Rethinking Critical Mass In The Federal Appellate Courts., Laura Moyer

This article draws from critical mass studies of gender in other political institutions to inform an application to the US Courts of Appeals. The results demonstrate the utility of considering court-level aspects of diversity. As mixed-sex panels become more common within a circuit, both male and female judges increasingly support plaintiffs in civil rights claims, though the magnitude of the effect is larger for women. The presence of a female chief judge is also positively associated with pro-plaintiff decisions by men and women in sex discrimination cases.

The editorial content of piano method books published in the nineteenth century contributed to the gendering of the domestic piano by targeting a middle-class female audience. At the same time, these tutorials circumscribed the ability and ambition of female pianists, cautioning women against technical display or performing challenging pieces in company, thereby reinforcing the stereotype of the graceful, demure woman who played a little. However, this effort was complicated by both the tutorials themselves and contemporary fiction. The middle-class women reading these tutorials also read novels—a fact the method books occasionally acknowledge—which often presented a very different picture of women’s …

This examination of late Victorian journalism reveals that one type of clothing offered middle-class women protection from street harassment: cross-cultural dress. In appropriate ethnic attire, reporters and social investigators ventured into the immigrant communities that made up a part of England’s urban poor, exploring such trades as Jewish fur-puller or Italian organ-grinder. This incognito ethnic attire afforded women both the means and the authority to carry out their investigations into the Italian constituency of the Victorian working poor. This chapter is part of a volume dedicated to rewriting human rights cases issued by the European Court of Human Rights. It uses the case of De La Cierva Osorio De Moscoso v. Spain (1999) as a platform to discuss the inherent tension typifying signs such as nobility titles – as merely symbolic or as carrying substantive content. The problem of one’s ownership of signs is especially acute in the case of women. This study examines the educational persistence of women of African descent (WOAD) in pursuit of a doctorate degree at universities in the southeastern United States. WOAD are women of African ancestry born outside the African continent. These women are heirs to an inner dogged determination and spirit to survive despite all odds (Pulliam, 2003, p. 337).This study used Ellis’s (1997) Three Stages for Graduate Student Development as the conceptual framework to examine the persistent strategies used by these women to persist to the completion of their studies.

In this article I discuss some of the findings of my study of the encounter between female migrants and immigration enforcement authorities along the U.S.-Mexico border. An objective of the research was to ascertain a more accurate picture of women temporarily suspended in the “intersection” of diametrically opposed processes, immigration enforcement and transnational mobility. Of the many issues that have emerged from this research, family separation is most palpable. This suggests a deeply entrenched economic relationship between family separation and measures to better secure the U.S.-Mexico border. In this essay, I present the voices of homeless women to illustrate the empowering impact of popular education on their lives. Popular education is a methodology of teaching and learning through dialogue that directly links curriculum content to people's lived experience and that inspires political action (Beder, 1996; Freire, 1985, 1990; Williams, 1996). On the basis of 5 years of ethnographic research in a shelter-based popular-education program, I describe how popular education approaches inspired a sense of community among a group of 50 homeless women of color. This Article contends that the current debate over gay civil rights is, at base, a dispute over the nature of same-sex desire. Pro-gay forces advocate an ethnic or identity model of homosexuality based on the conviction that sexual orientation is an immutable, unchosen, and benign characteristic. The assertion that, in essence, gays are "born that way," has produced a gay political narrative that rests on claims of shared identity (i.e., homosexuals are a blameless minority) and arguments of equivalence (i.e., as a blameless minority, homosexuals deserve equal treatment and protection against discrimination).
