International Idealism Meets Domestic-Criminal-Procedure Realism, Stephanos Bibas, William W. Burke-White 2010 University of Pennsylvania Carey Law School

International Idealism Meets Domestic-Criminal-Procedure Realism, Stephanos Bibas, William W. Burke-White

All Faculty Scholarship

Though international criminal justice has developed into a flourishing judicial system over the last two decades, scholars have neglected institutional design and procedure questions. International criminal-procedure scholarship has developed in isolation from its domestic counterpart but could learn much realism from it. Given its current focus on atrocities like genocide, international criminal law’s main purpose should be not only to inflict retribution, but also to restore wounded communities by bringing the truth to light. The international justice system needs more ideological balance, more stable career paths, and civil-service expertise. It also needs to draw on the domestic experience of federalism …

Selling Its Future Short: Armenia's Economic And Security Relations With Russia, Ian J. McGinnity 2010 Claremont McKenna College

Selling Its Future Short: Armenia's Economic And Security Relations With Russia, Ian J. Mcginnity

CMC Senior Theses

It is necessary and desirable for Armenia to retain close relations with Russia in both the short and long term. However, recent concessions to Russia for good relations in the short term may have potentially harmful repercussions for Armenia in the future. These concessions have in part resulted in the Russian dominance in the economic sector, over-dependence on Russia for Armenia’s energy needs, and the perpetuation of Armenian submissiveness to Russian interests. Armenia should, therefore, maintain good relations with Russia while simultaneously securing long-term paths that focus on actual strategic partnership and not dependence. In short, Armenia should return to …

The Right To Survival In The Democratic People’S Republic Of Korea, Jiyoung SONG 2010 Singapore Management University

The Right To Survival In The Democratic People’S Republic Of Korea, Jiyoung Song

Research Collection School of Social Sciences

For the past decade, the author has examined North Korean primary public documents and concludes that there have been changes of identities and ideas in the public discourse of human rights in the DPRK: from strong post-colonialism to Marxism-Leninism, from there to the creation of Juche as the state ideology and finally 'our style' socialism. This paper explains the background to KIM Jong Il's 'our style' human rights in North Korea: his broader framework, 'our style' socialism, with its two supporting ideational mechanisms, named 'virtuous politics' and 'military-first politics'. It analyses how some of these characteristics have disappeared while others …

The Tale Of Two Narratives: Nato As A Collective Defense And A Collective Security Institution, Anna M. Rulska 2010 Old Dominion University

The Tale Of Two Narratives: Nato As A Collective Defense And A Collective Security Institution, Anna M. Rulska

Graduate Program in International Studies Theses & Dissertations

The goal of this project is to determine NATO's present and future roles as a collective security organization and as a security alliance. In the past, NATO has dealt with both objectives under different and changing conditions. This paper argues that throughout the entirety of its history, NATO worked as both collective security and collective defense organization. The theoretical assumptions made within the paper are supported by the analysis of the past behavior of the Alliance in respect to the relationship between the narrative of collective security and that of collective defense, and changes within that relationship. Four specific periods …

Blood In The Wells: The Troubled Past And Perilous Future Of U.S.-Saudi Relations, Maxwell Czerniawski 2010 Eastern Michigan University

Blood In The Wells: The Troubled Past And Perilous Future Of U.S.-Saudi Relations, Maxwell Czerniawski

Senior Honors Theses and Projects

Perhaps no region other than the Near East plays a more important role in the shaping of both the foreign and domestic policies of the United States. The 9/11 terrorist attacks and subsequent deployment of hundreds of thousands of US soldiers to Afghanistan and Iraq, as well as the massive budgetary burden placed upon the United States government (and, by extension, its citizens) as a result of the War on Terror, lay heavily upon the consciousness of the media and the concerns of the American people. Much recent focus has also been placed on the impact that the need for …

The President's Unconstitutional Treatymaking, David H. Moore 2010 BYU Law

The President's Unconstitutional Treatymaking, David H. Moore

Faculty Scholarship

The President of the United States frequently signs international agreements but postpones ratification pending Senate consent. Under international law, a state that signs a treaty subject to later ratification must avoid acts that would defeat the treaty's object and purpose until the nation clearly communicates its intent not to join. As a result, the President in signing assumes interim treaty obligations before the treatymaking process is complete. Despite the pervasiveness of this practice, scholars have neglected the question of its constitutionality. As this Article demonstrates, the practice is unconstitutional. Neither the text, structure, nor history of the Constitution supports the …

Arab/American Relations And Human Security, Post-9/11: A Political Narrative Inquiry, Charlotte Moats-Gallagher 2010 Antioch University - PhD Program in Leadership and Change

Arab/American Relations And Human Security, Post-9/11: A Political Narrative Inquiry, Charlotte Moats-Gallagher

Antioch University Dissertations & Theses

This study explored eighteen women's views and experiences in the arena of Arab/American relations, post-9/11. The study engaged three groups of women: Arab women in Qatar, Arab American women in the U.S., and non-Arab women in the U.S. Qualitative narrative inquiry methodology was used complemented by an innovative use of freewriting to help prepare participants for interviews. Clarke’s (2005a) situational analysis was used to open up and analyze the data. Findings surfaced around the interconnected themes of identity, racism, discrimination and Othering, the role of the media, and how these ultimately influence a collective sense of and experience of human …

Conteted Heritage In The Ancient City Of Peace, William Feighery

William Feighery

As the imperial capital of thirteen dynasties Xi’an, formerly known as Chang’an (eternal peace), houses a legacy of many of the most important periods of Chinese history and is one of the great archeological centers of the world. This legacy of political and cultural dominance places Xi’an at the forefront of debates on cultural heritage and its role in the evolution of China in the 21st century. Xi’an is currently under a triad of influences from processes of globalization, urban transition and domestic and international tourism. In recent decades and particularly since the dawn on the new millennium, the historic …

"The Story Of Good Citizenship: Framing Recycling In The Context Of Duty-Based And Engaged Citizenship", Donna Lybecker, Mark Mcbeth, Kacee Garner

Donna L. Lybecker

Recent studies have explored the dimensions of duty-based versus engaged citizenship. These studies assert that individuals differ on the question of "what is a good citizen." Young individuals, in particular, are more likely to follow an engaged citizen view of citizenship. Engaged citizens are more participatory, global, and committed to social justice more than their duty-based counterparts. In this article we examine, with an innovative methodology and merging of citizenship and framing literature, the potential effects of increased engaged citizenship on policy issues. Our questions examine the characteristics of duty-based or engaged citizens and explore whether duty-based and engaged citizens …

Israel's Other Terrorism Challenge, Sandra Nasr

Sandra Nasr

This volume aims to ‘bring the state back into terrorism studies’ and fill the notable gap that currently exists in our understanding of the ways in which states employ terrorism as a political strategy of internal governance or foreign policy. [Book]
