การศึกษาวิจัยเรื่อง "การคุ้มครองสิทธิและการเข้าถึงความยุติธรรมของคนไร้ที่พึ่งในสถานคุ้มครองคนไร้ที่พึ่ง" มีวัตถุประสงค์เพื่อศึกษาค้นคว้า กฎหมาย หลักการ แนวปฏิบัติเพื่อคุ้มครองสิทธิ สภาพปัญหา สาเหตุ อุปสรรค ผลกระทบ การเยียวยา สถานการณ์การละเมิดสิทธิและการเข้าไม่ถึงความยุติธรรม และเสนอแนะแนวทางการปฏิบัติที่เหมาะสมต่อการคุ้มครองสิทธิและการเข้าถึงความยุติธรรมของคนไร้ที่พึ่งในสถานคุ้มครองคนไร้ที่พึ่ง การวิจัยครั้งนี้เป็นการศึกษาโดยใช้วิธีวิจัยแบบผสานวิธี (Mixed method) คือเชิงปริมาณและเชิงคุณภาพ รวมถึงการศึกษาทบทวนเอกสารงานวิจัยที่เกี่ยวข้อง (Documentary research) ตามแนวคิดการคุ้มครองสิทธิและการเข้าถึงความยุติธรรม ผลการวิจัยสรุปสาระสำคัญได้ 2 ประการดังต่อไปนี้ ประการแรก การถูกละเมิดสิทธิ (Rights Infringement) พบปัญหาหลายประการทั้งด้านกฎหมาย นโยบาย การปฏิบัติและองค์ความรู้ เช่น (1) พ.ร.บ คุ้มครองคนไร้ที่พึ่ง พ.ศ. 2557 กีดกันคนบางกลุ่มออกจากสถานคุ้มครองคนไร้ที่พึ่งเนื่องจากกฎหมายคุ้มครองเฉพาะกลุ่มที่เกี่ยวข้อง (2) สถานคุ้มครองคนไร้ที่พึ่งมีกฎระเบียบมากเกินไป ขาดการเชื่อมโยงฐานข้อมูลและขาดระเบียบวิธีการปฏิบัติงานที่ชัดเจนระหว่างหน่วยงานที่เกี่ยวข้อง (3) คนไร้ที่พึ่งส่วนใหญ่ขาดการรับรู้เรื่องสิทธิของตนเอง (4) เจ้าหน้าที่และบุคลากรไม่เพียงพอ ขาดองค์ความรู้ และทักษะการปฏิบัติงานด้านสังคมสงเคราะห์ ประการที่สอง การเข้าไม่ถึงความยุติธรรม (Inaccessibility to justice) พบปัญหาหลายประการ เช่น (1) เจ้าหน้าที่ตำรวจใช้วิธีการล่อลวงและควบคุมตัวคนไร้ที่พึ่งเพื่อเข้าสู่กระบวนการคัดกรองคุณสมบัติโดยปราศจากความยินยอม (2) การเลือกปฏิบัติของเจ้าหน้าที่ในบางสถานคุ้มครองคนไร้ที่พึ่ง (3) สถานคุ้มครองคนไร้ที่พึ่งยังขาดมาตรการ หลักเกณฑ์และกองทุนการเยียวยากรณีคนไร้ที่พึ่งที่ได้รับการปฏิบัติที่ไม่เหมาะสม (4) คนไร้ที่พึ่งไม่กล้าร้องเรียนปัญหาเนื่องจากเกรงผลกระทบต่อการใช้บริการ ผลการวิจัยในครั้งนี้สามารถนำไปใช้ในการปรับปรุงกฎหมาย นโยบาย ระเบียบ กลไกลและหลักการปฏิบัติในการคุ้มครองสิทธิและการเข้าถึงความยุติธรรมของคนไร้ที่พึ่งในอนาคต

Callisto As A Value Agent: How This Online Site For College Sexual Assault Reporting Extends Value Design, Stephen J. Lilley, Amanda Moras

In this paper, we offer a case study of Callisto, an online site for sexual assault reporting, to highlight innovations in value design. We compare Callisto first to ordinary reporting systems, second to value design projects in computer/information system engineering, and third to large scale social movements and social media enterprises. Callisto stands out from other systems based on its exceptional value agency- a measure of a system’s societal reach, resource commitment, and value design engineering. As such, it provides a model for human rights and social justice campaigns.

