Wrongful convictions are a major issue hindering the effectiveness and legitimacy of the criminal justice system. The topic has become a focus of media attention. Among the issues raised are the contributing factors to wrongful convictions, such as false confessions, false or misleading forensic evidence, official misconduct, mistaken witness identification, and perjury or false accusations. The following study examines how media frames these contributing factors of wrongful convictions using Loseke's social constructionist framework, which is useful for deconstructing the issue’s diagnostic, motivational and prognostic frames -- that is, how media consumers assess the causes, solutions, and the reasons to act …

This article explores the activities of The New Zealand Prostitutes' Collective (NZPC) in promoting decriminalization of prostitution and its role in gatekeeping this legislation. The NZPC has loomed large in the government’s evaluations of the decriminalization legislation known as the Prostitution Reform Act (PRA). It has collected information, partnered on the research team appointed by the Ministry of Justice to conduct the research, and ultimately secured seats as evaluators on the Prostitution Law Review Committee (PLRC) charged with assessing the research and making recommendations. In this article, we examine how socio-political actors frame prostitution and problems attached to the phenomenon and what types of policies they suggest. The sex trade in Switzerland has been tolerated since 1942, and prostitution is protected under the economic freedom guaranteed by the Swiss constitution. Any critique of prostitution is viewed as counterproductive, claimed to be rooted in old-fashioned ideas about sexuality and thought to worsen the situation for women who sell sex. The role of sex buyers is largely obscured, and the presumed right to buy sex remains unquestioned.

There is an overrepresentation of youths with disabilities in the juvenile justice system. As a result, each year thousands of juvenile offenders despite of the seriousness of the crimes committed, are released from incarceration with the hopes of living a successful life in society. Despite progressive research on identifying factors associated with desistance, it is still unclear what factors contribute to desistance for serious juvenile offenders and especially those with disabilities. 911 dispatchers are often the first point of contact after an individual is in an accident, needs emergency assistance, or witnesses a crime. In an emergency involving a crime, a dispatcher can play an important role in assisting the investigative process and collecting evidence, such as an eyewitness’ description of the suspect. While trained in how to gather situational and locational information from a caller so that relevant first responders can be notified, dispatchers may not be trained on how the specific language they use with a caller can impact the caller’s memory for the event. There has been growing research on multiple perpetrator sexual assault (MPSA) and how it qualitatively differs from single assailant offenses. Relying on rational choice theory, we compare burglars’ varying levels of offense planning to understand differences among types of burglars. Surveys were collected from a sample of incarcerated male and female burglars in three states. Participants answered questions detailing aspects of a burglary including motivations, target selection, deterrents, and techniques. Comparisons were made between 119 deliberate (32%) and 257 impulsive (68%) burglars. Deliberate burglars focused on obtaining cash, whereas impulsive burglars were more motivated by drug habits. Impulsive burglars were more easily dissuaded from a target when multiple obstacles are present. Burglars consider how many obstacles they may have to …

Record clearance allows some individuals to redesignate or remove certain minor convictions from their criminal records. This interview-based study finds that both men and women seek opportunities for personal gain through record clearance, but women are more motivated by moral and religious influences and concern about reputation. Women are also more likely than men to acknowledge personal flaws, and to desire to replace criminal identities with law-abiding identities. As women redefine their identities, caregiving is especially important as a personal obligation and professional aspiration. Record clearance is particularly compatible with women’s motivations, willingness to change, and personal and professional goals.

Current research indicates an association between intense adolescent work (twenty hours or more per week) and delinquent behavior. It has been widely speculated that this relationship is spurious, occurring only as a result of other factors which are common to both offending and intense employment. The current study attempts to fill a gap in the literature by utilizing the Pathways to Desistance dataset to examine the evolution of the relationship between work and self-reported offending in a longitudinal sample of juvenile offenders. “Bloody Bay: Grassroots Policeways, Community Control, and Power in San Francisco and its Hinterlands, 1846–1915” follows the history of San Francisco’s spectrum of formal and informal policing from the American takeover of California in 1846 during the U.S.–Mexico War to Police Commissioner Jesse B. Cook’s nationwide law enforcement advisory team tour in 1912 and San Francisco’s debut as the Jewel of a new American Pacific world during the Panama Pacific International Exposition in 1915. Prior research indicates that completion of prison programs significantly decreases recidivism amongst offenders. This research classifies prison programs as an aspect of Social Bond Theory to determine if these types of programs improve the recidivism rate. Social Bond Theory has four elements: commitment (time invested into education or career), attachment (relationships with family and friends), involvement (time spent in activities outside of crime), and belief (agreement with social norms). Research articles were compiled from 2000-2015, published and unpublished, with a three year recidivism rate or less (several exceptions were made), and a sample size of greater than 50. An odds …

