian courts grappled with the issue of whether intoxication should mitigate criminal responsibility. During that time, Parliament avoided dealing with this controversial issue, preferring to leave it in the hands of judges. This paper examines the legislative response to the Supreme Court of Canada’s 1994 decision in R. v. Daviault. The author argues that Bill C-72, which limits the defence of extreme intoxication, is constitutional because of its strong underpinnings in equality. The author reviews the statistics on violence against women and the role of intoxication in that violence to illustrate why the defence of intoxication raises issues …

The Law Of Humanity And The Law Of Nations, Mortimer N.S. Sellers

The nineteenth-century doctrines known as "international law" developed out of the seventeenth-century "jus gentium" and eighteenth-century "law of nations." Now we see that twentieth-century scholars such as Richard Falk would like to speak of the "law of humanity". What is the value of such semantic shifts? Proponents of "international law" sought to promote a positivist doctrine, which would minimize the natural law elements of the old law of nations to privilege the views of governments and states. Advocates of the "law of humanity" presumably seek to diminish the role of states in international law by eliminating "nations" as the basis …

The purpose of this research is to examine the acceptability of male homosexuals in law enforcement as determined by those currently employed as sworn officers in Southern California. Law enforcement has historically been reluctant to accept "outsiders" within its ranks. It has only been within the last 25 years that women and minorities have sought to enter the law enforcement profession in significant numbers, and it took legislative action and law suits to make this a reality.

The history of urban policing paints an evolutionary picture describing the various forces that impinged on society's earliest efforts at public policing and led to numerous reforms culminating in what has been termed the professional model of policing. The dynamics of an ever-changing urban society continued to present new challenges to policing and have driven police administrators and politicians to seek new methods of responding to society's criminal element.