Cultural Resource Centers Reports and Resources

The Cultural Resource Centers (CRCs) at Portland State University (PSU) create a student-centered inclusive environment that enriches the university experience. The CRCs value diversity, social justice, cultural traditions, student identities, success and leadership. On November 2, 2016, PSU held a grand opening celebrating the expansion of the CRCs with the addition of two new centers, the Pan-African Commons (PAC) and the Pacific Islander, Asian, and Asian American Student Center (PIAAA). Technological advances have created new avenues for the perpetration of sexual violence. The widespread availability of cameras has made it easier to take covert recordings of an individual’s intimate body parts, and whether sexually explicit images are recorded with or without an individual’s consent, growing access to the Internet has facilitated the nonconsensual dissemination of those images. Yet criminal laws have not kept pace with technology in most jurisdictions across the United States, and victims of nonconsensual pornography typically have no avenue by which to seek justice. The abstract legal subject of liberal Western democracies fails to reflect the fundamental reality of the human condition, which is vulnerability. While it is universal and constant, vulnerability is manifested differently in individuals, often resulting in significant differences in position and circumstance. In spite of such differences, political theory positions equality as the foundation for law and policy, and privileges autonomy, independence and self-sufficiency. การศึกษาเรื่องการกลับใจของผู้พ้นโทษในบ้านกึ่งวิถีแนวคริสต์ ศึกษากรณีบ้านกึ่งวิถีบ้านพระพร ของมูลนิธิพันธกิจเรือนจำคริสเตียน มีวัตถุประสงค์เพื่อศึกษาแนวคิดและรูปแบบการดำเนินกระบวนการของบ้านกึ่งวิถีบ้านพระพร กระบวนการกลับใจที่เกิดขึ้นกับผู้พ้นโทษที่สมัครใจเข้าร่วมในบ้านกึ่งวิถีบ้านพระพร และแนวทางในการพัฒนาบทบาทของภาคประชาสังคมในรูปแบบของบ้านกึ่งวิถี ที่นำเอาหลักคำสอนในพระคริสตธรรมคัมภีร์มาปรับใช้ช่วยเหลือผู้พ้นโทษที่มีความแตกต่างหลากหลายให้กลับสู่สังคม โดยใช้วิธีการวิจัยเชิงคุณภาพ เก็บรวบรวมข้อมูลด้วยการสัมภาษณ์เชิงลึก และนำข้อมูลที่ได้มาวิเคราะห์เพื่ออธิบายประสบการณ์การกลับใจของผู้พ้นโทษและการดำเนินการในบ้านกึ่งวิถีแนวคริสต์ ผลการวิจัยพบว่า (1) การดำเนินงานของบ้านพระพรมีการดูแลสมาชิกอย่างเป็นระบบ กิจกรรมต่างๆส่งเสริมระเบียบวินัยและความรับผิดชอบของสมาชิก ดูแลปัจจัยพื้นฐาน ฝึกอาชีพเสริม และมีชั้นเรียนเพื่อพัฒนาความรู้ทางพระคัมภีร์ นอกจากนี้ ยังมีกระบวนการจัดการกับอารมณ์และพฤติกรรมติดตัวของสมาชิกให้เป็นไปในทางที่ดีขึ้น มีคริสตจักรพระพรเป็นศูนย์กลางประสานงานกับผู้พ้นโทษและเป็นสถานที่ที่สมาชิกเก่าและใหม่สามารถกลับมารวมตัวกันได้ ซึ่งทำให้เกิดพันธะทางสังคมที่ต่อเนื่องช่วยในการสอดส่องดูแลพฤติกรรมอย่างไม่เป็นทางการเมื่อกลับสู่สังคม (2) กระบวนการกลับใจของสมาชิกในบ้านพระพร พบว่าสมาชิกมีการเปลี่ยนแปลงในจิตใจคือตัดสินใจที่จะละทิ้งการกระทำผิดและตั้งใจดำเนินชีวิตตามแบบอย่างของพระเยซูคริสต์เริ่มตั้งแต่ในเรือนจำ และมีสมาชิกบางคนเกิดการเปลี่ยนแปลงนี้เมื่อได้รับการฝึกฝนในบ้านพระพรแล้ว การเปลี่ยนแปลงเกิดทั้งด้านพฤติกรรม ด้านอัตมโนทัศน์ และด้านจิตวิญญาณส่งผลให้สมาชิกมีมุมมองใหม่ต่อตนเองและผู้อื่นในทางที่ดีขึ้น ช่วยให้พวกเขาดำเนินชีวิตในช่วงเปลี่ยนผ่าน (Transitional Period) จากเรือนจำไปสู่สังคมภายนอกได้อย่างเข้มแข็ง (3) ควรมีการขยายแนวคิดในการส่งต่อผู้พ้นโทษจากเรือนจำไปอยู่ในการดูแลของคริสตจักรหรือให้หน่วยงานภาคเอกชนอื่นๆ เข้ามาช่วยแก้ไขปัญหาแบบครบวงจรโดยอาจพ่วงมิติของศาสนาอันจะส่งผลให้เกิดการช่วยเหลือผู้พ้นโทษที่เป็นรูปธรรมมากขึ้น

