The status of African Americans in relationship to the administration of justice has improved since the 1940s. Significantly, however, researchers continue to find racial discrimination and racial disadvantage operating in various aspects of the criminal justice process in numerous jurisdictions. Such findings are unacceptable in a society that claims to honor equal justice under law.
This article is reprinted from Summary, Volume 1 of the Assessment of the Status of African-Americans series, published in 1990 by the William Monroe Trotter Institute, University of Massachusetts at Boston, and edited by Wornie L. Reed. Materials included in the article were adapted …

Mark Ensalaco
It is time for new thinking about human rights advocacy. This is the challenge for the global human rights research and advocacy community.
The University of Dayton Human Rights Center creates positive change through research, education and dialogue. As a leader in the global human rights community, we search for transformative solutions to systemic patterns of injustice that will bring about real change in the lives of poor people. We are committed to addressing the gap between theory and practice, between scholars and practitioners. Advocates need information to be able to develop evidence-based strategies that bring about real change. We …

2013 Conference Report: The Social Practice Of Human Rights, Mark Ensalaco
Mark Ensalaco
Universities have new importance in the global human rights movement. This was the resounding message the University of Dayton heard at its global conference on human rights advocacy in October 2013. The human rights movement is experiencing dramatic changes. Dynamic new NGOs in the global South are resetting the human rights agenda. Popular movements inspired by human rights ideals are arising around the world to demand justice. New information technologies are creating the possibility of real global solidarity. The movement must adapt. Human rights organizations must imagine new strategies to address poverty and other root causes of human rights violations. …

Broad Are Nebraska's Rolling Plains: The Early Writings Of George Bird Grinnell, Richard Vaughan
Richard Vaughan
Profiles the life of writer George Bird Grinnell (1849-1938) and the influence his first trip to Nebraska had in shaping his early writings about the American West. Among the works he published were several groundbreaking books about the Plains Indians of the late 19th and early 20th centuries. Not only did this 1870 trip to Nebraska, as a member of O. C. Marsh’s first Yale Paleontological Expedition, influence Grinnell's scholarly endeavors, but his deep interest in the state also influenced his lifelong devotion to environmental preservation and established him as an important advocate for the protection and welfare of Native …

Black Male College Achievers And Resistant Responses To Racist Stereotypes At Predominantly White Colleges And Universities, Shaun R. Harper, Ph.D.
Shaun R. Harper, Ph.D.
In this article, Shaun R. Harper investigates how Black undergraduate men respond to and resist the internalization of racist stereotypes at predominantly White colleges and universities. Prior studies consistently show that racial stereotypes are commonplace on many campuses, that their effects are usually psychologically and academically hazardous, and that Black undergraduate men are often among the most stereotyped populations in higher education and society. The threat of confirming stereotypes has been shown to undermine academic performance and persistence for Blacks and other minoritized students. To learn more about those who succeed in postsecondary contexts where they are routinely stereotyped, Harper …

Sex, race, gender, sexuality, color, religion, language, nationality, ethnicity, culture, poverty - socially constructed categories, social tropes that relegate "others" to subordinated positions in the varied and various cultural and economic marketplaces of both global and local societies. Richard Delgado's transformational work engages all of these tropes insightfully, disturbingly, and illuminatingly. His rich literature conceptualizes persons as multidimensional, complex beings and exposes society as the pre-fabricated stage in which diverse interactions evolve. Delgado's epistemological stance is fluid, non-rigid, and grounded on subjectivity. In this essay I will focus on Delgado's latest book When Equality Ends: Stories About Race and Resistance. …
The Social Practice Of Human Rights, Joel Pruce
The Social Practice Of Human Rights, Joel Pruce
Joel Pruce
The Social Practice of Human Rights bridges the conventional scholar-practitioner divide by focusing on the space in between. In capturing this cutting edge research program, the volume proposes a perspective that motivates critical self-reflection of the strategies that drive communities dedicated to the advocacy and implementation of human rights. The social practice of human rights takes place not in front of a judge, but in the streets and alleys, in the backrooms and out-of-the-way places where change occurs. Contributors to this volume investigate the contexts and efforts of activists and professionals devoted to promoting human rights norms. This research takes …

