Using hermeneutical methodology, this paper examines some of the legal fictions that form the foundation of Federal Indian Law. The text of the U.S. Supreme Court’s 1823 Johnson v. M’Intosh opinion is evaluated through the lens of the Convention on the Prevention and Punishment of the Crime of Genocide to determine the extent to which the Supreme Court incorporated genocidal principles into United States common law. The genealogy of M’Intosh is examined to identify influences that are not fully apparent on the face of the case. International jurisprudential interpretations of the legal definition of genocide are summarized and used as …

The purpose of this study was to determine whether there is a relationship between religious affiliation and Native American Identity. Based on the findings of this study, a component of a Native American's Identity is their religious affiliation. To contribute to the research on Native American and Alaskan Native identity, this study targeted the teenage demographic of ages 12 to 19 years old. Over growing concern, expressed by tribal elders, about a loss of cultural identity amongst teens, this study investigates a connection between a teen’s sense of identity and their religious affiliation (Quigley, 2019). A critical problem to study Catholicism in the context of Latin American modernity, is that the conceptual tools we use to study religion were designed to understand the transformations that modernity provoked in European religiosity. Studies on the religion of Latin Americans have largely explored the religiosity of the population through surveys that measure attendance, adherence and affiliation. While some anthropologists have explored religious practices among particular groups, we do not know how ordinary, urban Latin Americans practice religion. Fraternity, Martyrdom And Peace In Burundi: The Forty Servants Of God Of Buta, Jodi Mikalachki

During Burundi's 1993-2005 civil war, students at Buta Minor Seminary were ordered at gunpoint to separate by ethnicity—Hutus over here, Tutsis over there! They chose instead to join hands and affirm their common identity as children of God. The forty students killed were quickly proclaimed martyrs of fraternity. Their costly solidarity defused the cry for reprisals and continues to inspire Burundians and others on the path of reconciliation. Drawing on fifty interviews with survivors, parents of martyrs, neighbors, religious leaders and other Burundian intellectuals, this essay examines how Burundian Catholics understand the significance of the Buta martyrdom to their …

Religious Mega-Events And Their Assemblages In Devotional Pilgrimages: The Case Of Círio De Nazaré In Belém, Pará State, Brazil, José Rogério Lopes, André Luiz Da Silva

The article presents a typological categorization of contemporary mega-events and their characteristics, in order to interpret the assemblages mobilized by sectors of the Catholic Church in traditional devotional pilgrimages in the northern region of Brazil. It uses ethnographic accounts of the Círio de Nazaré feast, in Belém, Pará state, Brazil, considered the largest Catholic procession in the West, in order to analyze how the promotion of this event is organized through institutional and market logics that overlap with the religious phenomenon, evincing a contemporary trend. Young Brazilian Catholics Reaffiliating: A Case Study In The City Of Campos, Rj, Brazil, Cecilia L. Mariz, Wânia Amélia Belchior Mesquita, Michelle Piraciaba Araújo

Through a case study in Campos, a northern city of Rio de Janeiro state, Brazil, this article analyzes reports from young people who state that they have undergone a process of revival or reactivation of their Catholic faith. They all declared to have participated in the “St Andrew’s School of Evangelization.” They also mentioned having experienced an "encounter with God." Their narratives were similar to conversion accounts reported by practitioners of other religious traditions. The interviewees describe faith as a personal choice, and emphasize the need for religious study and the value of religious knowledge. To what extent these values …

Anthropological studies on Brazilian Catholicism traditionally focused on popular variants of this religious practice and their relationship with the official Catholicism. Encouraged by recent anthropological perspectives, which highlight the relevance of devoting researches not only on the margins, but also on the center of social practices, this paper analyzes contemporary practices of Brazilian Catholic friars and priests on health promotion. The analysis of their publications (books that include practices and tips on health and that became best sellers etc.), as well as interviews, allows us to perceive a process of environmentalization on the contemporary Brazilian Catholicism. In this paper we explore data on Catholicism from the 2010 census in Brazil, as well as other data from the Center for Religious Statistics and Social Investigation. Using these statistics, we question those arguments that explain the reduction in the number of Catholics in Brazilian society as a problem in the institution’s adaptation in response to the challenges of evangelization, or as a lack of ministerial vocations to meet the religious demands of the people. This work suggests that we consider a new, working definition of post-Christianity. This new paradigm is in response to Western Christian thought being too dominant a force that fails to take into enough account other global experiences— like those of Japanese Christians. These reflections are based on scholarly opinions claiming that Christianity is a “global culture,” and ultimately argues for more international inclusivity in Western Christian thought and institutions, especially regarding the Asia-Pacific. This study discusses the contestation of Islamic identity and local traditions of the Bugis-Makassar people in socio-religious life. Tradition contains a belief with form and practices that can still be traced to the present. In this case, the identity of the hajj pilgrimage attached to Muslims has been adapted to the Bawakaraeng Hajj community in the South Sulawesi region. The current research employed a qualitative descriptive approach and field-based data collection techniques by conducting observations and interviews with key informants about the Bawakaraeng community. Today’s undergraduate students are digital natives, shaped by constant access to information and countless experiences of encountering the world through the convenience of a screen. The ostensible comfort students have with difference gives way to a paradox, and one that’s made especially apparent in the theology classroom: Students are comfortable with seeing difference and particularity at a distance, but not adept at locating difference and particularity “at home.” I contend that Catholics & Cultures can help students from the dominant culture—namely, white students who comprise the vast majority of Catholic college students—destabilize their notion of the Catholic tradition as tightly …

Among various formations of interfaith interaction in the United States, practitioners strive to build relationships across religious difference through appeals to commonality. Problematically, relying on commonality to unite religiously diverse groups can ignore the colonial history behind what is considered common across humanity, and may serve to make interfaith interaction ineffective. The interfaith project is itself connected to the colonial legacy of Western epistemology, which tacitly normalizes Protestant Christian norms and conceptions of “Religion” and human subjectivity. Re-Assessing The Genocide Of Kurdish Alevis In Dersim, 1937-38, Dilşa Deniz

This article discusses a century-long denial of historic genocide targeting Kurdish Alevis in Turkey. Firstly, I argue that the state-sponsored killings and forced displacements that occurred in Dersim in 1937-38 constitute genocide. Secondly, I use census numbers and other available documentation to suggest a possible figure for the causalities, while pointing out the methods by which the state has tried to cover up these numbers, indicating state planning and preparation. Finally, I show that as a part of the continued denial of such genocide, Turkish leftist organizations have been manipulated by the state, and thus have ended up supporting much …

Julius Kambarage Nyerere, African philosopher, anti-colonial leader, first president of the United Republic of Tanzania, and respected international statesman, served as president of the newly independent Tanzania from 1964 through 1985., after which he remained politically active in Tanzania and on the global stage. Trying to steer a post-colonial course of self-reliance, he developed and implemented African Socialism in Tanzania, articulated in the Arusha Declaration in 1967. As an anti-colonial leader, Nyerere referred to international human rights standards such as the Universal Declaration of Human Rights, and maintained a commitment to human rights as president and afterwards. Christianity and Hip-Hop culture are often said to be at odds with one another. One is said to promote a lifestyle of righteousness and love, while the other is said to promote drugs, violence, and pride. On the Indonesian island of Java, there is a religious tradition referred to as Kebatinan, which can be seen as the mystical branch of the indigenous religion of Java called Kejawen. However, unlike the mystical traditions of other religions, mysticism is critical to the entire popular practice of Kejawen and is not simply reserved for a select few.