การศึกษานี้มีวัตถุประสงค์เพื่อศึกษาปัญหาการบังคับใช้กฎหมายมาตรการสำหรับการเผยแพร่เพลงลิขสิทธิ์อย่างเหมาะสม และการลดปัญหาการเผยแพร่เพลงลิขสิทธิ์ในร้านอาหาร - ร้านกาแฟ โดยใช้วิธีวิจัยเชิงคุณภาพเก็บข้อมูลด้วยวิธีการสัมภาษณ์เชิงลึกจากกลุ่มตัวอย่าง 2 กลุ่ม ได้แก่ ผู้ประกอบการร้านอาหาร - ร้านกาแฟในกรุงเทพมหานคร จำนวน 9 คน และเจ้าหน้าที่ในกระบวนการยุติธรรม ประกอบด้วยเจ้าหน้าที่ตำรวจในกรุงเทพมหานคร จำนวน 3 คน และผู้พิพากษาศาลทรัพย์สินทางปัญญาและการค้าระหว่างประเทศกลาง จำนวน 1 คน การสุ่มตัวอย่างใช้แบบที่มีลักษณะเฉพาะเจาะจง (purposive sampling) และการสุ่มตัวอย่างแบบลูกโซ่ (snowball sampling) โดยใช้วิธีการพรรณนาข้อมูลร่วมกับการวิเคราะห์เนื้อหาข้อมูลที่ได้จากการสัมภาษณ์ ผลการศึกษาพบว่า 1) ปัญหาด้านการบังคับใช้กฎหมายที่สำคัญคือ การเลือกปฏิบัติในการตรวจสอบการเผยแพร่เพลง รวมไปถึงการแสวงหาผลประโยชน์แอบแฝงของผู้รับมอบอำนาจ ประกอบกับผู้ประกอบการส่วนใหญ่มีความรู้ในการเผยแพร่เพลงลิขสิทธิ์อยู่ในระดับน้อย 2) มาตรการที่เหมาะสมสำหรับการเผยแพร่เพลงลิขสิทธิ์คือ การกำหนดบทบาทการใช้อำนาจของผู้รับมอบอำนาจให้ชัดเจนเพื่อป้องกันการแสวงหาผลประโยชน์แอบแฝง และระบุรายละเอียดในข้อกฎหมายเกี่ยวกับข้อยกเว้นการละเมิดลิขสิทธิ์ให้ชัดเจน โดยยึดผลประโยชน์ของเจ้าของผลงาน และการปกป้องคุ้มครองผลงานลิขสิทธิ์ 3) แนวทางการลดปัญหาและข้อเสนอแนะจากการศึกษานี้คือ การให้ความรู้ความเข้าใจในเรื่องกฎหมายลิขสิทธิ์และการเผยแพร่เพลงลิขสิทธิ์แก่ประชาชน เพื่อพัฒนาความรู้ความเข้าใจและทัศนคติที่ดีต่อลิขสิทธิ์ในประเทศไทยต่อไป