Why must we explore the social practice of human rights? In the 65 years since the U.N.’s Universal Declaration on Human Rights, the human rights community has become a standard-bearer of normative behavior, influencing development and humanitarian organizations, multinational corporations and philanthropists. Though the movement is viewed as honorable and admirable, the certainty of its mission can inhibit introspection; a natural tendency is to prioritize rather than challenge prevailing assumptions. Are the good intentions of human rights advocates enough? No. Research and dialogue can help propel the human rights community forward by facilitating introspection to improve both advocacy and action: …

Debate, Implicit Race Bias And The 2008 Presidential Election: Much Ado About Nothing?, Gregory S. Parks, Jeffrey J. Rachlinski, Richard A. Epstein
Jeffrey J. Rachlinski
The election of Barack Obama marks a significant milestone for race relations in our nation—on this much our debaters agree. The meaning of this milestone for the future of race-based policies, such as affirmative action and antidiscrimination laws, is where they disagree. Dr. Gregory Parks and Professor Jeffrey Rachlinski argue that any announcement of the arrival of a “post-racial America” is premature, as the presidential campaign actually revealed an implicit racial bias present in “most white adult brains.” The stereotypical criticisms of Obama, explicit racial references by supporters of opposing candidates, and “deeply racially stratified voting” were, in fact, “reflection[s] …

The Effectiveness Of Diversity Initiatives At Suny Brockport Including Student Perceptions And Campus Climate, Kara Hiltz, Amanda Crowley, Marquia Westbrook
Kara M. Hiltz
This presentation preliminarily examines the effectiveness of campus-wide diversity initiatives through the Office of the Assistant Provost for Diversity at the College at Brockport, State University of New York. Effectiveness will be measured by survey item responses and institutional data. Student perception data was obtained through item responses on the 2008 and 2011 National Survey of Student Engagement (NSSE) survey and SUNY Student Opinion Survey (SOS). The College's institutional research department collected the institutional data that is examined (e.g., enrollment diversity). Strengths, areas for improvement, and suggestions for future diversity initiatives will be presented. Keywords: diversity, initiatives, student enrollment, improvement, …
A Critique Of ‘Liberal Peace’ And ‘Conflict Resolution’: A Critical Peace Alternative, Nicos Trimikliniotis
A Critique Of ‘Liberal Peace’ And ‘Conflict Resolution’: A Critical Peace Alternative, Nicos Trimikliniotis
Nicos Trimikliniotis
This paper critiques the notions of peace, peace-building, which often goes together with state-building, development and transitional justice, are connected to the liberal peace model. It proposes that alternative readings are required that to allow reconceptualising of peace and better route in a dynamic and conflict-based reading of society. The critique of liberal peace can pave the way for reading the dialectics peace/war and ethnic conflict/reconciliation in deeply divided societies suffering from ethnic-related violence. It critiques Conflict Resolution (CR) approaches and considers how a sociological reading can enrich, restructure and reconceptualise of peace-in-society in terms of critical peace. Unlike those …

Made In Germany: Integration As Inside Joke In The Ethno-Comedy Of Kaya Yanar And Bülent Ceylan, Kathrin M. Bower
Kathrin M. Bower
As the largest “foreign” population in Germany, Turkish immigrants have been the primary target for concerns about integration and the impact of immigration on German culture. Since the founding of the first Turkish German cabaret in 1985 by Şinasi Dikmen and Muhsin Omurca, the misconceptions and one-sided expectations associated with integration have been played, parodied, and satirized by Turkish German performers. As producers of contemporary ethno-comedy, Kaya Yanar and Bülent Ceylan appeal to mass audiences with a new approach, inverting questions of integration by creating communities through laughter in which audiences are at once in on the joke and its …

