Globalization has not translated into a set of universal monolithic values. As populations relocate for various reasons, increasingly less effort is required not only to stay connected, but to remain within the home community via satellite television, radio, telecommunications, and locally concentrated diaspora. This thesis predicts how United States Supreme Court Associate Justice John Paul Stevens would have ruled on the constitutionality of same-sex marriage if the issue were to have come before him while he was on the Court. The hypothesis is that he would have found a constitutional right to same-sex marriage. The hypothesis is substantiated based on an analysis of Stevens‟ record in ten specific cases. The thesis puts forth the argument that these ten cases most accurately predict how Stevens would have voted on the constitutional issue. Stevens‟ opinions and dissents in these cases are examined. Socio-legal scholars often approach dispute resolution from the perspective of the disputants, emphasizing how the resources on each side shape the course of conflict. We suggest a different, “supply-side,” perspective. Focusing on the state's efforts to establish centralized courts in place of local justice systems, we consider the strategies that a supplier of dispute resolving services uses to attract disputes for resolution. We argue that state actors often attempt to “sell” centralized courts to potential litigants by insisting that the state's services are more efficient and fair than local courts operating outside direct state control. The wars in Korea and Vietnam were of a piece, directly related by virtue of U.S. global strategy and China’s security concerns. This paper, focusing mainly on the U.S. side in these wars, argues that three characteristics of American policy had enduring meaning for the rest of the Cold War and even beyond: the official mindsets that led to U.S. involvement, the centrality of the China threat in American decision making, and the common legacy of intervention against nationalism and in support of authoritarian regimes.