ปัจจัยที่ส่งผลต่อการตกเป็นเหยื่ออาชญากรรมทางเศรษฐกิจ : ศึกษากรณีแชร์ลูกโซ่, พลิสสุภา พจนะลาวัณย์

การศึกษาเรื่อง "ปัจจัยที่ส่งผลต่อการตกเป็นเหยื่ออาชญากรรมทางเศรษฐกิจ : ศึกษากรณีแชร์ลูกโซ่" มีวัตถุประสงค์เพื่อศึกษารูปแบบของแชร์ลูกโซ่ในประเทศไทย ปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อของแชร์ลูกโซ่ และแนวทางการแก้ไขปัญหาการตกเป็นเหยื่อแชร์ลูกโซ่ การศึกษาครั้งนี้เป็นการศึกษาวิจัยเชิงปริมาณควบคู่กับการศึกษาเชิงคุณภาพ ในการศึกษาวิจัยเชิงปริมาณใช้แบบสอบถามเป็นเครื่องมือ โดยการสุ่มตัวอย่างแบบเจาะจง (Purposive Sampling) จากกลุ่มผู้ที่ตกเป็นเหยื่อแชร์ลูกโซ่ จำนวน 396 คน ส่วนการศึกษาเชิงคุณภาพใช้การสัมภาษณ์เชิงลึก ประชากรที่ศึกษาจำนวน 4 คน คือ เจ้าหน้าที่ที่ปฏิบัติงานโดยตรงเกี่ยวกับแชร์ลูกโซ่ ผลการศึกษาพบว่า มีแชร์ลูกโซ่ในประเทศไทย 3 รูปแบบ คือ 1. รูปแบบของแชร์ลูกโซ่ที่ใช้วิธีการขายสินค้าและบริการ มีลักษณะชักชวนให้ร่วมเล่นแบบปากต่อปาก เช่น การขายสินค้า การลงทุนแบบต่างๆ 2. รูปแบบแชร์ลูกโซ่ที่ใช้วิธีการชักชวนให้มาเป็นสมาชิกจะมีลักษณะเหมือนยุคอดีต แต่เน้นการหาสมาชิกมากกว่าการขายสินค้า 3. รูปแบบแชร์ลูกโซ่ที่ใช้วิธีการให้ความรู้และการใช้สื่อสังคมออนไลน์ที่เน้นการใช้สื่อสังคมออนไลน์เป็นเครื่องมือหาสมาชิกเข้าร่วม และการทดสอบปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อแชร์ลูกโซ่ จำนวน 11 ตัวแปร ประกอบด้วย 1) ลักษณะของเหยื่ออาชญากรรม 2) ความเชื่อ 3) การตกเป็นเหยื่ออาชญากรรมตามแนวพุทธ 4) แบบแผนการดำเนินชีวิต 5) กิจวัตรประจำวัน 6) โอกาส 7) การบังคับ 8) การสนับสนุน 9) ความสามารถ 10) ค่านิยม และ 11) เป้าหมาย/วัตถุประสงค์ ทั้งหมดส่งผลต่อพฤติกรรมการตกเป็นเหยื่อแชร์ลูกโซ่ มีแนวทางในการแก้ไขปัญหา คือ 1) การให้ความรู้แก่ประชาชนเกี่ยวกับรูปแบบของแชร์ลูกโซ่ที่หลากหลายและซับซ้อน 2) แจ้งต่อเจ้าหน้าที่ทันทีเมื่อประชาชนตกเป็นเหยื่อแชร์ลูกโซ่ เพื่อดำเนินการให้ความช่วยเหลือโดยเร็วที่สุด 3) ควรมีการบูรณาการหน่วยงานที่เกี่ยวข้องเพื่อให้เกิดความร่วมมือในการปราบปราม ป้องกัน และแก้ไขปัญหาการตกเป็นเหยื่อแชร์ลูกโซ่ให้เกิดเป็นรูปธรรม และ 4) ควรแก้ไขบทลงโทษในความผิดเกี่ยวกับแชร์ลูกโซ่ให้รุนแรงขึ้น เพื่อให้ผู้กระทำผิดเกิดความเกรงกลัว ไม่กล้ากระทำความผิด