Serdar Somuncu: Turkish German Comedy As Transnational Intervention, Kathrin M. Bower
Kathrin M. Bower
A reconceptualization of Germanness, combined with a reconsideration of what constitutes “Germanness” and “Turkishness” and how they are linked, is a central theme in the programs of a younger generation of Turkish German cabaret artists and comedians. As a member of the new generation of performers, Serdar Somuncu stands out, not only for his unapologetic embrace of political theater critical of both German and Turkish social politics, but also for his assertion of a right and responsibility to engage with Germany’s past, coupled with an insistence on differentiation and balanced comparison when discussing integration. After gaining notoriety through his Mein …

Serdar Somuncu: Reframing Integration Through A Transnational Politics Of Satire, Kathrin M. Bower
Kathrin M. Bower
Founded by Şinasi Dikmen and Muhsin Omurcu in Ulm in 1985, Knobi-Bonbon is widely recognized as the first Turkish German cabaret in the Federal Republic. Dikmen and Omurcu focused on ethnic stereotypes, integration, and coexistence in their early programs, with an emphasis on the German misunderstanding of integration as cultural assimilation (Boran 202, 219). With a run of successful performances, Knobi-Bonbon established a momentum that has carried through to the present day, making Turkish German comedy a fixture on the German stage. Responding to the wave of nationalism and xenophobia that followed in the wake of unification, Knobi-Bonbon’s shows became …
Minority Identity As German Identity In Conscious Rap And Gangsta Rap: Pushing The Margins, Redefining The Center, Kathrin M. Bower
Minority Identity As German Identity In Conscious Rap And Gangsta Rap: Pushing The Margins, Redefining The Center, Kathrin M. Bower
Kathrin M. Bower
After rap entered the German music scene in the 1980s, it developed into a variety of styles that reflect Germany's increasingly multiethnic social fabric. Politically conscious rap assumed greater relevance after unification, focusing on issues of discrimination, integration, and xenophobia. Gangsta rap, with its emphasis on street conflict and violence, brought the ghetto to Germany and sparked debates about the condition of German cities and the erosion of civic consciousness. Alternately celebrated and reviled by the media, both styles utilize rap's synthesis of authenticity and performance to redefine the relationship between minority identity and German identity and debunk Leitkultur.

Best Kept Secret: Single Black Fathers, Roberta Coles
Best Kept Secret: Single Black Fathers, Roberta Coles
Roberta Coles
The Best Kept Secret studies the often-overlooked group of single, African American custodial fathers. While the media focuses on the increase of single mothers and the decline in marriage in the black community, Roberta Coles paints a nuanced picture of single black dads. Based on qualitative research, the author looks at the parenting experience of these fathers, who may have become single parents through nonmarital births, divorce, widowhood and adoption. The fathers, ranging in age from 20 to 76, discuss their motivations for taking custody of their children, what roles they enact as parents, what they hope for their children, …

Myth Of The Missing Black Father, Roberta Coles, Charles Green
Roberta Coles
Common stereotypes portray black fathers as being largely absent from their families. Yet while black fathers are less likely than white and Hispanic fathers to marry their child's mother, many continue to parent through cohabitation and visitation, providing caretaking, financial, and other in-kind support. This volume captures the meaning and practice of black fatherhood in its many manifestations, exploring two-parent families, cohabitation, single custodial fathering, stepfathering, noncustodial visitation, and parenting by extended family members and friends. Contributors examine ways that black men perceive and decipher their parenting responsibilities, paying careful attention to psychosocial, economic, and political factors that affect the …

Less Enforcement, More Compliance, Emily Ryo

A common assumption underlying the current public discourse and legal treatment of unauthorized immigrants is that unauthorized immigrants are lawless individuals who will break the law—any law—in search of economic gain. This notion persists despite substantial empirical evidence to the contrary. Drawing on original empirical data, this Article examines unauthorized immigrants and their relationship to the law from a novel perspective to make two major contributions. First, I demonstrate that unauthorized immigrants view themselves and their noncompliance with U.S. immigration law in a manner that is strikingly different from the prevalent view of criminality and lawlessness found in popular and …