This research examines the effectiveness of loss prevention strategies, specifically, uniformed and undercover Loss Prevention Agents (LPA), to determine the proper implementation of these strategies and provide necessary recommendations for the retail stores to lower the rate of shrinkage. It has been found that to date $13 billion worth of merchandise is stolen per year nationwide. Therefore, in order to reduce shoplifting, retail stores implement various loss prevention strategies among them: LPAs and others. Video recordings of police-citizen interactions, most notably those obtained from the dashboard cameras (dashcams) of police cars, have been successful in objectively capturing police-citizen exchanges. However, since police-civilian interactions do not solely occur in front of police cars, dashcams present significant limitations. Off-camera violent, and sometimes fatal, encounters (such as the notorious Ferguson case) have fueled increased public support for body-worn cameras. This is especially true in cases with conflicting accounts from the officer(s), victim(s), and witness(es). Requiring officers to wear bodycams may reduce incidents of force and citizen complaints, and increase officer accountability. This paper will present peer-reviewed research …

Previous literature explores the many dimensions of homicide investigations, including case and individual characteristics, evidence and investigative activities. However, little research delves into situational characteristics and their relationship to specific homicides, charge severity sought by prosecutors and sentence length given to homicide offenders. The current study sampled homicide cases (N=68) to gather baseline information and data regarding judicial outcomes. Donald Black’s Theory of Moral Time (2011) is tested and utilized as the study’s conceptual framework for the study’s hypotheses.

This qualitative study explores the impact that the fear of deportation has on the lives of noncitizen immigrants. More broadly, it explores the role that immigration enforcement, specifically deportation, plays in disrupting the process of integration, and the possible implications of this interruption for immigrants and their communities. The study aims to answer: (1) how vulnerability to deportation specifically impacts an immigrant’s life, and (2) how the vulnerability to deportation, and the fear associated with it, impacts an immigrant’s degree of integration. Cyber-crime is unique in the fact that, cyber criminals can commit crimes behind completely closed doors and they are virtually anonymous. This makes for a varied environment of theory on the causation of cyber-crimes. Through the process of record clearance, individuals can have certain minor convictions removed from their criminal records or designated as expunged. This study analyzes data gathered from semi-structured interviews with 40 persons with past criminal convictions to examine the expectations of individuals who seek record clearance and the extent to which completion of the process facilitates efforts to reintegrate into society and desist from crime. The analysis finds that record clearance benefits ex-offenders through external effects, such as the reduction of barriers to employment, and internal processes, such as the facilitation of cognitive transformation and the affirmation of a new …

Research from control theorist Walter Reckless has shown that positive self-image acts as an insulator from delinquency during adolescence. Current research investigates the connection between an individual’s self-perceptions and their inclination toward delinquency, hypothesizing that rates of delinquency will be lesser for an individual with a positive perception of self. Data from Wave I of the National Longitudinal Study of Adolescent Health are compared to follow-up data with participants in Wave II so reported self-image may predict subsequent delinquency. Ordered logistic regression is used to estimate the significance of self-image effects on delinquency, and probability scores for participation in delinquency …

It is said that the Unites States is a post-racial society where race doesn't matter and colorblind rhetoric is used as a defense mechanism for perceived or committed discriminatory acts toward black people. In theory, color-blind ideology would help to eliminate racism by treating people equally without regard to race or ethnicity. In practice, colorblindness completely ignores the historical context of race in this country. Under the ideology of colorblindness, overt racism is translated into cultural criminalization.