งานวิจัยเรื่องทายาทความรุนแรง: แนวคิดการประกอบสร้างทางสังคมต่อการจัดการประสบการณ์ความรุนแรง เป็นการวิจัยเชิงคุณภาพ (qualitative research) โดยใช้วิธีการสัมภาษณ์เชิงลึก (in-depth interview) เป็นเครื่องมือหลักในการรวบรวมข้อมูล ศึกษาวิจัยผ่านเรื่องเล่า (narrative) ของผู้หญิงอายุระหว่าง 20 - 60 ปี จำนวน 5 คน ซึ่งเป็นผู้ที่มาจากพื้นฐานครอบครัวตั้งต้นที่รุนแรงหรือมีประสบการณ์ความรุนแรงที่เกิดขึ้นช่วงก่อนอายุ 20 ปีบริบูรณ์ จากการศึกษาวิจัย มีข้อค้นพบดังต่อไปนี้ 1) กรอบแนวคิดทายาทความรุนแรง อธิบายปัจเจกบุคคลที่มีประสบการณ์ความรุนแรงในครอบครัวซึ่งเป็นผู้ที่ได้รับ "พิษ" "ความรุนแรง" หรือ "ผลกระทบในเชิงลบ"อันเนื่องมาจากประสบการณ์ดังกล่าว ซึ่งอาจสะท้อนผ่านทัศนคติที่รุนแรง อารมณ์ที่รุนแรง จนอาจนำไปสู่พฤติกรรมที่รุนแรงต่าง ๆ ต่อไปได้ 2) แนวคิดการประกอบสร้างทางสังคมเป็นการอธิบายกลไกทางสังคม 4 ระดับ ประกอบด้วย ความรุนแรงที่แฝงอยู่ในระดับความคิดความเชื่อหรือวัฒนธรรมที่รุนแรง (Toxic Root) สภาพแวดล้อมทางสังคมที่รุนแรง (Toxic Environment) ความสัมพันธ์ที่รุนแรง (Toxic Relationships) และปัจเจกบุคคลในฐานะทายาทความรุนแรง (Toxic Fruits) ซึ่งทั้งหมดถือเป็นปัจจัยที่มีส่วนสำคัญทำให้ความรุนแรงในฐานะโครงสร้างทางสังคมสามารถถูกสืบทอดและถ่ายทอดมาอย่างยาวนานรุ่นแล้วรุ่นเล่า 3) ทายาทความรุนแรงสามารถเลือกจัดการกับประสบการณ์ความรุนแรงได้ 2 แนวทาง ได้แก่ การจัดการด้วยวิถีทางที่รุนแรงและการจัดการด้วยวิถีทางที่ไม่รุนแรง (4) ปัจเจกบุคคลที่เติบโตมาจากพื้นฐานครอบครัวตั้งต้นที่รุนแรงมีแนวโน้มที่จะสืบทอดหรือผลิตซ้ำความรุนแรงต่อไป แต่อย่างไรก็ตาม บุคคลนั้นก็สามารถเสริมสร้างพลังแห่งตนและเรียนรู้ที่จะจัดการประสบการณ์ความรุนแรงเหล่านั้นด้วยวิถีทางที่ไม่รุนแรงได้เช่นกัน 5) ในการยุติวงจรความรุนแรงในครอบครัว จำเป็นต้องอาศัย 2 พลังสำคัญ ทั้งพลังภายในของปัจเจกบุคคลเองและพลังภายนอกจากสังคมทุกภาคส่วนที่จะเข้ามามีส่วนในการแก้ปัญหาความรุนแรงในครอบครัวร่วมกัน เพราะฉะนั้นการเสริมสร้างพลังแห่งตนจึงต้องพัฒนาควบคู่ไปกับการเสริมสร้างพลังทางสังคมเพื่อยุติโครงสร้างความรุนแรง โดยสรุป เนื่องจากมนุษย์ไม่ใช่เป็นเพียงแค่ผลผลิตจากการประกอบสร้างทางสังคมเท่านั้น แต่มนุษย์เสมือนผลผลิตทางสังคมซึ่งมาพร้อมกับเมล็ดพันธุ์ที่ทรงพลัง ซึ่งมีศักยภาพในการเปลี่ยนแปลงตนเองและมีความสามารถในการสร้างสรรค์สังคมไปในวิถีทางที่ดีขึ้นต่อไปได้

This thesis reveals the development of micro, small and medium local food entreprise. Furthermore, this descriptive research uses a qualitative approach. The result of this research show that ODNR action has encouraged the appearance of UMKM in a culinary sector and it also provided local food – non rice and non wheat. The roles of UMKM in a ODNR action is producing, supplying, distributing, marketing local food, conducting inovation, socializing ODNR action, creating new UMKM and job vacancies. Domestic violence is a delicate matter in our society. Many efforts have been made by many institutions to decrease the violence that continues to increase every year. One of them is a prevention effort through a Men Care program that presents the male-engagement. Therefore, this study specifically describes the Men Care program implemented by Yayasan PULIH in Jakarta. This research uses descriptive method with qualitative approach. The results is to describe the forms of male-engagement including advantages and disadvantages faced by Yayasan PULIH in disseminating those issue, as well as strategies undertaken to attract the public participation into the program.

HIV-infected children have a longer life expectancy after the invention of antiretroviral treatment. Therefore, a well-prepared HIV status disclosure become a significant issue for children living with HIV/AIDS (CLWHA). This thesis is about Frank Johnson Sr. and the circumstances that led to his downfall as a farmer and father of six, to his tragic death in the isolation of a racially segregated mental institution 18 miles away from his home. Using his life and incarceration at the South Carolina State Park mental health facility, I argue that racial injustice contributed to his tragic death and the woefully inadequate treatment thousands of African Americans in South Carolina received during Jim Crow. This article presents a rationale for the infusion of social justice into kinesiology programs for the purpose of reducing inequities in society. Specifically, the current climate for social justice is considered and discussed using examples from an university-inspired service-learning initiative, law, and politics. Of note are the following areas of discussion: (a) differentiation between social diversity and social justice, (b) public pedagogy as a means by which to inspire service action, (c) the creation of climates for speech and application of social justice, (d) modeling and socialization for equity, and (e) the neoliberal threat to inclusiveness. This report examines the problem of concentrated poverty in the State of New Jersey. Both the individual and the long-term economic consequences of concentrated poverty are well- documented in social science research. The report adds to that knowledge by examining the practical, budgetary consequences faced by urban centers that are characterized by high poverty levels. The report focuses on four cities, which are represented in the New Jersey Urban Mayors Association (NJUMA) — Bridgeton, Passaic, Perth Amboy, and Trenton. Purpose: Layered with myriad considerations, school closure and rezoning processes in urban school systems are politically fraught with the potential for damaging consequences. This article explores the politics and impacts of a closure and rezoning process in Richmond, Virginia, through the lens of themes applicable to urban school systems and students across the nation. Understanding the context of suicidal behaviors is critical for effective suicide prevention strategies. Although suicide is an important topic for Asian Americans, there is limited information about what Asian Americans' attitudes are towards suicide and their perceptions about the effectiveness of prevention efforts. These questions are critical to examine to provide foundational knowledge for determining how best to intervene. In this study, Asian American (n = 87) and White (n = 87) participants completed self-report indexes on their knowledge of depression and suicide (e.g., estimates of suicide rates), coping attitudes (e.g., help-seeking) and suicide prevention attitudes (e.g., usefulness of PSAs). …

Digital games and simulations (DG&S) could help mitigate inequities in civic education and participation, which are found in many contemporary democracies. Yet incorporating DG&S into the curriculum may reinforce or introduce inequities for students who are less engaged by game-based learning. A quasi-experimental study of 301 U.S. high school students in social studies classes examined whether prior academic performance, civic engagement, civic game play experience and gender affected how (and which) students benefit from playing a life simulation game. This study aims at describing the subordination and marginalization of ex-commercial sex workers in Indramayu District. This qualitative research was conducted through in-depth interview and observation on 5 (five) interesting case studies whose data, then, was triangulated to ensure the valid-ity and reliability of the data. The results of the study showed that there were gender discrimination in the form of subordination and marginalization in education and employment which are applied at different periods, i.e.: before and after they worked as prostitutes.
